Comm. 00:02:01,100 Cleary here, mayor Smith here. Um, before we move forward to our proclamations Given commissioners, given the light of some recent events, I’d like to ask what your wishes are regarding Regular Agenda. Item four. A. Would move to table that discussion that’s already been tabled to two weeks from now. Second Do. We have further discussion. GN will call roll. 00:02:39,630 Mister Connolly. Yes. Mr Cleary? Yes, Comm. Marquardt. Yes, Comm. Anker. Yes, yes. Thank you. Now before we get to, uh, Public comment. We have two proclamations that we’ve been at that have been asked of of us or me. 00:03:12,230 The first is, whereas MD U resources was founded in 1924 as a small electric Utilities serving several farm communities on the borders of Montana, North Dakota and evolved organically and strategically over its 100 years into a multifaceted company with operations spanning the nation. And. They are currently headquartered in Bismarck. Therefore be it resolved that I michael Schmidt’s mayor of the city of Bismarck, on behalf of the city Commission. 00:03:35,200 Do hereby proclaim March 14th 2024, the 100th anniversary of MD Resources Group in the city of Bismarck. And then we’ll have we have another proclamation as well. And. I think there was somebody who wanted photos of The. 00:04:01,300 Other proclamation is is whereas the national drug and Alcohol facts week has started was started in 2010 by scientists at the National Institute on drug abuse and ID a to stimulate educational events in communities and to learn what science has taught us about drug use and addictions. 00:04:22,100 As such therefore be it resolved that I am Michael Schmidt’s mayor of the city of Bismarck, on behalf of the city commissioners do hereby proclaim March 20th through 26th 2024 is national drug and alcohol facts Week in the city of Bismarck. So. Those are the proclamations that there was a desire I heard of if you want to come forward. Did. So. Did you want to make a statement, or did you want to have a photo? OK. Don’t be so shy. We YEP. 00:05:25,170 OK? That Thank you. Really is exciting. Thank you very much. Thank you very much. I appreciate it. Much. You. I’m, the guy from MD Resources. Thanks for announcing Right? Actually clarity. Thank you. That much people just come up and not me. Thank you very much. 00:06:25,530 All right now on to the more formalities, Um This is the opportunity for public comment for anybody who wishes to speak on a Consent agenda item or a regular item that still remains. It is not a public hearing. Please come forward state your name and if you haven’t already signed in to let us know what you’re speaking about, the mayor have already signed in. So mayor and commissioners. 00:06:42,730 Good evening. My name is Terry Fleck. For the record I’m, a resident of Bismarck. Given the change in the agenda I might have approached this a little differently tonight. But given the what was all on the agenda. 00:06:58,130 I decided to come tonight and ask your permission to be placed on The agenda for one of the April meetings. I’ve got a story that I like to share. It’s called the Morrison Avenue story. And it consumes about 16 minutes. Comm. zenker was kind enough to allow me the opportunity to rehearse in his office. And. He he said I, so I told him. I said. 00:07:13,700 This could take 21 but he didn’t interrupt, which is which which shortened it, So. I’ve rehearsed it several times. And so I know it takes 16 minutes. And so if we could get the Morrison Avenue story put on the agenda, I think the good people of Bismarck would like to hear what happened to us how it got handled what went down and 00:07:26,970 perhaps, uh, maybe we can do some things differently in the future in the city as it relates to the Morrison Avenue story so with, uh with your mayor, I’d like to be placed on the agenda for one of the April meetings Commission zinker because Does it fall. I think under and Yeah, it does. So. 00:07:42,370 I think that certainly is appropriate. Thank you very much. Have A nice evening. Yes, thank you. Yeah. This is public comment period. Anyone who wish to speak, Please come forward. Second call for public comment. Third and final call for public comment. Erin and seeing no further public comment. Public comment period is now closed. Commissioners. 00:08:10,870 What are your wishes with regard to the consent agenda. Move to approve is presented. Second Is there any discussion? Here. No call all Mr Zinker. Yes, Mr connelly. Yes Comm. cleary? Yes Commission. Marquardt? Yes. 00:08:48,500 Moving to regular agenda Item four C request for resolution creating districts part a one a two and B resolution approving plans and specifications and authorization to advertise and receive bids for city concrete work. And Gabe your You’re like You’re on the hook. We got a couple of items were pretty straightforward here. Uh, good evening, mayor and commissioners. Uh, the first item I have before you is our concrete project that we do on an annual basis. 