Um In October of 2022. This Commission approved a development agreement to allow Executive Air taxi to build a 260 by 100 and 20 ft building. Uh, I believe the commission approved the development agreement without being provided all the necessary facts to make an informed decision. 00:06:13,170 Uh, a few months prior to that in June of 2022 prior to executive Hes Development agreement. Uh, this very commission also approved a development agreement with Bismarck Aero Center. That has several areas of conflict with the executive Air Taxi. Development agreement. Uh, most notably, the Bismarck airport has promised the same parcel of land to both parties through development agreements. 00:06:35,930 And, Um but But today I think what’s most timely, uh, is regarding the development agreement and how it includes a lease extension provided by the city of Bismarck, the Bismarck Aero center as it relates to the city owned building. Uh, in the parking lot associated with that building. And. So if you look in your packet, I think on the third page. 00:06:55,370 You see a diagram of that, says January 2024 at the bottom of it. And, uh, I have kind of an orange blotch there that indicates the the area that we’re describing here. And so if you look closely 85 is the building that we have, Uh, based on the legend. 00:07:20,430 It’s labeled as number Building five as the building that we have a an extended lease and parking lot agreement on Um, that’s a city owned building and that’s impacted by this development. Uh, most of you are involved in small businesses of your own. And. I ask you to imagine that the you know your city government provides a lease to you. And within months of your signature. 00:07:44,130 Uh, approves a separate process that displaces your parking and allows your direct competition to build in your parking lot. The New building displaces direct visibility and access to your facility and redirects all traffic to your competition. 00:08:06,400 By, allowing executive air taxi to develop this area, while Bismarck Aero centers occupying what is called building 22, or labeled five on that diagram. The City is allowed development to impact both visibility and parking. That’s vital to the safe and convenient access to the facility. Uh, frankly, the development agreement cuts off accessibility to not only our business, but airport access to general aviation users. Examples of general aviation users. 00:08:28,530 Um, that will be impacted include local businesses. Local state and federal agencies, emergency responders, air, ambulance and other outside business and pleasure travelers. That bring significant commerce into our community. Furthermore, the construction process, and our climate is typically slow. Were concerned that airport officials have not been transparent with not only executive air Taxi City officials but also our organization Bismarck Aero Center. On this issue as it relates to airport development, fairness and transparency. 00:09:19,370 We do not believe the airport has acted within the best interest of the city of Bismarck. We’ve been challenged with providing solutions and we have done that, and our solutions have been ignored. So far we’ve generated $43.8 million through 2023, and it does have 10 Year sunset. Um, but it was a a reconstruction of that facility. So for all intents and purposes, we’re not going to touch it again with with additional dollars for a while here, um, newest additions to this map would be in that bottom right corner Showing Century Avenue, Uh, extensions in 2026 that programmed project. Uh, that we’ve used the yellow highlight are the contracted cost. There will be what you’ll see in the 2025 to 2029 C IP, uh, with our construction costs, the engineering design and engineering costs. 00:19:23,770 Uh and then whatever federal or state aid Were able to use uh, in these program, which gives us a net nail, Uh, sales tax cost of the difference between what the construction prices have been, uh less what the federal or state aid has been in this program. So looking at that over time. 00:19:43,600 This is one of my favorite charts that I get to update on an annual basis or or even more than that, Uh, lists the project costs in orange that will be a A negative on this chart a anticipated have set sales tax in the gray, which shows what we’ve collected those years. 00:20:04,370 Um, I’ll, I’ll and then the estimated balance of just the difference between that, um Collections less what we’ve spent in those projects is what the that blue line over time is. I put a couple of caveats on here. The anticipated have sent rails half sent revenue. Um, is the actuals up to 2023. So. From that point on we just held the 2024 25, 26, 27 and 28 revenues flat. 00:20:23,400 Um, whether or not it stays there goes up a little bit goes down a little bit. At this point in time we feel confident that we’ll collect enough money in this program to pay for whatever projects but we will get to a point that we need to either slow that down. 00:20:36,530 Wait for it to actually accrue before we spend the dollars or or come with a different funding program. Uh uh, less that we end up spending more than this particular particular, Uh, tax collects would want to mention too. That Project. Cost is the year that the construction took place. But. 00:20:54,670 There are various, um, federal dollars and those federal dollars come in that might have came in a year after or or even two years after the, UM project was completed, so point taken being, uh, our 2024 project. In South Washington Street, uh, does have federal aid allotted to it $4. 