To the right. Is One nation. Divisible. With Before. We get into the printed agenda tonight. I’ve got a couple of things I thought things should be brought up tonight. The. 00:01:12,600 First one is we had a couple of In the community today that a couple of people that were important to the city of Manda and have given service back to the citizens of Manda in the first one is Jerry Senko. He was a city Comm. for two years. I believe from 2008 to 2010. So. 00:01:31,800 Jerry passed on hearts and prayers go out to us, his family and friends and also our long time, Uh Sheriff Leo Schneider passed away this week also so our heartfelt prayers and Uh, thoughts are going out to his family. So a couple of really good people that did a lot for the community. So. Uh, this community won’t be the same without them. 00:01:50,670 And then on something really positive, you know, sitting up here. A lot of times we think of a lot of the negative things that happen and we always you know, people complain. I look back on buggies and blues weekend and not just buggies and blues. If. You. Look at all that happened on that weekend. 00:02:07,170 I doubt there’s another community in the United states that rivaled as much that happened here as what we had here over that weekend. We had music in the park. Uh, a charity car run, uh, stock car races Halloween in June at Fort Lincoln State Park. We had a rodeo. 00:02:28,400 We had Dakota Alliance Kite fly truck and tractor pull classic car parade planes and pancakes and buggies and blues. The concert, the car show. There’s things at the library that E everywhere you looked around the community. 00:02:47,270 There was things happening, and most of it was done with volunteers, and it’s unbelievable the support that this community gets from not only man, Dan but Bismarck Lincoln and all the small towns around us not only with volunteers but the way they sponsor every event. Like I say, we Very fortunate here to have something like that happen because it doesn’t happen. Um, essentially refused to take our money for it, so it was really kind of of the dykes shorn to to contribute their beautiful, um, beautiful petunias and other other plants for the city project, So. 00:12:04,400 We have a picture of those that were given to City Hall and the planters that are along main Street as well. The Dykes Shors have always been really supportive of the city, and it was really kind of them to make this donation, so we just wanted to publicly thank them for that, and that’s all I have. Question or comments. Roll call vote, please Comm. 00:16:58,600 Kisa. Yes, Yes, Olson. Yes bra mayor Heling. Yes, that motion passes. We move on to new business item number one consider changes to the parking violation fines Chief. Good Evening, Mr Mayor and Comm., Uh Rene merch is here from the parking authority to address the changing of some fines. 00:17:24,230 Uh, this will come actually in, Uh, tonight. If approved. There’ll be another one coming and the next commission meeting to approve the change in the ordinance. A more turnover to Renee. Good Evening mayor and commissioners. 00:17:45,070 Uh, when we met in April, uh, we just kind of went through the whole parking, uh, authority kind of where we can make some changes to improve our downtown corridor and got some, um Feedback from the community, and another one was, uh Being able to make a better turnaround of people parking on Main Street in the in the timed area, and so we thought of we looked at kind of the ticketing violation on that. 00:18:10,300 And when the last time that was addressed, and that was never, uh so we are addressing that so are we proposed to move a ticketing violation from $10 to $15. And then also a big, uh, area where is really congested and people aren’t really, um, adhering to is in the parking and the loading, um The loading zones and that has really, uh, 00:18:38,000 hindered first responders, especially to get in on the Lewis and Clark building there. So. We, Uh, propose that we, uh, raise that from $10 raise it to $50 for those, um, important parking spots as well. OK commissioners. Any questions for an A or thoughts, MEREDITH. Uh one question. Do. 00:19:02,570 We have any specific fines for parking in front of fire hydrants? Uh, mayor Comm.. I believe we do. Yeah. Um Mr mayor and Comm. Kise. Yes, there is fines for parking and fire zones and in front of, uh, any type of, uh, Public safety service. Do. We know how much those are Is that set by century code. It. 00:19:26,630 I believe it’s set by city ordinance. Um Yeah. I don’t I. Don’t think we write very many of them If I was gonna take a guess at it. It would be probably a $10 fine if it’s like some, like I know, handicap parking is $100 fine. I would recommend taking a look at that as well. 00:19:43,070 OK that if it is set by City ordinance mean if it’s $10 I, I can’t recall what it is off top of my head, um, that we should probably increase that as well. Absolutely. Your honor. Mister chief before if we’re going to increase that, uh, I want to know from the fire department. 00:20:00,870 Is there a problem regarding fire hydrants and parking. That, Mr Mayor and Comm.. Uh, Roher, Uh, I’m not aware of a Big issue with parking in front of fire hydrants. I know if there’s vehicles in front of fire hydrants, the Fire department will remove the vehicle. 00:20:20,930 Uh, pretty abruptly to get to the fire hydrant or, um, So I’m not aware of how many tickets we’ve been writing for fire hydrants. That’s not something that comes across my desk a lot, so I don’t think we do a lot of them. 00:20:32,770 I’m just crying and you know if there’s a need because of a problem and we’re in huge problems for that problem than I I know there is a problem. Yes, sir. But. We’ll look into it and I’ll I’ll get you get the commission An answer on that. Thank you. Anything else for the chief or Renee. OK? Anything else, Renee? Golden OK, your wishes. 00:20:58,970 I move to approve raising the current $10 parking fines of $15 per violation and increasing the loading zone violation from $10 to $50 effective January 1 2025 and for the city attorney to draft the necessary ordinance changes. Second Motion by Comm. Kisa Seconded by Comm. Rohr Further questions or comments. CNN, Harry? No a roll call vote plays, commissioners roar Olson Yes Brown Camisa Yes, mayor Heling. Yes, that motion passes. 00:21:26,970 Uh, item number two under new business. The presentation of the 2025 preliminary CENTCOM budget. Hi. Good evening. Good. Evening mayor commissioners, uh, for the record, Mike, Dan felser, Uh, Centcom director, um In your packet. You should have received our base budget expense work sheet. 00:21:55,270 Just wanted to stress that’s a base budget worksheet, not the proposed number that I gave to Mr Welch on the on the budget. First thing I want to do though, is try and confuse you all by going through the 91 tax and how it’s used. 00:22:14,130 Um there’s a lot of questions on The allocation, the 91 tax and how we use that, Uh so I wanted to just describe the difference between the burly, burly dollar collection in the in Morton County dollar collection or $2 collection. So in each county. The, Uh, Ian tax is $2 per device. Um, on the burly county side. 00:22:33,900 Uh, the first dollar 10 Cent 10 10% of the first dollar was to the Association of counties, and this applies also in Morton County, um and the Association of counties manages the state and Iowa network, which we all use. Um Of. The remaining dollar, uh, for the burly county dollars, Uh 15% could set aside for our enhancement account, which is our equipment reserve account and then 75% of the dollars go to offset our budget so and operating budget. 00:22:57,930 Um, on the Morton County side. Taking away. The 10 10% Association of counties retains, Uh, Morton County man and have a sharing agreement for the nine on revenue and of that revenue that’s manned in receives from Morton County that comes to burly county 85%. Of that offsets are annual operating budget. 00:23:16,670 And, then 15% is set aside in that same equipment reserve account for if we need to replace, uh, certain equipment. We don’t. Um, we don’t have to compete with other departments for general funds. We have dedicated 91 funding to replace that. Critical equipment, so Um as far as the the second, um, dollar that’s collected in burly county. 