00:09:07,170 We have three parts to this contract. The first is our A one contract, which is new construction, new driveways and driveway widening is typically done in, uh, new developing areas of our town where we have a city contract to perform the work and either directly bill or special assess. Uh, the benefiting property. 00:09:26,900 The second project is part a two, which is our sidewalk Gap project where every year we get together with the sidewalk, Uh, portfolio holder and ascertain which which potential locations in our community. We would like to add sidewalks. Some of them are vacant lots. Some of them are constructive facilities that would benefit from a pedestrian improvement. 00:09:48,870 So the areas that I have Highlighted, uh, were in the packet. I’m not gonna go through through each of them here today, but I’m just gonna introduce then that third part which is our part B, uh, package, which is our hazardous sidewalk and miscellaneous concrete repair, where we identify areas in our community when we’ll do an inventory of those sidewalks 00:10:06,500 and, um determine if any of them are non conforming to the various standards that we have, and if so, we would repair those sidewalks and directly bill or special assess the benefiting Properties, um, so with that I’d take any discussions that you would have in any direction from the board for any questions. Commission. 00:10:25,630 Marquardt mayor and commissioners gave one of the things that we’ve discussed prior to, you know, whenever you bring one of these forward is some of the, uh, sidewalks in areas of Uh, commercial areas. You know as far as you know, not a lot of people walking necessarily from business to business, but it’s more in the commercial side. 00:10:43,870 What is the reasoning behind, um in the commercial areas versus residential, and then I got another question for you after that mayor and commissioners Comm. Marquardt. We look at really all sorts of properties. So. If it’s a residential area. It’s. 00:11:01,430 It’s usually more so that those people that live in that area want to walk within their their subdivision. Uh, we we, generally speaking will kind of avoid the area until it’s fully We know that the That over time, Those sidewalks will fill in organically as the houses are constructed. 00:11:18,030 Um, but over time, it might be 10 years later where that subdivision is 99% filled out, and there might be a gap here or there. Uh, so we’ll respond to citizen requests. Some of these would be indirectly response to citizens request, saying I would like a sidewalk. I’d like to be able to walk on XYZ Street, Um and we look at that and say, Yeah that makes sense. 00:11:35,670 Some of them are more SS staff, um, analyze in terms of looking at those same characteristics that we would find Throughout our community based on where we have sidewalks where we don’t What where the trail network is what the pedestrian generators and and origins are and kind of make a a our our engineering judgment when it comes to where we believe a pedestrian 00:11:53,230 facility would provide benefit, and we look at the same thing when it comes to commercial properties. There are some commercial properties that the site itself may not have a lot of pedestrian focused, uh, activity occurring within it, but there might be a adjacent sites or might be adjacent to a school or Or, or trail network 00:12:10,430 where we would find that that pedestrian connectivity while it doesn’t necessarily directly engage with that use that’s happening in the property it there is still a need or potential need for pedestrians to utilize that right of way, just like a a street user uses the street in their vehicle. So. 00:12:30,100 The other question I had is that you know as far as some of the curb and gutter or if it just a sidewalks that are going into some of the the residential areas or areas. Um, uh, vacant. Lots. 00:12:47,800 Um There’s a lot of the curb, or is it the standard curb or is it multiple curb? Or is it kind of a blend of each or do we try and do multiple curves? So that the, um either developer or the homeowner doesn’t have to tear that out? Pay for that again, and Um I. 00:13:08,000 Guess, depending I know, depending on which area because some contractors We do the multiple curbs Some don’t So what are your Thoughts on that Sure mayor and commissioners Comm. Mar or generally speaking, most of our developments have a standard curve in them. So any of the the gap projects were likely an older style subdivision where we really didn’t use modelle curve and many of those locations so the proposed sidewalk would just be valued. Just be the sidewalk. 00:13:22,930 Um if the landowner in a vacant lot, um type of example, knows where they want to have their driveway. We would thicken up that section. Um, if that’s where they knew that they wanted their driveway. So then, when that sidewalk goes in, it wouldn’t have to be tore out in the future. 