00:21:14,830 5 million, but that money will not show up until 2026 so that money once we receive in 2026 for all when I’m looking at this, uh, just gets backdated to the the year of the construction that took place, but, um, so there might be a a different cash flow than Then, uh, if you took into account the year that that federal dollar was received But it does show here in 2026. 00:21:33,230 Based on all these estimations that by the end of 2026, we’re kind of even like we have. We’ve paid for all the projects that we’ve done. We’re not in the hole. We’re not in the black. We’re just kind of really No. No Balance One Century Avenue project is completed. 00:21:46,600 Which brings me to the request that I have before you is to talk about what that next project should be and whether it’s done in 2026, or 2027 could be debated. But. Uh, what I would recommend was the next project is the Tyler Parkway extension across Tyler Cooley. This would take us from Valley drive north to Cogburn Road. It’s about 3000 ft of Corridor. 00:22:07,170 In this particular area of town the it would be an urban extension is how we would envision this so we would pull that typical section from South of Valley Drive, the curb and gutter streets with with the sidewalk lighting, etcetera pull that type of section across the coolie and into Tyler Parkway, uh, to at least Cogburn road is how I’m 00:22:26,300 envisioning this, uh in instead of pulling What is Tyler Parkway north of that south with it. Everything north of Cochrane Road is a rural two lane section. Uh, with no lighting on it. 00:22:45,100 Currently there will be a trail constructed is part of a parks and rec and DOT funded project that will take a trail from Cogburn Road, uh, north to Ash Coole drive. It’ll be constructed yet this summer so this project would tie in nicely with the trail connectivity on Tyler Parkway as well as the trails that are existing on East Valley Drive. 00:23:02,170 Um, should note also that we would look for opportunities to tie in some of those wreck trails that you’d find, um within the coolie itself, Uh, using any aerial photo you look, you can see a whole, uh Network of paths, not improved trails, necessarily, but, uh Powers. Nonetheless the public are using and recreating try to find ways to integrate those into this project. 00:23:19,800 Uh, so this embankment that would cross East Valley or the that would cross from East Valley Drive. Um, it doesn’t look as an impediment to that wreck use but really an additive in trying to connect more people to that trail network. 00:23:36,830 This project would be Constructed in part with our stormwater management plans that we have in this area we do or we have identified and are working on designs. Final designs for special assessed stormwater improvements for regional detention in this watershed that would go all the way from Pinehurst Square to the the The Tippy top of these last hills that drain towards this area, those embankments would be planned for construction in the next couple of years. 00:23:56,030 In the watershed We look for opportunities to marry these projects up potentially so that they’re in the similar timeline so we can In that coolie once and just do all the work at one time. 00:24:11,200 If there’s some efficiencies there to to look at I will want to be sensitive to geotechnical issues in this area, so it’s probably not something we’re as concerned about in, uh, South Washington Street, which you’re constructing right now. In these steep slopes. It’s pretty flat down there, but I will obviously be a point of very high concern Here is how how steep slopes are safe. 00:24:25,970 What sort of structural elements do we need to consider when we’re putting dirt on top of dirt, and now? 50 ft of dirt, potentially on top of that existing soil? What do we need to do to make sure that’s safe and doesn’t uh Settle in in areas that we don’t expect. Would offer. 00:24:43,770 Also the concept of of potential traffic calming type improvements on this court, or really anywhere from south of Tyler Parkway at Century Avenue north to Ash Coole Drive as a mitigation component of what the extra traffic that we might find on this corridor. Once. It’s constructed, Um it’s not generating any new traffic today. It’s all traffic that probably gets there eventually. 00:25:02,830 Um, but in the future, this will become more and more and more of a corridor that people will use for Northwest Bismarck. We want to make sure that we are provi A safe way for everyone to use that, but the people that live in in Live on those streets as well as the people that just want to drive through those neighborhoods as 00:25:14,800 well. My last piece. I’d say this project will include right of way. Dedication, uh, where you see Cogburn Road at the north End of this is the last I should say is the last area of Platted right of way on both sides of the road. 00:25:30,570 Uh, the plat for Elk Ridge Third edition dedicates half of Tyler Parkway, Uh And then there’s no right of way Dedication for the coolie land itself, so those will be elements that we’ll have to secure as part of this project for us to be able to construct this roadway That is a little bit different than other projects that we’ve done where we’re rebuilding a road like 00:25:43,900 South Washington Street that it already has all of its platted. Of way secured Uh, we would anticipate a 2026 construction for this project. I’ll put that with some caveats that it might be a phase project where we put the embankment down in a given year and let that settle before we go back through and