00:23:40,670 Um, both in Morton County and burly county 50. Cents of it goes to the state for the statewide radio network. And, then the the other 50 cents in burly county is used for the the building lease that we currently have at DC N. 00:23:56,130 So that’s how that kind of breaks down and I know it’s uh, kind of hard to Picture of the moving moving sense here and there, but, uh, it all makes sense when you deal with it every day. Um any questions on that at all? No. OK so on the expense worksheet. If. There are questions just interrupt me. 00:24:16,770 Um, A lot of it’s pretty straightforward our expenses from year to year have been pretty static. Other than, uh, increases in maintenance fees in certain areas. So our computer aided dispatch. Maintenance. Um Are nice and warm logging recorder. Uh, that records all of our telephone conversations. Radio conversations. 00:24:37,830 We’re CN 3 to 5% increases per year in maintenance agreements on those and we’ve made some changes in like our Tate system. Maintenance where we don’t we don’t pay as high a level in maintenance on that system to offset the cost of these other increases so so we can minimize the amount that we request in a given year for requesting anything so going into 2025 the 00:24:55,570 estimate. That I gave to Mr Welch on our budget was about a $21,000 increase over the projected dollars last year, and that’s entirely salary and benefits cost that we’re projecting for 2025 and again, That’s that won’t be determined until the city Bismarck goes through its budget process and sets salary policy. 00:25:16,400 So we always try and aim a little bit high to try and make sure that we’re not coming back and saying Well, we guess short, uh, when we come to burly county in Mandan, so burly and Mandan are kind of in the same boat in the budget process. Us. 00:25:28,930 We have to estimate a little bit higher than what we think it’s going to be, um so that we don’t have don’t have an issue with the preliminary versus the adopted budget. Um, for revenue. Um, just to give you an idea how much the 91 tax offsets the general operating budget we use about $1. 00:25:52,030 1 million to offset the general operating budget, so that’s a significant amount There’s about 830,000 from burly and about 202 180 for man then so, um It helps to offset our operating budget, so we don’t we don’t, uh, use as much in general funding but our our budget bottom line is about 4.7 million in total. 00:26:12,070 Um, that’s all salaries and benefits and, um Everyday day to day expenses. Um And if you have specific questions about those items, Uh, certainly. I would take those, but, uh, as far as increases and stuff the only thing that we’re looking at is the potential increase in salary benefits. Mayor Mike. Just. 00:26:40,370 One Quick question looking at the, uh, the cost differences between what you had last year. And this year I assume you had a number of, uh, hires no number of new employers or employees. Excuse me. Uh, Mayor Comm. Kise. Yes, we We have a turnover. We have a lot of turnover year to year. 00:27:00,800 Um, and recently like we have six vacancies today we budget 50,000 in overtime, but we spend about 100 and 230,000 in overtime to cover those back the back filling of the positions. So. Uh, you know, we’re in a struggle just like, uh, Some law enforcement agencies are today and dispatch across the country. I mean it’s it’s a difficult job and and something hard to do. 00:27:18,570 But as far as Some of the differences in like the actual amount versus the 2420. 2024 amended and then 2025 proposed There’s some coding differences in how fiscal puts it in the system. So where we might have something budgeted in, um in software maintenance. 00:27:42,530 They have it in a they put it in equipment maintenance, So it kind of throws the numbers back and forth. One I was and I figured maybe there there was some new FTES because looking at like worker worker compensation premium that was a pretty large jump unless there was some injuries or, you know, just Large differences between 2023 and 2024. So. 00:28:00,870 That’s I was just wondering if there was some new FTES or some new staff brought on our budgeting compensation. From 2024 this year is 798. Um, next year is proposed at 797. Yeah so as far as As far as the jumps go. If. You have any anyone specific? But there’s I mean the pension expense that increases based on increase in salary costs. 00:28:32,770 Um, you know be so when you look at the benefit items, there’s gonna be changes based on you know somebody’s earning more money. Their pension cost goes up Health care. I mean health care is All of our employees are City Bismarck employees for paying benefits purposes, so we take take advantage of their self funded health care plan. 00:28:51,270 So we see we see less. I think as far as increases in that plan. Then what you see from some normal plans out there. So. Basically. Most of those changes are going to be based on Bismarck’s, um, salary policy. Correct? Correct. Thank you That’s all I had. Anything else for Mike. Chief. 00:29:11,300 I was just gonna keep calling you, chief. But Mayor commission into the public, too. I know I serve as a board representative, you know, to send Com for the city and I’ve been there, You know a number of years now and you know the ever since we went with them, they’ve been very proficient supplier of working, 00:29:28,700 you know, public safety communication needs and when I’ve looked a number of times when I look at what it would cost if we had to maintain our own dispatch communications center with all the equipment and new software everything and trying to keep up the technology, it would be very difficult. 00:29:44,700 I don’t think We could do it for the For less. The pay right now to to certain income, I think, um, in terms of are we getting, you know our money’s worth? I would say definitely, And and and, uh, probably the best alternative. We have. And providing good public safety communication, which is vital. 00:30:05,170 For the police and fire and others to, uh have that response and and and keep up. Mike has difficult job turnover rate is hard and and just, I always ask him about how how things come along with new technology and things like that, and, uh and I read about once in a while and it’s it’s 00:30:22,070 It’s difficult for many to keep our new technology, but it’s It’s a premium thing to do. In your line of work, So we appreciate that. Thank you, Mike just for the public. Why don’t you let everybody know what different agencies you you represent. OK. 00:30:42,400 So, our Our funders, of course, are the city of MI City, Bismarck city of Mandan and burly county. Um, but we dispatch for manned NPD, Man and fire. We work with men in public works, Um Bismarck, PD, Bismarck Fire Bismarck Public works burly County Highway department. 00:31:03,270 Um, all the rural fire agencies in burly county, uh, Metro area ambulance and the rural agencies and in burly county so we we’re dispatching, you know a pretty good number of agencies and communicating with them on a daily basis. And when we go back to talking about the cost of this I mean, there’s When. 00:31:21,370 Mandan joined Weimin, Probably six or 7000 transfers of 91 calls per year, Uh, between Bismarck and Mandan of of somebody calling in man, and it comes across to Britain Bismarck and has to get transferred back Now. The call is handled in. It’s dispatched and just the efficiency of, um, law enforcement, knowing what’s going on in the adjacent city any given time we have dispatchers working side by side able to share information like that, So. It’s a. It’s A. 00:31:39,630 Pretty. Good, Pretty good deal. Um, it’s Cheap. By no means Is it cheap. Um the technology is gonna be driving further and further consolidation across the country, whether we like it or not. 00:31:56,070 Um, but areas like this where you’re more populous and makes a lot of sense to work together on, especially in areas like this. So. Um but yeah, as as Comm. Rohr mentioned he’s on the board with, uh Comm. from burly County Comm. from city man and, um, and ultimately they they approve what we’re gonna propose for a budget. So. It goes through the the Chiefs and the sheriffs. Initially. 00:32:14,800 They get their first stab at what they want to see and spend money on And. Then the board gets their say so That’s what gets presented. Teacher of the Each of the entities. I. Just think it’s important for the public to know that it’s more than this 911. It’s. 00:32:31,730 There’s a lot of things going on, and hopefully someday we can get Morton County on board. The To join on board with us so we can all be together and on the same system and and using the same procedures and protocols so For the most part If, You’re calling for a stolen bike. You’re talking to our people. 