00:13:37,400 Uh, but that driveway When it’s constructed within, uh, pull out the curb and put back a, uh, the actual driveway apron at the future point. But if we can program in where that driveway will be, That’s one less thing that has to get ripped out initially, but there’s other times where they don’t know where they want the driveway and those there 00:13:50,700 might be some sacrificial four inch sidewalk that would be replaced by some six inch driveway 1 1050 years from now, when that driveway is installed. Thank you, sir. Are there any other questions for Gabe? Comm. Zinker, actually, uh, mayor, uh and Comm., so you’ll notice the new sheet That’s in the, uh That packet of information. 00:14:12,800 Um, page 32 of the packet. And it has the The addresses with the years that the streets were constructed and and those types of things because that’s That’s one of the things when we discussed it with gabe, or I discussed it with gabe and staff as hey, How long are some of these Properties out there. 00:14:30,930 I mean, obviously, if there’s if you see a trail of people walking on the grass or whatever it it’s kind of common sense so to speak, that the people are using it and and the sidewalk should go in, Um I, too. Comm.. 00:14:46,270 Marquardt had a issue with some of the commercial stuff that we did, and I drove. Um, as Mister. Fleck stated the Morrison Avenue scenario and I. I do. Um, I do question some of those things that we put in the, um commercial side of things. Um, today is just a resolution to create the districts. 00:15:09,170 Um, we don’t actually approve it until we get the the bids back so we could still have time to Um, figure out what we wanted to do with this gap Project or, um, remove it completely, but Um, this list is actually Uh, smaller than what it was when I met with Gabe because we removed some some other items. And. Not all of this everything on this list. 00:15:31,630 Um Is private some of its public. Um, the very last item I’ll refer to as burly Avenue eclipse drive, trying to merge some crossings together. So, even though there’s some things on here. I don’t agree with with this list. There are some items like that that are beneficial to the community. So Thank you, Comm.. 00:15:51,700 And Because we approve it? I mean there could be some of these addresses that come out. Even if we put the rest of the gaps into it, correct, it could still be edited. Yeah Mhm Mayor Comm.. 00:16:08,900 I would add that when we go out to the bidding environment, and we tell the contractor that we were going to do 5000 lineal feet of sidewalk, um it’s in our interest as well as we can to have that marry up with what the expectation of what will happen. 00:16:23,430 This is a project that already has a significant amount of of landowners that will take it upon themselves to hire their own contractors, even though the city might have a contractor available to do the work, Uh, they might have a relationship with another contractor, and then we’ll have that person or that entity install the sidewalk so Is already a project that we might think it’s a 5000 square foot lineal foot job that turns into a 4000 or 3000 as it goes, and there’s just some additional costs for the contractor to 00:16:39,000 bond that higher number when in fact, um our what we end up giving that to to do work is less so it is beneficial if we can have some sort of alignment, But to all the discussion points that we’re going here earlier. 00:16:54,900 Um nothing’s like a set in stone until later, but we would want some direction if there are particular addresses that we’d want removed. Those could be removed here. Uh And then that would just Be removed from this list and a smaller bid package we put out to to market Thank you. Other questions or comments? Yeah. 00:17:11,530 So a few things that came up last year and have have come up already this spring is that, um, we, the city provides a letter to those landowners and says, Hey, you You’re in this gap project. Um You have until X amount of date to get this done type thing, and you only get a year to do it. So some of the commercial people, even the residential people. 00:17:32,400 I mean they don’t have an opportunity to quote unquote budget for it. So that does Create some some, um, anxiety. Um, there’s one person last year who was trying to sell his house and then got this letter type thing. So, um, there are some of those types of issues too. So I. Just. 00:17:53,630 Um I wonder if we shouldn’t take a look at this and and maybe those gap sidewalk areas. We notify those landowners that that they’ve been put on a a list, so to speak to close up some of those, uh, residential passageways, and then we give them more than just this construction season to do it in case they wanna they wanna do 00:18:12,500 it by a third party and not by the contractor that we that’s gonna be low on this because we have no idea who that Is until it’s bit out. Comm. Cy. Is it possible to to send out the those notifications. 