We’re located in the Ed Bosch Frelich meeting room here at Mandan City Hall 5:30 P.m. Could I have roll call, please. Commissioners roar here. Olson Camisa Air Braun Heling. Here. Next we will do the pledge of Allegiance. 00:00:42,730 I pledge allegiance to the flag. The United States of America. To the public. Individual Justice. Next on the agenda is the announcement side. I. Thank you to our community? Let her clean up month volunteers. I know there’s been a ton of them, and Kerry’s had a lot to do with that. So. Carrie, You. 00:01:11,430 Wanna give us an update. Yeah. So. The month of May was the litter cleanup for the ditches throughout, Um 20 areas in Mandan. We had over 200 volunteers and I’ve got some pictures to show you. Um not everybody took pictures, but a lot of our groups did. Um And. 00:01:39,100 I do wanna give a shout out to jason Herman and our grounds maintenance crew. Um, they go out and pick up the bags after the volunteers do the route. This last slide has all of the different groups. Um Again. This is something that we used to do in one day. We’ve changed it now to a month. 00:02:03,170 We’re still having over 200 volunteers help with this, and it seems to work a lot better by it being a month long event versus one day. Thank you, Carrie. I know I’ve heard a lot of good things and a lot of people like not having to be tied down to that one day and And I’ve seen a lot of groups out there doing it So again. 00:02:17,600 It’s an awesome community And. Thank you everyone for that’s volunteered to do that, thanks for the steady staff for picking it all up and It’s worse seems to work out well for the community. Um, I married to and I’m, bound by the weather so much, too. 00:02:32,730 That way can be pretty nasty some days to go out there if you had that one day As long as we’re on announcement, so there’s a ton of announcements that I’d like to make as long as we’re there. 00:02:49,600 Uh, tonight There’s the Mandan Market Nights, uh, put on by the mand in Progress organization, uh, the craft vendors and food trucks and stuff. I believe it’s going on tonight in Dykes Shan Park from 430 to 730. Thursday night we got the Morton County charity run. This is kind of a unique thing Put on by again. 00:03:10,970 I think the Um Man Progress Organization had a lot to do with this and the benefits that go to the community foundation that starts at five or 430 at the Braves center Friday night. We have races at Dakota Speedway and Halloween in June at the Fort Lincoln State Park. Saturday, the UM Dakota, Manda and Lyons Kite Fly in, uh 10 a.m. to 4 p.m. at the middle school If. You haven’t seen that before. 00:03:29,330 That’s really cool I happen to be in Jamestown last week, and they had one and it was a really awesome event. Of. Your kids are looking for something to do. That’s something to do. We have a truck and tractor paul at Dakota Speedway at 5 P.m.. 00:03:45,570 On Saturday the classic car parade for buggies and blues is at 6 P.m., the buggies and blues. Uh, party is 3 p.m. to 6 P.m.. Unleash to start at six at three o’clock. Shirts and skins from 7 P.m. to 11. There’s beer gardens and food vendors. Sunday. We have the fly in, uh, planes and pancakes 8:30 a.m. to 12:30 p.m. 00:04:08,100 out at the Manden Airport Lawler field and buggies and blues car show from 11 to 4. So. I’d like to thank everyone who volunteers all the businesses again that sponsor everything. It’s really awesome the way this community comes together. I’d like to thank the police department and and all of the city staff that’s had anything to do with this. Um, again. You look around town. 00:04:26,700 You see the flowers going up again? I know I mentioned at the last meeting. I noticed that flower pots are hanging off of the light poles now, and the banners are up. There’s a lot of really good things happening in the community. So thank you to all those involved. Now we’ll go on to the minutes. 00:04:43,830 Consider approval of the minutes from the May 21st 2024 Board of City Commission regular meeting. And move to approve the minutes as presented. Motion by Comm. Kisa seconded by Comm. Braun questions or comments Roll call vote, please. Commissions. Braun Camisa Roar Mayor Hell Yes, that motion passes, we’ll move on to our public hearing. 00:05:11,170 Consider the right away vacation for a portion of right away south of Mackenzie Drive southeast in Lakewood, Sixth Edition, Andrew. Good Evening. Good evening. We’re he and Comm.. This is a request from TRX developers for a portion of the right of way. Of, uh, south of Mackenzie drive on my screen. 