00:32:49,470 Not talking to law enforcement agency directly anymore, so OK any other questions for Mike or comments, Mayor Mike, I’ll Just just say I’ve I’ve personally I had to call into your your guys’ call center and you guys do a great job, So, I. I’ve never had anybody give me any negative comments in my personal time. 00:33:08,730 I’ve used it it Everybody’s been professional and, um, have serving the public Well, So. Keep it up and thank you. And. I’d just like to echo the same thing and I was really reluctant at first and kind of fought it a little bit at first, and but it’s turned out to be a really good System. Everything is everybody is represented very well. 00:33:24,130 And like you said it costs a ton of money And but To. Try to get perfection. It Things cost a lot And when you call 911, you want the the proper answer. On the other end of the phone, So. Thank, you and all your staff for all you do. Thank you. Yeah. 00:33:42,430 I don’t think we need a voter or anything on that. Those informational only, uh, item number three. Under new business. Consider a request from TRX developers to use city right away for shores of Lakewood sprinklers, andrew. He Comm. is all do a brief introduction on this and then turn it over to some others. 00:34:01,130 Uh, prior to that, I, I did receive some information prior to the meeting. So approach and hand out just some packets that were provided by the, um By the developer. Um, For starters, I. I’ve had a limited amount of time to look at that, so I’m. I’m not able to really speak. 00:34:33,700 To on the contents of um that information, however, the topic it And um and Southeast man and the development shores that Lakewood is underway. The city’s been asked for permission to utilize the city’s right of way. And if you deliberate locations for planned irrigation crossings, sort of a, um, innovative approach to irrigating the the Master plan development. 00:35:01,330 Um, on the screen is a layout of the master plan development and the proposal would be to use the system of private irrigation lines and pumps to take water from the storm, water and amenity pond within the development and pump it into a network of irrigation mines throughout the subdivision in your packet, this exhibit is included. 00:35:25,400 I know that for sure, and detailed and read are proposed crossings of the city. Right of way. This is coming to you as an appeal because using the right of way for private purposes is not allowed. And. There are a couple sections of the code of ordinances that specifically speak to this. 00:35:46,730 Um Section 115 article one broadly details Franchise rights for major corporations, major utility providers that provide a a network of community benefit to be able to use the right of way upon fee. Um, that would be Midco, for example, or Montana Dakota utilities, for example. Section 115 38 details that the use of streets, alleys and public way public rights of way. It is not for private use. 00:36:09,670 No person shall place any object in the street a public right away or public easement that restricts the public’s use of the street alley or public right of way or easement. 00:36:30,470 We as staff are Concerned that permitting this encroachment to, um To the right of way might lead to the potential disruption of the right of way due to concerns regarding maintenance and and conflicts with things within the right of way, of course, and then section 1 15 63, although particularly specific to sidewalks, sidewalks are of course within the right of way and, and this speaks sort of to the general intent of Um it being unlawful for a person to 00:36:48,100 put across an boulevard or sidewalk within the city. Any private crossing for any purpose whatsoever. Um, What’s the Agenda document, the concerns that I have been asked to forward to the board include Um It’s sort of being introduced to us relatively late into the project. 00:37:08,930 The first that I remember hearing of the irrigation lines was in November of 2023. Um, it’s I know it’s noted in here that it was something that was introduced a little bit earlier, it might have been contemplated, although not expressly implied that the H a and the master, um Maintenance that residents of the who will receive included this component, um, did not seem to be something that was 00:37:28,870 made explicitly clear to city staff. I don’t know if anyone at City Hall or within the Development Review team here at the city was expressly. Um, asked if the city’s right of way could be used for private irrigation. Were well aware of Master snow removal, Master lawn care and things like that. 00:37:48,600 However, this part Um, didn’t quite seem to have as much emphasis. It was not brought up as an item that was discussed with Phase one or phase one is Actively under construction, and I can assure the board that if someone were considering using the city’s public right of way for private purposes, that would have been a topic of 00:38:04,100 discussion it would have been in development agreements, etcetera. So, um As. We sort of generally dispute it being part of the project the whole entire time. Um and all of the kind all of the developers sort of ex express How, Um, how they feel that it was documented throughout the project. 00:38:29,000 The other comments include This being maintained by an HOA seems Pretty different than the the franchises that are allowed in the right of way are major corporations that have, um, kind of a requirement to provide gas and telecommunications and electricity to homes. 00:38:51,870 Um, and have The staff and the network to to kind of coordinate, Um, correcting any issues that come up, should they come up? So it being maintained by nature ways. It’s something that’s fairly concerning to the city. Um There’s a A thought that allowing the infrastructure would increase the city’s liability and responsibility for maintenance. Should that H a be unable to perform the maintenance that is required. And, um And. Lastly. 00:39:17,000 Really the concern being that permitting the use of the right of way for private owners might be, uh, a can that we’re really not looking to open here at at City Hall. It’s noted in here that the city lacks ordinances, um to lean on for approving this And. 00:39:33,530 That’s true because the the general intent of the right of way is for us to not really permit private, Um infrastructure within it. So I. I would I would stand up here. Um and basically state that that it’s probably OK that we don’t have ordinances that That enable the approval of private infrastructure within the right of way. So. 00:39:52,470 Those are the points that I have been asked to forward to the board. Um I would recommend that You review the packet. The statement of appeal. Feedback from other city staff. Should you desire that? And ultimately, staff’s recommendation is to deny the request. On that last one by me again, Andrew. 00:40:14,070 What did you say? Yes so I would recommend that you consider, uh, the information in the packet. Consider the information that’s provided to you by me and from other city staff, Also considering the statement of appeal by the developer and staffs ultimate recommendation is to deny the request. I. Gotta have a question for you. How would, uh, granted, this is probably only a couple of crossings. But. 00:40:31,270 How would this different than Any homeowner in town, using the boulevard or public right away to run their sprinkler lines. Granted, this is servicing a bunch of em. I could see where we could really be. In some hot water here and were you have a real big conflict of what’s going on? Uh, mayor Hal Blin Comm. 00:40:52,070 , I could defer to public works director and engineering director. Um should they want to provide feedback? I think the scale the aspect where these are transmission lines as opposed to private service lines or things that, um, that introduce some concern, Um We Frankly, did not look for a lot of examples of how this is working 00:41:11,800 because of our concerns around, um Any private infrastructure being in the right of way at this scale. I don’t believe that we’re motivated to come after Boulevard irrigation systems, and the concern is That the streets, um, could be compromised by closures that might need to occur for maintenance, et cetera, so it’s a little bit more intense. 00:41:36,330 It’s a little bit more, um, tailored to areas where we have other utilities and other infrastructure needs. Any questions for Andrew? Mayor Andrew. So when it comes to our franchise, um, agreements or the permits that we can give to whether it’s MD U or, um, one of the other utility providers. 