00:00:06,700 Here. It’s five o’clock. Is there a chaplain in the room. Welcome. That But. We. Think for today we thank you for this moment. God, I Pray that, uh, we can just, uh, calm ourselves and be ready. We’re grateful for all the rain and we see how, uh, the grass is enjoying it. 00:00:34,170 The flowers and the trees and, uh, we wanna look on those as incredible blessings. I pray that you’ll be in with all the activity that’s happening with these. The minutes and all the things that need to be done today. I pray we do it to In, a timely manner and, uh, We. Wanna make sure we’re doing it with your your knowledge. 00:00:52,670 Song in Jesus name. Amen. Regions to the blood of the United States of America. And to, uh, like we to stands, one nation under God, indivisible with liberty and justice for all. Thank you. 00:01:26,900 OK I’ll call the, uh May 6th 2024 meeting of the burly County Park board to order first item is a roll call Members, please Comm. bah Comm. Woodcock. Comm. munson Comm. Bakken here. Comm. Schwab Comm. Herman Chair Bittner. Next item is the approval of the October 2nd 2023 minutes in March, 18 2024 minutes and bills commissioners. Move to approve. I have a motion and a second to approve any further discussion, seeing none call the roll. Comm. Bakken Comm. Schwab Comm. 00:02:01,000 Herman Comm. Bam Comm. Munson Chair Bittner yes, motion carries Um, Next item is Driscoll Park. Who has that I’ll I’ll jump into here in your, um, packets? Uh, you have a a recent, um Site visit. Um, that was done out of Driscoll Park. 00:02:23,600 Uh, we talked about it here a few meetings ago that there is a time capsule. Uh, that is due to be opened on June 14th 2024. From there. Audit response. Kowski is going to get some of those pictures up. Uh, for us. Uh, the question. I have, uh, first before the park board is How much maintenance. 00:02:48,430 Do we want to do at this facility prior to June 14th to have it ready for, uh, our Um Time capsule opening. Uh, obviously the first one that I see is the flag. Uh, in typically burly county Highway department has been gracious to take care of that for us, Uh and I’m hoping they’ll be able to do that again. Um But. 00:03:10,330 I’d like to hear your opinions on some of the other maintenance items. Uh, if we want to have them done and get them ready for our meeting. The time capsule itself. Um, I’m Gonna I’m gonna suggest that we meet out there earlier than the 14th. We have no idea what this capsule is in. Cased in. 00:03:33,470 We have no idea exactly where it is. Um, there is a plaque on a concrete pad that talks about the date that it needs to be opened. Um But with the Comm. Swab’s approval. I would like to ask, Uh Berley County hybrid department to come out with us. Try to locate it. 00:03:54,230 Um, I would like the capsule the tomb if you will opened up prior. I don’t need a backhoe or a jack hammer or a concrete saw the day of the 14th out there trying to find this. 00:04:11,800 Um, I’d like to have it available and ready for a program on the 14th to open it up and show the public but, uh, if we could, uh, ask for ply County hybrid department’s assistance and actually locating it, getting it above ground so that it’s ready for That 14th time frame. I don’t have a an actual program put together yet, But that is something I will have, Uh, ready for you shortly. 00:04:34,200 Uh, we have asked the DAV Honor guard to be present, since they’re the ones that have been taking care of this part for the last five years. Uh, and they have accepted that honor as well. So Was there. Um, What are some of your ideas. 00:04:54,300 What, should we? I have roughly about $3000 that I could allocate towards any improvements out here out of the budget for that park. Mr Chair. Uh, do we have a ballpark idea where this might be, or is it or is it? The? Assumption is it’s just under the concrete plaque with the plaque or that’s the assumption. 00:05:17,130 Um Marcus had offered that they do have a metal detector that they could bring out and search the area to give us a little bit better idea so we’d have a little bit better planning as to where we would want to look, But. Do. You have any, uh Assets pertaining to lidar or anything like that to go a little further, Marcus or No. OK? Commissioners. 00:05:39,930 I know a gentleman who was there when the capsule was placed And if I can find The contact number for him. I would be willing to, uh, be in touch with him and inform Comm. Munson. Uh, what he tells me. Sure. That would be helpful. 00:05:59,830 Yeah because II I don’t think we want to be in the position of digging it all up. Let’s let’s dig a park up so Uh, both Mary and, uh, Pam. Pam grew up in Driscoll, so they have been searching for the last few last month to try to find anybody that has any knowledge. 