00:05:28,230 You can see a location map for this area. It was dedicated as right of way as part of Lakewood Sixth edition in 2012 with kind of limited record as to why it was dedicated as an oversized right of way. 00:05:48,430 It’s believed that due to the limited amount of space between, uh the the former lower heart oxbow and, uh, the East west alignment of Mackenzie drive that there would not have been a developable parcel in there. Therefore, it was Dedic. That’s right of way. 00:06:09,830 It wouldn’t have met the minimum depth or, uh or other developable development requirements rather to be able to build at that time, Uh, the development uh, the developer and the development in this area has has changed over the past decade or so. And is now planned to be a private road and the, uh the applicant TRX seeks the vacation of this portion so that it can be converted to private property and developed as a private road. So. That’s where we’re talking, Um today and an exhibit. 00:06:32,770 That shows the amount to be vacated is included in your packet. I have it on the screen as well as the 66 FT wide strip of land. That would create a, uh the appearance and function of a four Legg. Intersection of Mackenzie Drive with East West Mackenzie drives and 34th being public city streets. 00:06:55,630 And, a private road coming, um off of that from the South. Uh, this is sort of Kind of a a forced alignment for this area with Mackenzie Drive being a principal arterial road, the homes that are planned for the lots here on the screen. 58 59 60. 00:07:16,570 61 and two will not be able to have driveways or garages that load directly onto McKenzie drive due to Um, access management concerns so those homes would use this private drive to get out at a at a at a driveway location that’s consistent with the intersection of 34 that could reduce any potential conflicts that might be raised with a new access point on the arterial 00:07:34,700 road. Uh, this is an area that the city presently does use for, Um A Yard waste collection site, and it’s been verbally committed that the developer would assist with the relocation of the the grass grass and Leaf dump collection site. The tentative location to relocate that to is the northwest corner of Man Dan’s wastewater treatment plant. 00:08:01,970 And the developer is like I said, verbally committed to assisting us with developing that site as a replacement. Um, sort of as a condition of approval of this right of way Vacation. Um Some details are yet to be worked out with that, and and staff’s intent is to have this right of way. 00:08:21,570 Vacation be contingent on the final Plat of shores at Lakewood Second Edition. Uh, said Platt, which would be approved contingent on all of the bells and whistles necessary to relocate the grass dump site, etc. 00:08:38,970 So we will have that as a contingency of approval for the shores at Lakewood Development, um, but using the plat to be what kind of Solves all these problems. As, the ultimate, um, item for contingency. We did notice this item for four weeks in the Mandan news and are recommending approval contingent on that, Um, final plat and the recommendation would be to consider the resolution of vacation under resolutions and ordinances and conduct a public hearing. Now. 00:09:01,370 Do, You have any questions for me? Questions of Andrew Mayor. Andrew was one quick question, so if it’s gonna go into a private road network, are they setting up an HOA as part of shores to to handle that? Mayor. He win Comm. Kisa. 00:09:20,530 Yeah, There’ll be a rather robust HO A for the development, which would include, um Terms relevant to the maintenance of that and who can access it? I did also want to mention I Made the correction in the physical version of the resolution. There was a date that was wrong. And here. 00:09:40,100 We did a vacation for Georges at Lakewood in February and updated the document from that one. So. This is February 6 was updated in the the written version of the resolution to Today’s Day, June 4th. Thank you. Any other questions of andrew before we open the public hearing. 00:10:02,030 OK with that we’ll open the public hearing to consider a right away vacation for a portion of right away south of Mackenzie Drive southeast in Lakewood six edition. Anyone in the audience online or on the phone With questions, comments concerns Anyone like to come forward. Third and final call anyone Seeing. None. I’ll close the public hearing and turn it back to the commission. 00:10:25,870 Move to approve the right of way as requested contingent upon the approval of the final plan for second edition. Second Motion by Comm. Braun seconded by Comm. Rohr questions or comments of the commission. Where he Comm. would we be able to move under resolutions and ordinances to do the motion? I apologize the agenda. 00:10:49,130 I got that I’m working off of isn’t complete so I printed one out, so I’m not sure if I have the clear there. The I believe it’s under resolutions and ordinance item number one or two. OK. We’ll jump to resolutions and ordinances. Item number one. 00:11:08,770 Resolution of vacation for a portion of right away in Lakewood Sixth edition commissioners, This would be the vacation that I just talked about. It’s just helpful to make sure that we have emotions under the right item, so staff is recommending approval of the subject vacation for, uh, shores of Lakewood second edition contingent on the Final Plat, for short is at Lakewood second Edition. Do. You have any questions for me? Questions. I do have a question. 