00:42:03,630 Do we have some form of agreement in place. What do we use to regulate what they’re allowed to do within the right of way when we do issue those franchise permits? Mayor Hal Blin Comm. 00:42:21,800 is although I’m not an expert on the topic, I do know that we do have agreements with major utility providers such as MD and and the telecommunications within our right of way. What those stipulated I wouldn’t be the best person to answer but there is a formal agreement. That. Those franchisees are are they that they’re signing off on and agreeing to Correct Comm. Kise, And. 00:42:42,870 I believe that those agreements are Um historically and strictly reserved for those major utility companies, et cetera, and and not likely something that we would enter into with an H, a But, I. Guess. My my concern would be Is that I I if we were to move forward with this, we would need to have some kind of definitive agreement in place because there there is a lot of questions that come up. 00:42:58,070 Um, I know when we had our our meeting together, you know, we we had a list of questions that we were trying to figure out if if XYZ were to happen, who covers that cost, and, um, I think there’s a lot of questions that this will open up and I think we’re gonna need 00:43:14,700 to I if we wanna move forward with this as a We’re gonna have to have some kind of agreement in place because I think it’s gonna open a can of worms. If. We don’t know who’s covering what expense when certain things happen. Yes. That’s That’s correct Comm. Kita. 00:43:28,930 I would emphasize the number of crossings that are proposed is eight of the city’s public right of way as I can see here, there I did my math, right? It or possibly not trying to count on the flight. Um And. We. We would agree that something relatively ironclad would be necessary. 00:43:47,970 And, um It might not be very easy to sort of anticipate. Every scenario that would come up. Do. We have the ability to put something in place before they need to get this project done in the ground. In those crossings made Um, mayor Hub Comm. Ka. I think we would have to, We would have to to make time available to do that. 00:44:09,770 I’m, You know, I’m referring to that there would be a delay in moving forward with their project in order to accommodate us to be able to have an agreement put it drafted, reviewed, agreed upon and signed that that would cause probably a substantial delay in their project if they wanted to go this route versus finding an alternative route 00:44:27,330 that doesn’t require crossings through the right of way. Yeah, I guess that That would be my suggestion. If we’re gonna go that route. We. Gotta have this in place before they can even attempt to do this project and and make those crossings. I, too. Think. 00:44:47,170 Something needs to be You know in writing, maybe limit the number of crossings and don’t let it be. Wide open. I think we have the park board there? Proposing. Pipeline for the golf course and the softball fields or they were at one time you know it’s cross in public right ways. 00:45:04,670 It’s doing a lot of things, but this is kind of a unique thing that Nobody’s ever really done around here before, and I think we need to work to try to accommodate it to some extent, because they’re using it for W wa lawn watering. 00:45:24,870 It’s not in my opinion any different than Some commercial building or landowner in the in town that has a 60 P SI water line running through their property to feed their sprinkler system. And. I know there’s some pretty good sized ones out there. So. I think we gotta be careful, so we don’t You know. Pull out one group and treat them differently than the others. But. I. Think it. 00:45:40,000 I drove down there again this morning early and and looked it over and I think it’s It’s pretty unique and I think we should do what we can to try to work through it. And. If. This Commission wants to move forward with allowing it. 00:45:57,470 I think there needs to be some kind of bonding done to ensure that the HO a, which is not going to have the financial means that a franchisee or utility company is going to have to ensure that if there are any water line breaks any damage that they are able to pay for the cost of redoing a whole road, and that’s not a cheap process. I. 00:46:15,070 I, don’t I don’t know where you’re gonna have the guarantees at an HO a can afford to repay and rebuild an entire road. So, I think if if the commission wants to go forward with that, I think there’s got to be some some kind of surety bond of of some sort put in place that there is the ability to pay for it. 00:46:29,470 I think if you had a whole road blow out, you have the ability to special assess I. I would be more worried about the day to day stuff where you have a single line break and who is responsible? Who’s gonna fix it and No, But I think if you have a big one. 00:46:43,100 I mean you’re not talking high pressure 12 months out of the area. You’re just talking over the summer months, and that’s not gonna be a You know a lot of pressure behind it, so it could be shut down quickly and So But. I think we should do all we can to try to work through it. Kay. I would recommend that you, um I. Guess. 00:46:59,530 Welcome, Mr Gold, and we’re up here And then if you have any questions for city’s engineering and public works staff, um you can ask them as well. Thank you. Thank you. Want to come forward more than welcome. 00:47:22,800 Good evening mayor Commissioners Arthur Gold Demmer TRX developers I Appreciate you hearing me? I won’t read verbatim the information I’ve got in front of you point out some some some facts and then also some of our solutions for, uh, some of the various staff concerns that We agree our concerns need to be addressed as well. We’re not here to fight any of that. We. 00:47:41,600 Just wanna do what’s environmentally responsible and, uh, do our part as stewards in nature to protect our water resources and to help the residents you know, with their watering needs as well as take the burden off of the city plant, uh, which would also allow more capacity for future projects without upsizing. This was in the original covenants that we filed with the city. 00:48:02,400 Um In. A few different sections and that was in 2021. I. Believe, uh, it’s been When we started out this there was a different city planner and a different city engineer. And. 00:48:18,930 Uh, some of you were on the commission back then and can remember it was, you know about four years ago when we started this We kept it off of the Public type of approvals as it was a private matter, just like any other sprinkler system that along the Missouri River or Bgee Bay or Marina Bay Lakewood harbor that pull from the water. Um You know, just handled it as a private ho a matter Um again. 00:48:39,770 We do have some some various Solutions and answers for all the concerns brought forth by the city, um, again are very valid. Challenges that could arise if there wasn’t a solution, put in place with a agreement. Behind it? I again fully agree with those suggestions whatsoever? Um, pipe breakage under the street. 00:49:03,430 We’re hoping as you said, This is gonna be a little pressure line, Um, on only in operation for a Three months, four months out of the year, so it uh the chances of it freezing and bursting at 2 a.m. and causing massive flooding is pretty pretty slim. Um The system. 00:49:22,670 Will be winner as each year, meaning, taking all the lines out of it. So there wouldn’t be any risk of breakage. Um you know there could be some natural disaster that could cause a break like an earthquake or something. But, you know that’s highly unlikely as well. You know how do we fix it? Um, you know, in your packet, you’ll see the demarcation. 00:49:40,030 Lines on both sides of the street, so it’s clearly located tracer line in the entire length of the wire. Um As well as having it located on the on the plat, located by a engineer survey team, So. It’s a very specific where it’s at, um, who fixes it, you know again, the H a would be responsible for the system. 00:49:57,830 Ultimately, however, it be a developer installed. Item, um, we reviewing this just like any of the other private utilities. Um We’re not a Huge corporation, But. Um, we do We do have a rather sizable for our location. 