00:06:18,430 So it is great to finally hear that we have one person that was there when it was buried, and so that would help us tremendously. So, um They have some money in the Driscoll Park budget that can reimburse the highway department for Correct Yep, that work Comm.. Uh, I talked to Marcus about this, too. And This flag deal. I guess they replaced the last time. And it was wet. And. 00:06:48,200 It wasn’t good for the grass. Right? So Just be aware that A boom truck going in there. Work isn’t going to look the same when it comes out so Whether they can get to that or not. And. To. Be honest, that’s gonna be no different than we talked about excavating or trying to find this. 00:07:12,200 It’s going to have to be weather dependent over the next I wouldn’t start off excavating the back anyway, because if you don’t know where the hell you’re digging, you dig the whole park up. Then Call me. I work by the hour. 00:07:38,570 Ditto OK? Are you in? Are? You looking for a motion or are we just gonna direct the highway department to If. Mr. Schwabe is OK. Um, first we’d like to get a hold of this, Uh, Bob. Gelner gel gelner see what kind of, uh information he can get to us. And, Then from there if Comm. 00:07:58,170 Schwab is all right with it, we’ll move on excavation prior to the date a couple of things we can’t do like this. Sign. Uh, Got that kind of triangle in it. I don’t believe we can do anything there. And Somebody’s gonna have to stick that thing out. You can’t just go out there and start On Sign in and stuff it Digging. 00:08:28,200 That has to be done so the highway department goes down there and they’re not. Get out there and it’s not ready. I would certainly make sure that’s taken care of. What are you gonna do with that windmill? Oh. I have a suggestion on that one. Collected up all those parts that are laying around save every one of those parts. 00:08:56,330 Um, that is a very valuable old old windmill and that that really should be, um, overhauled and maintained its value. I can tell you, um we do You know my company has done a lot of historical reconstruction for the state of North, Dakota. 00:09:16,230 That’s one of our One of our key focuses and and things like that have value and I think we should My, I suggest, uh, taking it down and and putting the pieces together, and that might be a nice winter project when things are a little bit slower for For the highway department. Well, I don’t know that that’s in the wheelhouse or the highway apartment. 00:09:37,930 That’s I’m asking you I was hoping for a bid from IR for that. Well, we would actually do that and And for those reasons I will abstain from the discussion or the, uh, you know any any motions on that, But that is the sort of stuff that we actually do. 00:09:54,630 All over the state of I would incur about taking that down and and and housing that in a in a safe place. Um, I’ve been out there and it it is in disrepair and it it needs some serious maintenance and and repair work. So. Um I would suggest taking it down and then, uh, Uh, we can have that conversation at a later date. We’ll definitely get the parts cleaned up. 00:10:17,530 Don’t don’t lose any part. Don’t and don’t let anything get damaged. If. We have a boom truck out there. I would recommend if if there’s a boom truck, um we should be looking at how to remove that and I have a problem with that. Pardon me. I don’t have a problem. 00:10:37,730 Just don’t want to go out there and then when we leave Um We get complaints that there’s tire tracks all over him. To deal with it on a daily basis. Windmill looks like it’s kind of leaning a little bit. It’s probably time to move it. 00:10:56,500 Well, if it doesn’t come down, it’s probably gonna come down on its own, given some wins and stuff, so, I I would make that a priority getting that down in located someplace safe. In. The pump head should go with it. Yeah, people like to Borrow those That’s what we call it now when people walk off with stuff they intend to bring it back. Trust me. I. 00:11:16,730 Guess I always thought that was stealing. But, Mr Chair. Maybe, uh, the S Highway department could also look into refreshing the signs. As some of them are on the roadway. And That would probably be appropriate because of bur the county Highway department does have a signed shop. So. If. 00:11:39,700 There’s Something that they feel that they could Well, there’s some we can’t do, Marcus, we need you. There’s some signs we can’t do. Will. Those signs you can’t do just so you know, that’s another part. We’ve we’ve been involved in a lot of, um overhauling signs and getting new ones made and whatnot. Also. Like. I said. I abstain from voting on this anyway. A Comm. 00:12:02,670 ? Yeah, the one that’s on the highway definitely would like to be involved in that I can we can take that down and and put up a new sign there, Uh, Brown sign basically going into the park there. That’s no problem whatsoever. 00:12:17,200 Um, the other one that blue sign if you wanted us to do something on the bottom half of that we could. I don’t know what that symbol is up above, and I don’t have any idea that we could do anything with that. But the bottom part of that we could turn into a regular brown Brown Park sign. Um and just copy that. Information that’s currently there. 