00:11:23,900 Uh, we had a motion in the second on the table in the first. Believe we had a I think we have to resolve that before we can do anything else. So. We did have a motion and a second. Or Yes withdrawing, right? Yeah. Comm. Braun made the motion. I believe, OK. 00:11:42,370 I withdraw that motion and I withdraw the second. OK, then we’ll move on to resolutions and ordinances. Now I move to approve the right of way, as requested contingent upon the approval of the final Plat of shores at Lakewood Second edition. Second Motion by Comm. Braun Seconded by Comm. Rohr. Questions or comments of the commission. CNN hearing. 00:12:01,200 None are roll call vote, please. Comm. Camisa. Yes Roar Braun. Yes mary He. Yes. That motion carries. OK, we’re gonna move on to the consent agenda. Jim if you please pay attention, Like. I said, I’m going off of one that I printed out at work earlier and I’m not sure that it’s the most recent In such agenda Item number one. 00:12:22,530 Consider the amendment to the lease agreement with Marathon petroleum Company and the city of Mandan related to the property, which houses the raw water intake. Item. Two consider approval of a special event permit for ST Joseph’s 1/100 anniversary Item. Three consider approval of a special event permit for the lion’s Heart Grapple Classic. Item. 00:12:42,770 Four consider approval of a raffle permit for the Mandan rodeo days. Item. Five consider approval of a gaming site Authorization for the Mandan FPs Pitch Association at 501 powerhouse Bar and Grill from July 1st 2024 to June 30th 2025 Item. 00:13:07,870 Six Consider the issuance of a new class a liquor license to Big stick Cigar Lounge BS C LLC at 104 2nd Avenue northwest in Mandan. Item seven. Consider approval of the Class a BBWO CD D one EFH, a special B and a WB liquor license renewals Effective July 1st 2024 Item eight. 00:13:38,230 Consider authorization of loan applications for the Collins reservoir and water treatment plant projects and Item nine consider approval of a special event permit for the festive Fridays. Are there any items that any Comm. would like to remove for discussion. Very commissioners. I’d like to take out one. Kick off one OK, any others? Then. We’ll deal with consent Agenda items one through nine I move to approve consent Agenda two through nine. Second A motion by Comm. 00:14:04,030 Braun seconded by Comm. ka questions or comments Roll call vote, Please Commission roh! Yes Yes Camisa. Yes Mayor Helbling. Yes that motion passes question for the attorney. I just I number seven. I know I didn’t pull this. Yes. I’m just signing all the liquor licenses for Here and the new mayor will take over July 1st. I. 00:14:30,170 Just wanna make sure that we’re doing I Think Mayor Herling because the licenses were approved. Now effective for July 1. I think you’re fine in signing them? Just just so we’re We’re good on that. Sorry, OK. We’ll jump back to number one. 00:14:49,700 Consider an amendment to the lease agreement with Marriott Marathon Petroleum Company and the city of Mandan related to property, which houses the raw water intake. Comm. Brown. I’m I’m just looking for a little background on that. Mayor he and Comm. Brown, Um When. We first leased property from marathon There were two separate lots down in that area where we constructed the raw water intake. 00:15:10,730 The raw water intake is constructed. Um, kind of half on one of the lots on half on the other adjoining lot, and therefore, um, we are joining those two lots that marathon owns and because the building needs to be addressed separately for emergency purposes, so The south. 00:15:35,170 Half of that building is contains marathons, pumps and everything else. The north half contains the city of Mandan S equipment. Um, so this amendment to the lease just puts Those two lots together. So that we have one lot. Um, nothing. None of the terms of those of that lease change. 00:15:59,630 At all other than now, we have one lot instead of two lots and one the building that has two separate addresses. Very good. Thank you. Any further questions. Your wishes. Uh, I moved to approve consent Agenda Item one. Second Motion by Comm. Brown Seconded by Comm. Rohr questions or comments Roll call Vote, please. Commissioners Braun Camisa. Yes Roar mayor Heling. 