00:50:18,130 Excavation underground utility company side as well as land development home building and as many of you know, we’ve been around for about 25 years not planning on going anywhere. Uh, we’re currently doing quite a bit of work for the city of Mandan for emergency services and other miscellaneous utility work. So chances of us getting the call would be Pretty high at this moment in time. Uh, As, a backup. 00:50:39,270 There’s many local excavators in town that would have the expertise and ability by excavating Schlosser excavating and many others outside of site works excavation. HO a ability to remain organized. We’ve We put together close to 20 HAS now in our career, and we’ve we’ve learned some things and we’ve improved over the years. 00:51:03,870 Um Things like Mr Camisa when you mentioned, you know, how do you pay for it? Um, we started doing this in Wells Fargo. And. Now. We’ve done this in four or five HOAS here in Bismarck Mandan. We Start, a Capital improvement fund. 00:51:21,470 It’s similar to a special assessment district in reverse where the initial transfer of the the lot or home to a third party gets a $500 deposit into a separate account owned by the A and then every subsequent transfer following that, meaning homeowner a sells the homeowner B there. Half a percent transfer fee as well that goes to that capital improvement fund. Specifically for future infrastructure type repairs. Uh, we did have a water main break. 17 ft Down in West Fargo. 00:51:44,470 The age. We had funds to fix It, uh, wasn’t a big deal. Um Work. Really? Well. Uh, that type of fund could be Somehow co owned with the with the city somehow, so if there was ever a a defunct of the Each way the city would have have a pot of money sitting there to do what 00:52:02,170 they wish with it make prepares, Tell the residents that they’re on their own. So on and so forth. Um There is as well There is a private irrigation line down burly avenue. Um, we do, have we we we have done Three communities. Developments in Mandan by our development company. 00:52:28,970 HO, a manager and 10 total separate communities between Bismarck Lincoln, Wells, Fargo Fargo, Mapleton and Manion. We’ve got experience doing the community systems managing HOAS, and I think it’s extensive enough to At, least stand for that. We No kind of what we’re doing and have some good ideas. You know the rest of the right away. We simply just missed this on the plate. 00:52:50,300 You know we obviously as the developer came forth with the plat originally, uh, just didn’t have easements on it. So. Have we known this would be a challenge would have put easements on it and likely aired out this conversation three years ago. Um, but here here we are, So. 00:53:08,470 I again Appreciate the consideration these crossing lines are buried at approximately 2 ft. Below the surface. The storm sewer. Sanitary sewer water. You know those types of utilities are down quite a bit further than that, with the other private utilities typically located in the boulevard. Any irrigation crossing any MD midcontinent would be done with a you know, pothole type of, uh, excavation. 00:53:31,670 With, the fact trucks to make sure it’s sensitive infrastructure isn’t disturbed. And in the future, you know, likely, um, our affiliated entity site works will be doing a lot of the other infrastructure installation in the area, and, uh, All of our operators and are completely comfortable with this and you know, excited for it. 00:53:55,730 We do have in the covenants and bylaws that require a separate professional management company to run the HO, a We found that turning over H a to homeowners. Sometimes. It works well sometimes, OK, and sometimes it’s a struggle. Uh, so we have that requirement. So what the board does of owners after we sell. 00:54:15,670 The last lot is the board is responsible for maintaining the annual budget and hiring and paying the HO, a management company, which is a professional company. That manages H ways and Rental properties. In. Our covenants. We do have the right for the city to take over private facilities. Should the city choose. 00:54:37,500 Uh, the city is under no obligation whatsoever to do so at any time if there is a default again with the capital Improvement fund and regular monthly dues, we haven’t had any of our major ways Default. Some might remember Bridgeview Bay. We built a lot of homes there. I do want to stress we did not set up that H A. We did not write the covenants. 00:54:54,030 We just Most of it out. So. I sat on the review committee there, but, uh, didn’t uh, Not, a board of directors or responsible for the original development work covenants. Things of that nature. There’s a lot of what if questions out there and again, I agree. 00:55:19,070 That ultimately, the You know the burden has to be placed on developer that installs it. Irrigation contractor Who’s Brendel sprinkling in town they’ve been putting in sprinkler systems for many years. Bismarck Pan Dam, Uh, On the second generation Now. It’s they do a great job for us and many other owners. Again. 00:55:37,800 There’s a lot of professionals working here and not just a group of homeowners trying to put a irrigation system in I would also encourage that the developer agreement mirrors and reinforces the covenants to to really memorialize this and to put those levels of control in place that again, I agree are needed. Each lot just so you guys know how we’re designing this. 00:55:59,430 The main line is simply going to feed each lot just like it would if we put meter pits in and tapped in the city system. Or, just like individual would tap into their house and hook up the system, too. So While. It’s a community supply system. Each home is going to have its own unique by the yard. Irrigation system. 00:56:19,570 We’ve thought about a lot of different It falls that may arise and we we try to put listen to the city staff concerns and at least Provide Some options for solutions you know again with, uh The thought in mind of I’ve got a slide in here. It’s in your packets. This is from the EPA In 2023. 00:56:46,130 There’s only 17 states in this country that don’t have water reuse regulations or guidelines for landscaping. It’s coming one in three. People around the world on a clean water. Uh, I again didn’t think this would be a a thing, but I understand that there are some challenges that we we need to work through again. 00:57:04,870 We’re just trying to be a steward of the land and work with our water resources, which were very, very, very fortunate to enjoy in Mandan, North Dakota with the Missouri and heart rivers. Flowing through town. A. 00:57:21,270 Lot of people aren’t that fortunate, and I believe we should do our part to at least Do what we can to conserve what we can with that much water in our back yard. With that said I would ask for your your support and, uh, would field any questions? Mayor Art. Uh, I have one question. 00:57:44,870 So in regard to, um this capital fund that you would create with the HO A, Um, to my knowledge, the state of North Dakota has prohibited private transfer obligations since 2011 and that they don’t run beyond the first owner that would come in. So. If you have a subsequent set of owners that refuse to pay the transfer fee. You’re not gonna really have much of a legal obligation to take to court for it. 00:58:02,470 So how do you make that fund sustainable If you don’t Have a legal mechanism to acquire that half a percent transfer Comm. commissioners. I am not an attorney. I’m not going to try to be, um You know our law firm A BS T law has put those together for us. 00:58:21,670 Uh, there is a mechanism that Is tied to what I believe again. This is not a legal opinion by any means, Uh, but it’s tied to the Improving. A shared ownership of a property. Um, I will ask that question, though of our attorneys and I will get an answer back and maybe there’s another mechanism. 00:58:38,270 I’m not aware, I just my my knowledge is that you can’t have a private transfer fee. And, so maybe there’s another route that your attorneys are recommending. Absolutely will look into that for you. Thank you. Any other Comm. comments. 