00:12:36,800 Um, that would be no problem. Uh, the, um the restoration sign of the big white one. We’re not real comfortable with that kind of sign, so that would be something I think would be better be done someplace else, or with somebody with better expertise on that. And. Then. The bronze signed refurbishing that That’s something we’re not really comfortable doing either. 00:12:54,630 So But we do a lot of that so Wood an asset to reach out to be the state Historical society to have a conversation there. It probably a place to start. OK? How old is that fireplace out there? Does. Anybody know in this battle of Stoney Lake sign for that. 00:13:27,000 We assume At the time when you know prior to that, uh, Um That’s where I would be running the metal detector around that. Well, that’s where the plaque is at that says that it’s there just in front of it. That Concrete Square. No looking for your, uh, for your time capsule. 00:13:45,370 Yeah, there’s a There’s a plaque right there in the ground with that piece of concrete that’s in front. It’s about 2. Ft. By 2 ft piece of concrete. There’s a plaque in the middle of it that states that it you know, this is when it’s supposed to be opened is June 14th 2024. But. You can’t find a plaque. 00:13:59,600 No, it’s plaques there in the concrete. I don’t know where the the actual Um, OK, I see. I don’t know the size of what they buried. I don’t know. But. Hopefully. We can get some information from from Rob. And. We can go to the next step from there. 00:14:22,100 OK? With that I would just leave it at that. For now, Um I will come up with a An agenda for the 14th and make sure that is sent out to everybody and and including the auditor for publication, Um Like. I said. If we can work ahead of time to make sure that that’s excavated and ready. 00:14:41,730 For the 14th. That would be the best use of time. So OK so no motions required on that. I don’t think so. Good. Next item, Kimball bottoms. Hey, Mayor. Bitner and Comm.. Good evening. Uh, on your agenda. First item, I. Guess would be Kimba Bottoms. Just an update for you. 00:15:09,530 Um, Last time we spoke about that We did put out a quote request for dredging that boat ramp. Uh, we received one quote from Midwest dragline in the amount of $6200. Which is similar to last year’s. I think it’s right on the same Same amount is what last year’s was for the for about the same amount of of, UM Dredging. So. 00:15:33,070 Um, as we discussed. You requested that I bring that back to the board for your authorization. Um And. Then. The Next item was the letter that we received last Friday, uh, from the Army Corps of Engineers. It kind of goes along the line with the discussion that we had had Prior. 00:15:54,400 Uh, Couple months back about the fact that we need to do something the corps had been approaching me just in verbal conversations about doing something about cleaning up the parking lot and the the asphalt that’s um sloughing off stabilizing that slope and, uh, So. They put it in writing. 00:16:15,730 Uh, in our, uh, asked us to proceed with something as we talked last time. Also, um, about Creating an RFP. For Consultants to, um to address that work. Um Comm. Munson and I had had talked, Uh Today about the possibility in the R fees about 95% just a couple of questions that we Possibly had to ask, Um, depending on how this conversation went tonight. 00:16:40,100 Um Possibility, either going out for an RFP or Could with the county be interested in having the water resource district. Address these issues Donut Kimball bottoms and going through that route. Uh, instead of going out for an RFP similar to I. 00:16:58,100 Guess you could kind of look at it similar to how the bank stabilization work was done up at Hog Island. If if that could equate to in that conversation. So a couple things there for for discussion. Back to Kimball. Bottom’s, uh, I would move that we approve hiring Midwest dragline for 6200 bucks to get that cleaned out. So I get no motion in a second, any further discussion. 00:17:24,600 See none called roll. Mr schwab? Yes. Mr. Herman. Yes, Mr Bain Comm. Munson! Yes Comm. Bakken Yes Chair bitner yes motion carries We also have some issues up at misty waters. You’re getting ready for that to Are. 00:17:49,800 You going to speak with this group about that too, OK? That’s That’s next on the list on the list. Let’s talk a little bit more about that, Um And kim OK? Do. You have a preference on how to move forward with that. Chair Bittner. I don’t um It could go either way. If. We go with an RFP. We could. Take a little bit longer to make a selection for a consultant. 00:18:13,730 You know we’d have to. I’m guessing based off of this route, we would go for an RFP probably advertise it in the paper. Um, if we go through the water Resource district, they have an engineer of record. 