00:16:27,230 Yes that motion passes, we’ll move on to new business Item, number one consider approval of a request for qualifications for building inspections. Good evening. Good evening, Mayor Helling commissioners on here. On behalf of the building inspections, obviously, and, uh, our request in front of you for qualifications for, um, help on the plan review side of the Women’s correctional facility that’s coming to man and I know, um, next month, they’re 00:16:52,800 starting the process of annexation and different things with planning and zoning and getting getting things rolling. But. Uh, we’re getting this to you now, Um, We’re just looking for assistance for the plan Review and, um Project is going to take several hours and possibly days of time. 00:17:14,430 So, uh, any help we can get on this would be Would be would be very helpful. Uh, I know the school plan has about 650 pages that we looked at. And. I anticipate this being much higher, so Um, quite a bit of work involved with it. 00:17:34,770 And if we can get some assistance and and look for qualified people to help us out, Um we’re going to throw that out there and seek qualifications for this project until July 22nd. And. Then. After that, um, final approval will be brought back to the commission for, um Consideration at the August 6th meeting. 00:17:57,170 Um, the fiscal side of this is we are building permit that will get pulled for this project. We’ll take care of the costs associated with, um whatever bids and things that we, um That come with this project. So, um Shouldn’t be any fiscal impact as far as the city is concerned, will take care of that in the building permit and I’ll. 00:18:17,230 Ask if you guys have any other questions for me. Or just a couple of questions. It’s What, a $70 million project 160. I believe 60, OK? Yeah and one of the reasons you’re asking for this is because The structure. The JL is kind of out outside of the wheelhouse of what your department is working with every day. Yeah. 00:18:37,830 It takes some expertise in that area that we probably don’t have in house. Yeah, I. You know the the I You. Your condition eye is what is what we’re looking at. And Yeah. There’s a lot of things when it comes to building egress and just exiting in point out point. They have very special specialized things that they do. 00:18:58,070 And. Um yeah, I. I would love some help. On it. Um And Yeah I, I would say I I’m qualified, but at the same time, uh, some help would definitely be, um Great with this project, and it’s It’s also not just one building with this project. There’s several buildings, Uh some of them are tied together. 00:19:20,470 There’s apartments, there’s there’s other things in there. There’s a lot with this site, so, yeah, very big project and, uh, we’re definitely excited for it to come as well. So And he Other questions for Jordan Mayor Jordan. Just. 00:19:40,170 One Quick Question the selection Committee for once the request for qualifications come in, who is on that committee or is that to be determined? Mayor Heland Comm. Kis said that would be To be determined. Would you? Are. You volunteering your services. You can call me if you need Anything else? OK, your wishes. A move to approve the RQ 4 billion inspections related to the plan review. 00:20:07,970 Second Motion by Comm. Rohr seconded by Comm. Kisa questions or comments CNN Harry Nunn a roll call vote, please. Monsieur Camisa? Yes Roar. Mayor heling. Yes that motion passes item number two Under new business Consider approval of the Eighth Avenue Northwest Project Change Order number two. Good Evening mayor Commissioners. 00:20:33,600 This change orders related to the, uh, reconstruction project just happening just west of the new high school site. Um, And. This Change order is related to a school district. Um, request. Uh, the current shared use path in between Eighth Avenue Northwest and the new high school site, um, is slated to be constructed as an asphalt trail. And. 00:20:54,530 The School has requested us to, um, change that to a concrete trail. Um, this would be for, um, maintenance purposes and for easier tie ins with their proposed driveways. Um, there’s there’s a few other, um, items related to co ordination within this change order, But, um The school requested this. 00:21:19,500 Our consultant engineer put together an estimate and the the school acknowledged this and accepted the, uh additional costs as uh, To be special assessed against their property, and, um, we’re recommending approval as presented. Questions a juror Your wishes. Move to approve Change Order Number two for the Eighth Avenue Northwest reconstruction Project as presented second Motion by Comm. Braun seconded by Comm. 00:21:42,770 Kisa questions or comments Seen in here and no a roll call. Vote plays commissioners Camisa Roar Braun Mayor Helbling. Yes that motion passes new Business number three. Consider, a Highway six Trail Project Construction Engineering task order. American commissioners. 00:22:09,170 Um, this would be for the um construction, engineering and oversight for the highway six trail, This Trail will be constructed on the east side of Highway six between 19th Street and the bridge just south of the golf course I think it terminates terminates somewhere right here where it picks up again on an already constructed trail. 