00:58:58,600 I would think this is gonna have to go back to Said he staff to work through some items here before we even vote on it. I would hate to deny it tonight. I think we Andrew, I don’t know what your thoughts are, but Thank you. Thank you. Mayor I I myself. Um, I. Don’t think I would vote on tonight because we got the sheet of paper. We need to look through this. And. 00:59:18,430 Look, I understand? I might wanna business with art, too. When we talk about he has now There are several alternatives How, we can get this particular project used whether it be by city water or his project that he’s mentioning now, But, I want to be able to understand how these, uh different alternatives impact How. 00:59:37,100 He can get things done and how that works, too. So I’m A. I’m. Not Sufficiently At least I don’t feel I am sufficiently aware of all the dynamics it’s gonna take to make a proper decision here. I feel the same way. 00:59:54,000 I think there’s there’s too many unanswered questions that need to be answered to move it forward. Yeah I. I, wouldn’t I agree? I wouldn’t be able to to vote to move it forward and if we have to vote, I would vote to deny tonight. I’ll just kick it back to staff and work on it, and you’ll have to bring it forward to another commission meeting. Do. 01:00:09,470 We have to move the table this or Yeah? Yeah, I would make a motion then to table this particular request until we can get more information and proceed. Second Motion by Comm. Rohr seconded by Comm. Braun any further questions or comments Roll call vote, please. Commissioners Braun Camisa roar. Yes, Olson Yes. And. 01:00:39,930 The Mayor Heling? Yes that motion passes, we’ll jump down to Item four. Under new business. Consider Amendment two for the water treatment Plant Phase three Optimization project. A Commissioners. Good evening. Um, we have been working with a E two S on the preliminary design phase of the water treatment Plant optimization Phase three project. Um, this project would, uh make missile. 01:01:02,470 Several miscellaneous improvements related to, uh lime feed carbon dioxide and chlorine storage and feed systems as well as some several other, um, improvements. Um throughout the preliminary design phase, there were, uh, several improvements that were identified that Haven’t been considered before and we thought it would be wise to implement them into this project where we have, uh, 01:01:26,470 State water Commission, uh, cost share reimbursement agreements in place and just to just to Do things as efficiently as we can. Um, some of the items that were identified, uh were, uh, carbon dioxide storage utility transfer improvements. Um, High service pump drive improvements and then several others that are in your pocket. 01:01:46,870 Um, the total cost for the engineering service amendment to implement these items into the final design phases about $195,000. Um, with the previous amendment, plus the original task order amount. This puts the total task order, uh, amount at $769,000, which is about 10% over what we had budgeted for 2024 for this, Um An Engineering service agreement. 01:02:14,430 Um, we would recommend, uh, amending our 2024 budget for this project, and, um Approve entering into the approve The amendment number two for the Engineering service agreement, and then I also have a second motion on here that where we would recommend, um authorizing staff to submit this amendment to the State Water Commission for their, uh, consideration to 01:02:37,870 Cost share in these increased costs. Um, if you have any questions, I could answer them. We also have some, uh members of a two S here to answer questions, too. Any questions, comments. Just one, Mayor Derek Any issues with the additional funding coming out of the utility fund, Um mayor Comm. Kisa. No I. 01:02:58,730 I talked with the finance director today and he, uh he gave me the go ahead on it. Ok, thank you. OK. Then, We’re gonna need two different motions I wont do, amend and approve the change Order number two. I moved to authorize the use of an additional $70,000 out of the utility fund and approve Amendment. 01:03:16,900 Number two was presented. OK? Motioned by Comm. Kisa seconded by Comm. Braun questions or comments Roll Call board, please Comm. Kisa Roar Olson Yes. Braun mayor. He. Yes that motion passes and then a second motion to the State Water Commission. 01:03:43,070 I moved to authorize city staff to submit this amended Engineering Service agreement to the State Water Commission for cost share consideration. Ocean by Comm. Kisa seconded by Comm. Braun questions or comments Roll call vote, please Comm. roar Olson. Yeah. Bra Camisa? Yes Mayor heling? Yes that motion passes. That’s the end of our printed agenda for tonight. Is there anything else to come before the board? Mayor and Ah, fellow commissioners. 01:04:10,800 I have a something I’d like to say. Hey go ahead. Comm. Olson. Can. You. Hear me, OK? Yeah. We can hear you go ahead. OK, uh, I would just like to say that this morning I turned in my letter of resignation to Mr Neubauer as I no longer qualify for being a city Comm. 01:04:35,270 , Um, I’m moving to down to Nebraska where all my family is and pretty much to take care of help My brother and my sister sister in law Take care of my mom and, um it’s just a time in my life when I need to be down and close to family so Just, a couple of people that I would 01:04:52,470 like to to thank and first it’s the the people of Mandan. I’ve been there for 40 years and met so many people and friends and you know, from the golf course to the referee and to the city to just man in is such a great place, and I always call it home. 01:05:17,070 Uh, Second the man end Park District. I’d like to thank Cole Hagelin and Garrett Schultz. That, you know, 22 years of being around helping community and taking the golf courses to what they were and made him such a good Uh, Draw to the city of Mandan. 01:05:41,070 And, then last the, uh, the city staff and all the boards that I was on and, uh, Mr, Neubauer, jim, you know, the city administrator, my fellow commissioners, and, uh, I just want to say a special congratulations to you, mayor that I appreciate the phone call that you gave me this morning and stuff that I told you I kind of always thought of you as Mr Mandan and, uh, 01:06:02,370 people really knew how much time and effort everybody Puts in to make that city what it is, and I think they should. Everybody should be very, very proud. And. Uh, so with that I thank everybody, and, uh, That was my last meeting. 01:06:28,070 OK? I think we have to have a motion to accept the re the resignation. Correct, Amy. I move to accept the The Nation of Belson City Commission. Second And we have a motion by Comm. Rohr seconded by Comm. Ka. Any further questions or comments. Roll club vote players. Comm. Olson. Yes Brown? Yes Camisa? Yes, Roar Mayor. Hell. Yes, Brad. 01:06:59,530 We’d like to thank you from the bottom of our hearts. The citizens of man in would like to thank you. I know it’s a tough thing to resign in the middle of something, but family is always number one, and it should always remain number one. And I applaud you for being able to Step aside like that, Uh, and take care of your family. 01:07:16,700 So thank you for the time you served on the commission and everything you’ve done for the community. Amy. Very welcome. Thank you. And. Then. With Pa’s resignation. The Commission’s in a spot that you’re going to need to fill. 01:07:38,600 Uh, Brad’s position and amy if you could lay out a few ways that that could be done and give the commission some direction and the public, so they know what’s gonna happen. Sure. So the, uh, the term expires in June 2026. So there’s a a couple of years left, it’s considered an UN expired term. Um, And. When that happens. They’re essentially three ways forward. First. 01:07:59,570 The commission can decide to call a special election to fill that unexpired term. Um Second. The Commission can wait 15 days and then appoint a person to fill the spot until the next regular city election, which happens to also be June 2026, so it’ll be the same amount of time. Um, the way that the commission did that The method of appointment is up to the commission. 01:08:19,100 Um, there’s not a set. Procedure you could accept applications. Um, you could choose another method, but it would be up to the commission. Um, during that 15 day waiting period. Uh, citizens can file a petition with more than 5% of qualified electors. So 5% of the total votes from the last election. 01:08:42,130 Um Asking for a special city election, and then we would have to have a special city election. The board cannot appoint someone. So. That’s Why. There’s that 15 Day waiting period to give people the chance to do that. Um, that deadline expires on July 3rd, so assuming no petition is filed the earliest the board could appoint someone as July 5th. With. The. 01:09:01,330 November elections Coming up. Could the city use that as its special election date. Yes. Yeah, you could run it in conjunction. There’s no um Time frame, So yeah, that would be fine. 01:09:20,930 So you could, the commission could either appoint Call the special election for November, which would be the most logical or call a special election and pay for it. Yeah. Yeah and like and again like I said, Um if if a petition is filed within that 15 days, and the commission can appoint we’d have to do the special election. So. So a amy Mayer there. 