00:18:31,800 Um, that could start on the work right away to start doing the potential study that we’re looking at, or make a recommendation on an analysis. So what? What? Are. We actually asking the consultant or the water resource district to do do the bank stabilization Project? Is that, or are we Because originally I think we were talking about just Pulling out the concrete and asphalt and whatnot. But. 00:18:53,730 Uh, the thought when I was putting together, the RFP was looking for a consultant that has obviously has some hydrology background understands a river understand how the how the river flows so they can analyze how much of that existing boat ramp to take out. If. We take out too much. 00:19:12,530 My fear is that it could compromise the current boat ramp that’s in place right now. We have the fact that the old boat ramp is creating an eddy, which is depositing the silk that we keep having to remove. If. We take out the right amount. We could have that. 00:19:29,100 Push the sand right by the current boat ramp, and we wouldn’t have to dredge it anymore, and that’s kind of we need to find that sweet spot. I don’t think we just wanna have a contractor. Go in there and just take it all out. Because. It might be too much. And. It might compromise the current boat ramp. And. I think we need to have a consultant that Knows where that sweet spot is the parking lot portion Yes. 00:19:48,670 We need to take out the asphalt that’s sloughed off. We need to remove that asphalt back in the existing parking lot to a certain point that we are sure is stable and then stabilize that portion of the the River bank, so it doesn’t keep eroding and washing out. So. 00:20:07,470 There’s two things there, essentially, uh, you could even look at it as two potential projects if you wanted to break them into two pieces. OK? B. So going back to the asphalt. That’s Sarah on the parking lot, Um, is Being that that ground is topped with the asphalt. Um I That’s also a a stabilization portion as well. So Dragging that back. Are. 00:20:36,370 We talking, removing the entire asphalt? Because now we’re we’re gonna have to figure out something else to stabilize that bank with or we just looking at removing a portion of that lot in asphalt just to the point where it’s stable, so it’s not sloughing into the river Comm.. 00:20:54,000 Bach and the idea would be to remove the chunks of asphalt that have sloughed down the slope. Get those away from the water. Get those out, get rid of them and then cut that. Parking lot back. To a point where we know it’s not going to keep breaking off stabilize that bank. And, then re-establish some vegetation on that top. 00:21:14,100 Um, behind between the new edge of the parking lot and the rip rap that would be placed there so that we can We don’t have any erosion from from here forward. And then on the, uh, whether or not we were going to the water resource District or or look at Boone and RFP with this, Um, have you identified any cost savings with going one direction or the 00:21:28,000 other at this time? I think the biggest cost savings would be the fact of You wouldn’t have to pay a consultant. The additional cost that they’re going to mark up to do an RFP. Essentially, uh, because they’ll work that into their quote. For the work if they were awarded the project. Generally how it goes. 00:21:49,430 So Kush munson. One other part that that I’m looking at? We’re getting ready for budget. This is not a project we can afford to do this year because of the money we removed from our our budgets to to help that I’m gonna need to know what to put in. 25 budget to make this project go. 00:22:07,230 Uh, so the sooner we can get these info, this information, the better. So if that is the water resource district That Helps, at least with the budget side. Well. It’s kind of coincidental that we’ve been texting back and forth with mike guns. 00:22:28,330 Who’s the Engineer for the Water Resource district in Houston engineering and is asking if we could get together sometime this week, and it looks like maybe Thursday. To be able to do that. I. Guess. I could ask the question at that point. You know if that’s agreeable to the commission. I guess I know, I think that would be a good direction to go? To see if they would be. 00:22:47,300 You know he would be the one that would be involved so See if they have the bandwidth or whatever to even do it. Then. We could make a decision at our next meeting on that, because we’re not gonna do anything with it right now. As a hold off on the RFP at this point, correct? OK Just. One other question, I. 00:23:08,100 I think that we could Depending on what I learned from Houston engineering than we could probably, you know, authorize a Least putting out the RFP, depending depending on that discussion. One other questions are What is the timeline with, uh, the core. For this project or this mitigation. They have not specifically set a timeline. 