00:22:32,400 Um More engineering, uh, put together a proposal that would include, uh, the construction oversight required by the North Dakota Department of transportation and meets all federal requirements. Um, I spoke with the, uh, Parks district about the engineering service agreement and at I just spoke with Cole as recently as for, uh, as four o’clock today, and they are on board. Um, with this, uh, agreement and they would be 100% assessed the costs of this agreement. 00:22:53,930 And, uh, we’re recommending approval of this as well. So. They are the ones that requested this agreement come forward, or they, um Perhaps perhaps this is Has been done differently than how it’s been done in the past. 00:23:14,230 I think in the past, they had direct directly hired engineers, but for some reason or another, these last two trail projects were the The construction Oversight was separated out. Um so it kind of falls on our shoulders to either perform the construction, oversight ourselves or get a consultant on board to help us with it. And, um, just the federal requirements. And. 00:23:32,500 The documentation and reporting requirements on these federally funded projects is a little bit beyond the capabilities of our department may not capabilities. But the the time that our department has to dedicate to a project like this, so we would we would be hiring hiring this out, Uh, instead of self performing this Is a concern that I have is. 00:23:50,730 I thought we were out of the trail business after the fiasco on 19th Street, and I thought the park district was going to drive everything from here on out, and that’s why I asked Who’s I I spoke to I spoke. I spoke to cola at 4 P.m.. And. That was that was one of the topics that we had. I. Think going. 00:24:05,730 I think there was. These last two projects have been kind of, um Had went went astray from what had been done in the past. And. I think after this Um this trail they were the ball would be back in the parks Court as far as administering the, uh, engineering service agreements, But. 00:24:28,500 My understanding was that this was something that was separated out specifically for these last two projects for one reason or another. After we’re done with this one. Can, you give us an update on the other trail project, but, um, absolutely. Measures any questions? Mayor Derek Just. One question. 00:24:51,430 So if we’re involved with the bidding process and and bringing them on Are we then gonna be the ones responsible for quality control. You know, for instance, uh, referring to making sure the all of the files the design files are sent over to prevent issues from phase one. Is that gonna be an our wheelhouse that we should probably make sure we minimize any issues that we had in phase one with Phase two. 00:25:12,230 Uh, Mayor Comm. that would be greatly The chances for something like that, to occur would be greatly minimized. Um, by having a full time consultant on On reserve or on retainer or on on the project. 00:25:34,570 Um, this this the way that this ES a would be structured, there’d be Very very, very small chances of something like that is that what more would be doing that they’re going to be the ones responsible to make? Sure for instance, all of the design files make it to the builder. Correct they would be, they would be a lot they would have the time to dedicate a lot more time to the quality control side of things. 00:25:52,070 Yeah, thank you. Anything else for J. Your wishes. I move to approve Task Order six is presented. So I can Motion by Comm. Kisa seconded by Comm. Rohr questions or comments Seen in here, and none are roll Call vote plays Comm. roh! Yes, Yes Camisa. Yes Mayor Helbling? Yes, that motion passes If. 00:26:21,630 You could give us an update on the 19th Street Trail project and if the engineering firm was paid, and if that whole project is up to staff now and Uh, Mayor. Yes. Absolutely so that that has not been closed out. And, um The engineer has not been paid in full up to this point. 00:26:43,200 I believe, um, the contractor That was that was awarded the bid for the Highway six Trail is the same contractor that had been awarded for the 19th Street Trail Phase two project. 00:27:06,570 So in the interest of, UM Reducing mobilization costs and and such we would be planning on addressing Um, the fix on 19th Street trail at the same time as paving operations are occurring on the highway six trail project. So, Um, we we would be coordinating with the contractor to make that work done be done as efficiently as possible. 00:27:25,770 Why would we care about mobilization costs when it should be on the engineering firm and the contractor that Did the work originally and didn’t do it correctly. Um, I still think we would still need In the interest of going through the federally approved change order process we would still want to have, um, justification laid out and I think that’s the the the less that we Um The less that the change order will be amount the 00:27:48,900 amount of the change order will be the less scrutiny that it would be under. I think it’s in everybody’s best interest to save money, even if it’s just for Um, easing the federal Uh, change order process. OK, that it kind of explains that part of the trail. 