01:09:36,130 I understand Then if we go for if there would be a special election in November, we would have to go through that period of time without that Comm. seat being filled. Is that correct? That’s correct? Yep and the same process will be filed, as followed as far as people wanting to get their name on the ballot. Could you appoint somebody to fill the term and tell the special election. No. 01:09:53,470 The appointment would only be for that full term, So if you decide to go that route, you’d be without somebody. OK so the commission will have some things to work out here and our new mayor of Be. 01:10:12,830 The first thing on his agenda, I’m sure is to try to correct that or figure that one out so Yeah unless the commission were to decide to call a special election tonight. Really. You’d have to wait until like I said after July 3rd. So July 5th at the earliest. 01:10:29,800 I think it would be best for the the new mayor and the new commissioners to to be on board first and talk it over with city staff and see which way is the best for the community to move forward. Been You’re helping. Were there any further questions on the, um Mr Olson’s resignation and what attorney Ulster Provided I don’t believe so. You. If, not, um, Mayor Helbling. We did ask staff to come up with some Comments and stories about your term as mayor and city Comm.. 01:11:05,600 So just We just have a few of them that will go through tonight. Remember there’s payback. So. Please bear with us while we, um, talk about a few things about you. So jeez, I’m old I can hardly ever lift that thing. Um, again after you decided not to preserve pursue another term in office. 01:11:28,130 Um, this is gonna be hard for me. I do because I think we’ve Spent a few years together. So as mayor since 2016 and also from 20. 2008 to 2012 prior to being mayor served as city Comm. from 1998 to 2008, and before their for that eight years as a Park board member. For the show. 01:11:54,770 This is your life or part of it. Uh 1998. We had a population of 15,956 people. Um as of 2 2022, which I didn’t think a little bit more on that we’re about 24,486. 01:12:19,270 10,000 person increase is a pretty good Um, increase in your population for us over that time period in 1999 old Red Trail was completed and in 2000, I think we did the special assessment district for that which was my first introduction to what a special assistant district was. And the, um Residents in the area were not real pleased with the amounts that they were being assessed. So kind of wondered, Uh, what was I doing here? And. 01:12:38,570 Why. Was I here. Uh 1999 also saw a $17 million completion of a new wastewater treatment plant from lagoons to a mechanical system. And. Now we’re talking about Um, improvements to that plant north of $100 million in the next several years. I my segue from wastewater plant into the creation of the city administrator position. 01:12:59,870 I thought that was quite appropriate. Um, so the administrative position was created in 2000. I was hired in February of 2000. You were part of that decision. Sometimes. I. Thank you and sometimes I don’t. Um, but, um, for 99% of the time it’s been a It’s been a great run. Um 2003. We had some adult entertainment ordinances. 01:13:24,930 Which, um, some of you will remember. Some of us thought it times are quite interesting. Um I don’t think we Really quite Knew what we were doing then. However the ordinances and the redevelopment plan that is now credited with setting a higher standard for man and central business district. Those were some interesting times. 01:13:47,930 I don’t think anyone quite knew how many single mothers there were staying at home with their Children or going to school during the day and working in the evening. Uh, we are. 01:14:03,800 You are part of that discussion on suggesting a two year transition period so that businesses would have time to, um, transition from their current activities to figure out what they were going to do next. Um, the issue was referred to voters and received overwhelming support. Some of the most well attended City Commission meetings in our time or during this period, um, again. Lots of interesting things, um, occurred during that time. 2003. 01:14:25,270 We also, uh, the man and farmers elevator went bankrupt. Um, many of you remember were family Dollar and O’Reilly’s is right now we did a trade with BNSF that said All, right if you give us the property from the city standpoint, we tear down the elevator and return. We will then turn around and sell that property. 01:14:38,800 Um, that was a good transaction for us because we tore down the elevator, which was also very interesting times as watching the salvage crew. I think Johnny. B and his crew do that was, um, I, Think one of those events in Mandan that you talk about people. 01:14:53,730 Backed up with her pickups and their coolers in the back and away they go. Um but we were we able to advertise that property for sale, Um family dollar. Riley’s, um, bought it and are still there today, so very good. 2004 partnership with state of North Dakota and initiating a lawsuit with BNSF Railway for cleanup of the underground diesel fuel spill first discovered in 1985. 01:15:13,470 We reached a settlement in July of 24 of 2004, which made way for the remediation system that allowed for redevelopment in the central Business district. Um, settlement coupled with working with our local legislators, lenders and other elected leaders, uh amending and rewriting some of the North Dakota environmental laws that made redevelopment downtown possible. 01:15:35,200 Clean up in legislation projects such as Library Square one and two men and place People Square Medicine Shop and several other businesses would not have occurred. Um I think we both thought it was interesting times in the capital when navigating between the two negotiation rooms. 01:15:54,570 Thank you to Charlie Miller Sharon Gallagher the commission at that time, um, going back and forth with BNSF and also, um Lyle with him with the state of North Dakota, who is the assistant attorney general working on it, so kudos to them. Kudos to you? Um, that was a big part of of us reaching that settlement. 2004 also saw the combination of the, uh Morton. 01:16:13,130 County Library and the man in public library next to The room. We’re sitting in right now used to be the Morton County library in 2004. That vote occurred and and resulted in the opening of the Morton man and Public library in the remodeled freight house. 01:16:33,700 2005 the beginning of the Renaissance Zone in storefront improvement programs in downtown Mandan encourages new construction. Remodeling business retention and recruitment. Um 2005 the unity by the busy committee, I believe brought the, um man and middle school back up for a vote was Supported and passed in the new middle school opened in 2008. 01:16:59,130 2006 you’re part of supporting hiring of business development director creating that position to bring additional businesses and the sales, tax revenue demand and end goal of that was to attract more retail businesses to town, which in turn created more sales tax revenue, which in turn helped reduce local property taxes. 2011 Missouri River Flood. A. 01:17:16,130 Lot of things that happened in between there, but I’m trying to hit some of the high points and not keep you here for the rest of this book, Um, tonight, but the Missouri River flood. Um you were instrumental in getting the bass plugged several meetings with, um Um Governor Dalrymple and and the crew, bringing the North Dakota Department of transportation in every possible dump truck they had in the state here to dump 01:17:36,430 uh, clay into the in the bays and and, in essence, save a lot of people from having to sandbag. Although. There’s still a lot of it going on Those times were, um Interesting. Say. The least You and I were up about six o’clock every morning. Driving around town. Spending way, way way too much time together. And. 01:18:01,600 I think sometimes we got on our nerves, but we always were able to. All right, Let’s we need to get away from each other for at least an hour, and then we’d be back at it. Um, but again, lots of credit to you. 01:18:15,330 Um and leaning on you for the assistance you provided during that time. Have been a lot worse and what residents were supportive of all the actions we took. Along the way. Wow. I didn’t think this would be that tough. 