00:18:34,170 Let earlier like you’re talking about as far as like, like if we’re approving this now and knowing that it could potentially change if they’re on the list now, can they get notified of it or how? What What’s the timeline usually like Mayor commissioners Comm. Clary, Uh, we’ve thought long and hard, internally and and with Comm. Anker and what the best time to notify and and to engage. Uh, there’s pros. 00:18:51,470 Obviously if, uh by early advance notification, saying we’re Considering this potential thing. Um, but at that point in time, we don’t know what the cost would be. So, then we’re just making an estimate of what the costs are. So if their first question is well, how much will this cost and we’ll say, Well. 00:19:06,400 We don’t really know if we we can give you an estimate, and then they’re basing it off of that estimate. Um, the longer we wait, we would typically send out that notification after we have open bids for this 2024 project so that we would be able to say your cost will be you know, $5000 whatever that 00:19:21,130 number is, if you have it assessed or or bill through the city if you Go through somewhere else. Then at least you have that. Benchmark to go from, uh, that if it’s less than $5000, and you’re going to have it invoiced anyway, it’s probably better to pick that other contractor that can do that work in that particular 00:19:36,570 circumstance, But I want to be opposed. If. There’s a concept of Um, we give the landowners a notice and we say, have it done within this year or even the following year? And if they want to select this contractor to do it now, great. They’ll do it. 00:19:51,100 Uh, but if they want to do this privately and do that themselves, give them a longer lead time to do that. That would be more than adequate from our perspective. Mr Connolly. In the last three months. I’ve walked a lot of streets and, uh, some of these sidewalks are fairly new, and it’s like right along where the water pipe is. 00:20:13,430 It’s heaved in the middle and broken. Um Is that something we go in and replace without an additional special assessment because it seems like sidewalks should last longer than some of those areas. Nebraska Avenue is a good one. There’s a good chunk of number Nebraska where it’s broken already, and they haven’t been in there that long. Sure, Mayor commissioners Comm. 00:20:34,230 Connolly, generally speaking, if if the sidewalk fails, it could be a combination of of either the the sidewalk was constructed. Uh, incorrectly um or more than likely there was something underneath the sidewalk that might have not been compacted well enough. In the instance of a a curb stop. 00:20:53,070 That was, um That settled, potentially if if that’s your example or if maybe you had just differential settlement, it could be any combination of things, but it could also be the the excavator that the landowner hired to connect to the city provided curb stop. 00:21:11,100 Then it, then react that same trench to the same, uh, compaction requirements on their own property or or or in that adjacent property. Uh, and that’s what could be causing. Uh, the Settlement to occur now in those situations those would be identified if there was a hazard, uh, within there that that would be identified as a hazard that would have to be Addressed. 00:21:29,830 So be special assessed or the landowner could address it themselves through a privately paid for contractor. Thank you. Commissioners. Or. Do, You wish to proceed. So, Gabe just to reiterate your comfortable giving the gap people two years to To fulfill that need mayor commissioners. 00:22:21,770 I would be comfortable giving them two years if they did it privately, but if they ever have it assessed against their property, Um, for that to be done in this Here. So that we know if we have a project and what we can actually tell our contractor how much work they’ll do, cause we do our contracts on an annual basis for this type of work, and so it might end up with the odd contract that we might have 00:22:37,700 zero work this year and 5000 ft next year, or 5000 ft this year and and nothing. Next year. I would be cautious that they would change their bid prices if we kept the contract open for multiple years, taking that into account, not knowing when that work will occur. 