00:28:08,530 How about the project before that, that still wasn’t done correctly. Um, in talks with the parks, district and public Works and Engineering Department and and several others. I think that there’s um There’s a fix that we think will work, though it um when we tried to procure quotes from that last year, it came in, um, significantly higher than what? Uh, at least 00:28:34,030 the previous staff was comfortable moving forward with, um With, uh With more staff in the engineering department. I think we could Try and approach that situation again and try and get everybody on the same page. 00:28:53,770 Where, um Maybe the financial impact isn’t as large if everybody contributes a little bit, um, where they can they again. The City hired a contractor and an engineering firm to design it to oversee it. I’m not blaming the city engineering department at all, because you shouldn’t even be part of it because it was all hired out again. We shouldn’t be concerned about costs. 00:29:11,800 This is going on what five years now? For that first section was not done properly. And I want to know when the engineering firms are going to be held responsible? Because they were hired to oversee it, and they get paid. They get awarded new contracts constantly. It’s not right this whole If. 00:29:33,300 We’re going to hire these people and do hire them from outside, they need to be held responsible for the taxpayers’ dollars. Absolutely No. I. Appreciate that. And, um I. Guess as far as Projects that are finalized. Closed out. Potentially. Um, I guess I don’t know what the exact status of that phase one piece of the project. 00:29:56,700 I don’t know if there’s much we can do retroactively, but, um, absolutely can take that in consideration moving forward with similar projects I would suggest, and I won’t be here that the city Files lawsuit against that. Firm. To recoup the money. 00:30:18,100 I think the city commission should look really closely into that because there’s no way the citizens of Mandan should be paying to redo that new section of trail that was never completed correctly. And. I understand you came into this well afterwards, so I’m, You know, I. Wanna make sure the public knows We’re not blaming the city Engineering department we hired outside consultants and they need to be held accountable. I agree. 00:30:35,830 I think what we need to find out what our legal access would be for that. And all the legal processes involved for that. Also your mayor, Jared Sell in park or Still. There’s responsibility. They’re 100% for maintaining these things right along 19th. The. New one going in they they still have to do the maintaining and not the city. 00:30:59,770 Correct, um, mayor Comm.. I believe that is the case. I know that we are our grounds maintenance team along with the park boards maintenance team, or we’re we’re kind of working working through. 00:31:18,000 Um what makes the most sense? Between the two entities maintenance respon so that we’re not, um, both mobilizing out to the same area so that might shift around But at this time? Yes. I believe cardboard is maintaining that these boards I just sometimes feel a sig is pulled into these things a little more in depth than we wanna be. Absolutely II. I think, I. I agree with you there. 00:31:37,770 Um, if if if if I could have as Minimal exposure to what is essentially a park board project. I’d I’d I’d like that, too. Yeah. And. We just have to be cautious and And. I. Consider all the, uh, aspects of that to make sure we’re not Going beyond what we should be going to Absolutely appreciate that. Yeah appreciate your help there. Thank you. Chair. Uh, well resolutions and ordinances. 00:32:00,930 We’ve been asked to pull Item two correct. That’s the only the one I have, anyway. Is there any other business to come before the board tonight? And of our agenda. I’d just like to Encourage everybody. We have an election coming up. Uh, Tuesday, June 11th the get out there and vote. 00:32:21,630 I’d like to thank the commissioners that are running the current commissioners that are running for your service and everything you’ve done. I’d also like to thank anybody. That’s out there that is running looking for a position. We’re very fortunate that we do have what Five people run in for two positions on the commission. We’re fortunate. 00:32:37,230 We have somebody who stepped up for Mayor so Thank you everybody that did that. Please get out and vote. Um, I’d also like to throw a thank you to todd Porter for all that he’s done for the city of Mandan, Uh, because I won’t be around and I really appreciate that. 00:32:56,100 Um Get out there and enjoy buggies and blues this weekend. Uh, support your community like you always do. Future meeting dates of the board of City Commissioners, Uh, June 18th, July, 2nd and July 16th all at 5:30 p.m. with that I’d entertain a motion to adjourn. Some moved all in favor. I opposed Thank you Everyone have a good evening