put the 00:25:58,300 paving on or put the utilities across it as something that we would be considering this isn’t the only way in and out of this area, so letting it settle might be worthwhile for us to explore, But. We just don’t want to sit it out there for an unreasonably long period of time. 00:26:13,900 Uh, for for no particular reason. So with that this Next slide shows what those committed projects will look like, plus what we would anticipate Tyler Parkway costing something you know. 14 $15 million for an all in price is what we’re budgeting at this point. Um so the consideration of what would it take to do an animal? Crossing or something along those lines. It is very much a specific type of animal that you’re shooting for. I should say shooting aiming for it. The band Girl named Tom Coming to the bell. August 15th, the moth main stage going to the bell. November 20th. The price is right Live is coming on September 11th. 00:35:08,870 We have a family show blippy coming for November 20th the band Dropkick Murphys with Pennywise and the scratch is coming on October 20th into the arena and then we have comedian Steve O coming to, um the bell on August 10th. So those are just some of the, um on sales and announces we’ve had in the last few weeks. The events that have played out. 00:35:28,070 Uh, like I mentioned we had talked about 48 of them and we have been very busy, uh, in the last 30 days, we’ve had approximately 8000 people walk through our doors for a variety of events, including a Broadway show. And you know from 2008 until today. Uh, they’re highly competitive. Um, and there’s been limited space to develop on the airport. Uh, we have for 15, or 20 years tried to open up the north end of the General aviation area. 01:00:16,030 Uh to more, uh, development, uh, of new hangers. Uh, to the north where you’ve you’ve seen the two Bismarck a centers, latest hangars. Going in. And Um there was some older hangars and some older buildings. 01:00:38,430 We took down the old Meisner building with that was actually on the other side of university drive before the road was moved over, um, but ended up on the wet on the East side. Um, after the DOT pushed the road over which allowed for our development, Uh, change in that area, And, then we just recently took down hanger five. 01:01:04,430 Um and and and then, uh, hanger 38 the old way point building that was purchased by, uh, executive Air Taxi some years ago. Uh uh, after Fargo Jet Center acquired it. That building just went down. So all of the pieces and parts of this redevelopment plan for the northwest area of the General Aviation area is, uh, coming to fruition. 01:01:31,270 Um, uh, This is kind of a long story, but it’s It’s, uh, I think necessary history for for some of the newer commissioners and others, um So when? When that hanger 38 went down, it opened up. A space between executive air taxis. 01:02:00,630 Um, uh, northernmost, big blue hanger that they have, and there’s a there’s a gap in that in that area between the executive Hes, uh, northernmost Hangar and Bismarck, Eo centers, um, southernmost hangar. Um And there is no There was no claim for, uh, development space. Uh, by Bismarck Aero center on any of that space in there. 01:02:34,170 We use the development agreements because we can’t, uh, provide a right of first refusal to, uh the tenants, uh, for extended periods of time, uh, through their leasing, uh, for their their leases for their operations. Uh, we can’t provide a right of first refusal and, um Uh, Bismarck Aero Center put their development agreement together. Uh, first and then, uh, after their development agreement was passed this commission Executive Air Taxi asked to, uh, come in and utilize, uh, most of that space in between there. 01:03:02,970 Uh, we had originally thought that there was gonna be two hangars that were gonna go in there because that’s what historically we had heard from both of the F BS. 01:03:26,970 But when executive air taxi put in their development agreement they asked for, uh, a majority of that space and, uh, that is and would be, uh, the last, uh, a bit of space that they could develop. Uh, that would be contiguous with the rest of their operation to the South. They have their original hangar. They have the the the, uh blue. But that was Excalibur aviation many many years ago when they put that hangar in Executive ve bought that they it was moved over and put in place. I’m carrying a little bit of the water for for paul, but I mean I’ve heard this from him. This is their last chance to develop, uh, contiguous with their existing operation. Did that did that. Uh, in that building, um At the same time as their development agreement came through for the two northern at Sea, the two northernmost hangars and then the space in between. There is under, uh, a development agreement for Bismarck Aero Center to build their new FBO office. And so we are in a lease right now with Bismarck Aero Center until 2029 for building 22. So. 01:06:43,970 This building is gonna go, uh, in right behind it, and that building 22 is gonna be out on What will eventually be apron space. But you know, as the airport develops, we develop and chunks and and you know, pieces and parts and and, uh, try to, uh, stay ahead of develop. 01:07:09,100 Uh uh, of the the development desires of the tenants in building apron out in front of the of their buildings. Um, but this this the time frames of this got a little bit out of whack, right? I’m just trying to understand like if they And, a five year lease that puts them to 2029. But this building is going to be built.