00:23:17,270 Let’s Let’s break this up, I’ll make a motion to prove a one and B and then we can have more discussion about the Gap project with a two Second We have first and a second. What a one and B. I. Got that right, right, correct, OK. Any discussion. Hearing Dun. We’ll call roll. Mister marquardt. Yes. Comm. sinker. Yes, Mr Connelly. Yes, yes. MEMS? Yes. 00:23:53,430 Now Comm. zinker watching So. More more discussion. I need to so I. I understand. Um Why. We do this, Um But with the The costs that have driven up. 00:24:18,970 I think, gabe when we discussed Remind me what The linear footage was Price was it was last year because we we changed a few things because some of the landscaping wasn’t getting done, so we added landscaping back in for last year. And and it and it moved that price. Uh, but I don’t remember what that discussion what it was when we discussed that mayor and commissioners commissioners anchor I don’t have the the per foot price on me. But. The. 00:24:40,370 The total project is about $300,000 worth of concrete work and about $100,000 worth of, um Restoration. If that’s It was about 400,000, a little less than 400,000 total would be this this 5000 And that some of its 4.5 ft wide sidewalks all of its 6 FT side sidewalk, So it’s pretty OK. And. 00:25:05,130 Most of it, I think was That’s a pretty good split. 6040 residential. Yeah. You would you would find Mayor and commissioners Commissioners anchor than any of the 4.5 ft sidewalks, generally speaking, would be in our residential areas and the 6 ft sidewalks would be in the commercial areas as kind of a Area of shorthand note to Keep track of which ones are are, 00:25:23,370 which Can you tell the commission which one of what? All of these projects that are A, uh, gonna be City projects and not special assessed. Sure that I can identify the city related projects. Uh, the very bottom one, the burly Avenue and calypso drive Trail crossing was identified in the 2024 budget. And. 00:26:10,230 There’s dollars that will fund that particular component of it. A Trail crossing and some signage. The other two Have to find the addresses, but they’re up in Uh, Older Ridge area and they are adjacent to stormwater. Facilities. I, grab my map here. They would be at, uh 5250 Normandy Street. 00:26:42,830 And then Like, a 509 and 512 Flint shows up on the map. Hopefully. Those are addresses that show up on that. Yeah, there’s actually three In a role. OK? Yep. Yep. Perfect. 00:27:16,400 I understand that concern of The sidewalks and the special assessments But in some of these neighborhoods like these are single out lots where there’s no sidewalks and we have people pedestrians walking or having to jump off the sidewalk into the street that becomes kind of a pedestrian hazard. This is a very difficult I mean I. I understand the cost side of it, too, so I don’t know what the I mean it’s It’s difficult. 00:27:40,500 I don’t Certainly some of those older places seems Well mayor commissioners. If it does add we we haven’t started our advertisement. Portion of this project until after this commission meeting, but we would have time on our second meeting in March if there’s a is there more concerted direction or some addresses that should be removed that we could. If there’s direction now. 00:28:00,870 That would be obviously preferred. But if there’s direction at the second meeting in March, we would still have time before we open bids on April 2nd to then issue an addendum that could, you know, remove a third of it out of fifth of it. 00:28:15,370 Whatever the the changes might be, um, we end up giving our contractor just a square foot. Price of quantities without really getting to the specifics of here here or there, um, so it’d be pretty straightforward addendum. If there’s A desire from this board to Think through how they want to proceed with this. That being said at table. A two till the next meeting. That emotion. Yeah. Be motion. 00:28:47,570 Second OK? What parameters Do. We want to give gabe I was just gonna ask that question if I could maybe add another thing to we would want it created, though, so we can start the advertisement process if if that’s if it’s created with a condition that it comes back in in two weeks for further discussion, that 00:29:03,500 would be, I. Guess my preferred option, or else I. Guess. We wouldn’t really be able to start this process, and then it would move the contract back two weeks. If if we don’t have any direction to even Start. The discussion on a To in particular. 00:29:25,000 So can we Edit the motion or do we need to fully withdraw the motion? And start over. OK. I can withdraw it. Withdraw the second. OK? Thank you. I. Do we all consent to that, OK? How. Did you say that you would rather have it if we tabled it for further discussion. 00:30:27,300 If you could, I guess my my preference would be to create the A two Um District and the resolution approving plans and specifications in the resolution to advertise and receive bids for city concrete Project 24 a two but if there’s additional direction that you’d want to provide staff and come back to you at the next meeting, we would still have time to then modify that package that would be out on the street. 