00:23:32,870 They would like to see it done sooner rather than later. Um, they mentioned it last year to us, Um And I. I think I mentioned it once last year, and we talked about it this spring again. Um, but they The frequency of the conversations. 00:23:52,730 We’re stepping up, but I would guess as long as we’re in process with a mitigation solution that would probably suffice for now. I believe so, yes. OK, thank you. You know it might also want to consider since Midwest Dragline, um would be there already and take a look. See if maybe you can fish, some of that stuff out of there, too. 00:24:11,400 I could ask him stuff that’s fell in not the bank stabilization part. That might require another core permit, though. Yeah. I realize it would, But I’ve I’ve known I’ve known the owner of that company for probably 40 years and great family. This right? I’m guessing they would probably issue a permit for that portion rather quickly. 00:24:33,270 I bet I bet they would. But I. Think getting that getting the concrete out and the asphalt out would Might be more practical to do it while he’s already there because he’s mobilizing in And. He’s got the longreach backhoe. You know the I can you know? I believe the, uh Load restrictions are still on. Correct. 00:24:54,130 Um so we’re waiting on that, obviously for a couple of projects that I that I’m particularly working on I’m sure, as many others are, Um So. 00:25:10,600 I can I can ask the core if Can we Increase the permit area to look at that in the follow up on that I can do that follow up with the core and then also follow up with Ron and take a look and Thinks. That’s something you could Work in the OK? In all talk to Houston. OK, anything else on Kimmel bottoms. OK. Let’s go to knife. Bo, please. Uh K or bolt ramp. 00:25:45,400 Um, much of the same, um That we’ve talked about in the past with that with that boat ramp. It needs dredging again. Uh, the water is as we all know, on the river. It’s pretty darn low. Um, that boat ramp Wanna say was dredged either in 2020 or 2021 somewhere in that neighborhood. Uh, was it, 21? Thank you. Um So. We need to address that again. 00:26:09,500 Uh, we did just receive the Army Corps of Engineers approval with the 404 permit last week, and we just put the quote out today. Request for dredging on that as well. So we’re In progress with that one should know back in a few weeks, Um, for responses, and, uh, I can bring that. 00:26:33,670 Back to the board again at that one if I had a crystal ball, it’s probably gonna cost a little bit more than Kimble. Bottoms, Uh, They will have to haul that material up and out of the river bottom. Um, to meet core requirements. 00:26:51,070 Well, we We’ve been up and down that street the last time um we utilized that material in right in in and around the area there. Um, that requirement is is From. The conversation I had with the corps of Engineers was That, generally speaking when people do these projects, they require them to remove it from the area because most people don’t have a campground right next door that they can utilize the material, so we did use it. 00:27:10,430 I think as landscaping and whatnot around the area so I can check with them if that would be permissible, right? I would recommend doing that, because that was the What. We did last time. And then, um The. Last time we had that dredge the machine. Um, hooked the concrete and broke it. And. Then. 00:27:34,030 We ended up having to dive team go up there. And, uh, dive down and cut the rebar that was sticking up. That was, uh damaging boats and tires, so we want to make sure in these operations that we don’t have damage to the Uh, the underwater edge of the concrete. 00:27:55,070 It turned into a a pretty big deal, You know, diving down there and cutting rebar under underwater. OK? So. You’re just going to A quote on that correct. Bring it back here. I can bring it just like we did with Kimball bottoms. We’ll Bring that response back, uh, for board authorization. OK? Sounds good chair. The. Only concern I have with Neel is if there’s any Complaints. 00:28:19,070 It’s coming in on that almost daily, So. I don’t know if we want to set an acceptable limit that if he can get a quote, and it’s under X amount of dollars, he can proceed. Quickly. Or do you Want it back here for approval a month from now. 00:28:38,730 Well my preference being a boater would have, the sooner the better cracked me. I mean I’m not gonna be up. I’m not gonna be up there using it, but obviously it’s It’s sooner. The better I get a lot of calls. Yeah, um Do we have any A record. On what it costs this last time by any chance. 00:28:57,870 Obviously it’s not gonna be that. Oh Sorry chair. I believe last time that it was done, it was done in conjunction with the dredging of the channel, and that was done all by, um Misty waters. Misty Waters had had done it, so I’m. I’m. 00:29:18,470 We didn’t really put anything out for the boat ramp at that time, so I’m not aware of what that cost portion would have been. OK, then the next the begs the question of what’s in the budget for knelt. And. We would have enough. I’ve got 30, some 1000 in the budget for boat ramps in general for this type of maintenance. Um 6200 is gonna go towards uh Kimball. 