2014. We saw the opening of old red or Red Trail Elementary school 2016 and 2017 chief. 01:18:39,870 Ziegler comes on board in January and we have the Dapple protests going right away many days spent with Law enforcement center. Many tents but respectful discussions on what to do next. 01:19:02,970 Um 2019 really big deal was amending our ordinances to allow chickens in town, so Um, one of my favorite memories is because our legislative session was going on at that time when I walk into the Capitol and I had About 1000 people clucking at me As. I walked down the hallways. Uh, thank you. John Van Dyke, Our Former planner, Um, provided them with a lot of entertainment and me was going on. What. Have we done? Um interesting enough. 01:19:23,600 We don’t really have a lot of problems with chickens in town other than the other day, our code enforcement officer said that we did that have to chase some chickens down along with a goat. And I don’t really know what the outcome was. Nor do I really care 2020 Library in downtown Park Enhancement project, um, resulted with Comm. 01:19:41,800 Scott Davis and Mayor hell blink being approached by energy transfer with their desire to contribute to a project demand and the result. Was a $3 million donation expanded library with an 8000 ft edition that included an atrium with public restrooms, public Meeting rooms. Staff offices bookmobiles. Um, remodel of the 13,000 FT Existing Library, um park improvements. 01:20:05,870 Main entrance off fourth, um, permanent decorative fencing production park Installation of shade sails in the front band shell meandering walking paths, lighting elements, um, that tie the history of the railroad, the gas fire pits and I think one of the areas that you pushed hard for was a play area and we can see that play area being used every day. 01:20:20,730 That completed in August of 22 and has been in heavily used since its completion. Couple of street projects have happened in the last 20 plus years old Red trail, um, used to be a country road moving with two lanes up to the northwest part of town. We’ve turned that into four lanes. 01:20:40,770 Um, are from east to West. We’re looking at Manon Avenue being reconstructed Collins Avenue being reconstructed along with sunset Drive. And. We have been systematically moving through the town with street maintenance, street maintenance items. 01:20:59,400 The goals for keeping the roads that aren’t fair to good condition in that condition and working on the reconstruction of those in need, which there never seems to be an end to Other infrastructure projects. You’ve had a hand in the raw water intake $36 million project. Um, the split with um, the State Water Commission state of North Dakota along with the Tesoro now Marathon Refinery, um, very much in favor of the city. Mandan. 01:21:19,000 We’ve got a $4 million public works edition and renovation Construction of Lakewood Fire station can complete gut if you remember and remodel a fire station Juan back in 2001. And. We’ve also renovated the existing law enforcement Center when Morton and burly county um constructed combined center. In the process. We’re still working on moral highway. 01:21:40,900 Probably since 25 years, um, the lower her levy project. We’re starting the downtown street reconstruction in the heart of downtown, Um, also the streets and roads that are just to our north. Um, you as part of the commission have approved, um, that project to move forward. Redevelopment of the high school site. 01:22:00,770 We talked a little bit about the waste water treatment facility 25 years later and the need for 100 plus million dollar upgrade, Um, replacement of the Collins Avenue Reservoir. We’re in water treatment plant optimization phase of 1000. 01:22:19,400 I think I put in here because it seemed like every year we’ve got a new optimization phase and we also a structural engineer here today looking at City Hall renovation. The list goes on. And After more than 20 years of service to your hometown. Mayor Heling. I think you can be best described as always bringing a common sense approach to issues. You will notice all of the interesting infrastructure projects. 01:22:40,700 I think it is definitely where you arrived at your love for engineer and architects. Um One thing that many of you may not know is during your time in office, and even when you’re not in office you if you saw a red truck driving around the streets in the wee hours of morning It is most likely mayor Heling. Up before most to see what needed attention. 01:23:00,430 Um Sue can probably attest to that. Uh, one of the things I appreciate about. Mayor Heling was his willingness to disagree. And be disagreeable. Just kidding. Uh, well, for the most part as staff were encouraged to present opposing opinions as he always wanted the best for the city and as a whole robust discussion was OK. 01:23:21,800 I’ve known Mayor Helbling for many years. Not as many as the folks here tonight but his love for family, Uh Demonstrated during the many mornings on our drives, drained the flood of 2011. Or numerous snowstorms or the many meetings where we Early in the morning we attended on his cell phone would ring There wasn’t a doubt. 01:23:48,700 It was one of the grandkids calling Everything would stop. He took the call. I didn’t need to know who was calling. As a smile on his face said it all. So Good for you guys. Um city staff and all those current and past. We’d like to thank you for your dedication. 01:24:09,800 And your many years of service to the citizens of man. So and we wish you the best. And If. You like this book? You can carry it out yourself because I’m not going to so again on behalf of, um all of us. We do have a plaque for you. 01:24:31,730 Um, thank you for your dedication to the city of Manda in 1990 to 1998 as a man in Park board, 98 to 2008 Man and City Commission 2008 to 2012 as the mayor and 2016 to 2024. So thank you, Tim. Almost sounded like an obituary there, Jim, so I don’t know what’s coming up. 01:25:12,870 I’d just like to take a minute to thank everybody, Uh, the citizens of manned in, uh You’ve all been great. Every, one of you. I know we had a lot of doubts. We had a lot of bad things happening. 2025 years ago, Uh, lot of people put their trust in US and I. 01:25:31,470 Thank you for that I couldn’t have a better family and more supportive family, My direct family, Um If my family at work always covered for me, no matter what was going on. They might have complained about a little bit about it at times, but always covered for anything that I had to do. They just picked up the slack and did it. 01:25:47,870 Uh, the Uh, employees and the people that work for the city of Mandan. You guys are awesome. There’s been a lot of people that have worked for the city. But. I’ve never seen a better group at getting along together and looking out for each other this department then what’s here today? You guys are awesome. 01:26:03,670 I think you’re gonna take the city to a whole new level? I look back over all the years and jim and I went through a lot of different things together. Uh, Back In the early days all that Really stands out a Dell wetch Vern Cermak, the MP O. I mean them guys have done just done so much for the city of Mandan and Steve Nardello In. The. 01:26:24,000 Early days we did so much together. Ellen Huber did so much for the community and a lot of times it was never recognized for it. Um greg is always been the rock. 01:26:41,000 How you We’d always come up all these harebrained ideas and the things that we should do, and greg always found a way to pay for it. So. I can’t thank uh The citizens, a man down and especially the employees. For what you guys all do for your community. You’re the ones that make it what it is today. The commissioners. I’ve served with great commissioners. All of you guys. I see Ambers in the back. 01:26:58,870 I mean we’ve had We’ve been very fortunate that we’ve had really good dedicated people that want to serve the serve the community. We’ve all had disagreements, but the nice thing is in the disagreements. I know. In your hearts Everybody always had the same or wanted the same outcome And that was the best for the community. So. Like I said. 01:27:17,900 There’s been disagreements, but we always remain friends and and that’s that’s important thing. So. Thank you all? Um thanks to everybody that stepped up to run in the last the next election. Uh, jim. Welcome aboard here shortly, Craig back there. Welcome, Joe.