00:30:45,800 Uh, we advertise this for three weeks, so we still have time to go in and remove quantity from that package. Before everyone opens up their bids or before we open their bids up. 00:31:11,730 I was just trying to think of what other Um What else as far as direction that Or some guidelines to take a look at I guess Comm. Zinker with that being your portfolio in some of your other concerns is there is there. Is there something that you would like to see your different direction? Um, well, I, I would say it’s not always my decision. It’s our decision. 00:31:28,800 Um then that’s why I had Ask Abe to put together this So we knew how old some of these properties were right. Right. Um, obviously the ones that are the newest on here. The 20 twenties are city properties. Right because of the because of the drainage easement. Um and then do we have, you know is there Other litmus test or just something. 00:31:49,230 Hey, if it’s If the development is 20 years old. We need to close these up type thing. We really don’t have to be honest with you in the ordinance. I don’t think there’s measurables in there is that correct? Gabe? There’s not a metric mean Comm. Comm. anchor that that will guide the discussion. It is based upon the order of the city. 00:32:07,770 Uh, Commissioners and so it would be up to you to decide what what is it that you would value and and places the reasons that we would put forth these addresses? There’s been years that we haven’t done the project that was more in the boom time where our contractors were having a difficulty Just keeping up with the new 00:32:22,630 construction, so we piled on the Gap project for a period of time. Um, I don’t think we’re to that point from an industry standpoint, but there might be other reasons or rationale. You’d wanna Um, consider this. So. Just through. 00:32:40,370 What about if it’s a if it’s 1515 or 20 years, something seems that seems somewhat reasonable because I just think about where I live. And. There are lots that have been out there now roughly 1512. 15 years because that’s how long I’ve been in the ground he had. There are a handful of lots with sidewalks on it would certainly be nice from a pedestrian to have those closed up. I get it like If. 00:32:57,470 Something’s 10 years it, it takes absorption to fill those up and that 10 year absorption in a development is not out of line. From my experience in watching developers. 00:33:13,700 But after 10 years it’s getting to A close that point, so I don’t know it was 15 years reasonable or that would be like 2008, then. Kind of time frame I. I don’t know the the in the commercial side is a different animal. And. I don’t know how to address that. Comm. thinking you’ve walked more of that, so Yeah. Well. I mean commercially. It? It depends right If. You talk to those some of those business owners. 00:33:34,300 They don’t want sidewalks at all because it creates Two fold Problem one, They gotta maintain it and to it invites people to. Unfortunately. Some of the homeless become their neighbors that they that aren’t supposed to be there, you know, type thing, So, Um and people worry about break ins and theft and and things like that. So. 00:33:57,330 Um yeah, that is from a commercial standpoint and after driving Um Morrison. The last couple weeks. It’s like we might have Might have slipped up there. So So, Yeah, But I do like your 15 years on the residential. 00:34:18,730 I think that seems Um, a good metric to go by, because generally by then those lots of pride been sold, and it’s into a second hand. And sometimes, but there’s also those adjacent law orders who bought two at the time. You know there are some of those handful of those in there type thing. So OK? I. 00:34:38,400 I can go back with Gabe and we can have deeper discussion and come back with a list from there. OK, but I think we need to get a motion to On to a grant the authority to whatever, however, one term that I use. I’ll make that motion to as gay presented. Mart mayor and commissioners. Uh, Gabe, Ty that concrete. How long are they? I mean have they been in the community for a while? I mean? That’s a new name? For some of the stuff that we’ve seen come across. Sure mayor Commissioners Comm. 00:38:05,600 Marco Teak is a company that’s done work for us before. So game. Say that again. So do the award that was in the agenda packet identified, uh, confirmation that the city will receive grant funding from DWR and concurrence from Bismarck parks and recreation at their march 00:41:15,970 21st meeting. We would want to remove the condition of the DWR grant funding to do that we would have to hold this contract for, uh, Through April. 00:41:32,570 And then that would delay the contractor’s ability to get in and start doing the work so we would want to award that, Uh, we still have a high degree of confidence that the DWR will fund a cashier on this project. But in working with the utility, Uh, public works utility director Cloy, She has a comfort level that we would want to still do this even if that funding fell through, we would still want to move forward with this project.