00:29:39,070 Uh, so we would still have more. I wouldn’t depending on hauling if we have to haul we’ll be close to 10. Or would we be closer to the 6200 as this bit if we don’t have to haul I would venture that we would be almost at least double of Kimball. Double. Yeah. 00:29:57,870 Then I’d rather come back here as much as I would like to be faster. In Just timeline. We. We usually give two weeks for a court response. So we’re already to what the 22nd. And. 00:30:17,700 I guessing we’re going to be meeting first week in it, or first week in June, so it’s not too far off from when we receive quotes to when when the board could make a recommendation. OK, wait. Used to be a good path. Anybody else having input in that, OK? Right any other business Park board? No. Thank you. Thank you. OK not seeing any other business Park board is adjourned. Thank you, gentlemen. 00:30:50,770 OK, I called the May 6th 2024 meeting of the burly County Commission to order first item on the agenda is roll Call members, please Comm. Bakken here. Comm. schwab here, Comm. Woodcock. Comm. munson, Chair here. Next item is the approval of the agenda. Anybody have any additions, subtractions anything else? And, get a motion, please. 00:31:21,170 Would you approve? Second motion the second to approve any further discussions. A none Call the roll, please. Mr Schwab. Comm. Munson? Yes Comm. Bakken? Yes Chair Bitner Yes Wilson carries next consideration and approval of the April 15th 2024 meeting minutes and bills Commissioners I approve the bills are reviewed in the bills, and I would make a motion to approve the minutes and the bills. 00:31:43,000 Second motion to second any further discussion so you can call the roll. Please Comm. schwab? Yes Mr Munson. Yes. Comm. Bakken Yes Chair. Yes motion carries. Consent agenda. There’s abatements applications for licenses, Raffles and special Event permits second access permits. Anybody. I. Wanna pull anything off there for, um, further discussion. 00:32:08,830 I would move to approve second motion to second to approve the consent agenda any further discussion A. No Call role, please Comm. Schwab. Yes Comm. munson. Yes Comm. Bakken Yes. Chair Bitner yes, and carries County Engineer Hall public hearing on vacation to Vacate Section line, Marcus welcome. 00:32:34,870 Good evening commissioners under the North Dakota century code, the county Board of commissioners may close the section line, um as long as it meets certain criteria. Number one is that we receive a petition from interested landowners in that particular area. Uh, with the request to close that section line I I have included in the packet. The, uh, application that we received on this particular request. 00:32:55,670 Uh, Tony Fick, uh, has made a request out in wild Rose Township. Um, the county board may go ahead and close the section line if, after a public hearing is determined that there is a public benefit for vacating section line and basically no additional damages to other entities in that area, um or the cost associated with that, uh, there’s maps in your 00:33:19,230 packet, hopefully showing you the location of the the, uh, requested, uh, closure. I’m happy to answer any questions, either now or after the public hearing. So Wish any questions at this time? I don’t see any questions. OK. I will open the public hearing concerning vacation of a section line. 00:33:42,600 Um, is there anybody that wishes to speak on this item? Please State your name for the record, please. Arlene fed. Tony Pardon me, Tony Fed. Um yeah, we would like to, um we own the land on the South side, and paul Silvern owns the land on the north side of this section line, and it leads right into our pasture and we own The section 00:34:14,670 line that leads goes through our pastor. We own both sides of that land. Um, let’s see. We haven’t seen traffic go through there for I’d say, 4040 years. And. There’s a lot of rocks in there, and during the summer, it doesn’t get mold. So. 00:34:33,330 There’s A lot of old grass in there, so if it’s really dry out, and somebody would happen to drive through there, there’s a possibility of a fire. Um It’s not really passable safely and the tenant on the other half of the section line also would like this vacated also And. We basically graze the land on each side. For cattle. So. 00:34:59,000 That’s our reasoning of why we would like to vacate it. OK? Thank you. My name is Paul Silbernagel and I own the property on the north side of that section line, and I reiterate the same questions, I guess or concerns they have. 00:35:34,730 It’s not a possible section line and I’ve owned the land there for approximately 15 years, and I’ve never seen a vehicle on it, and, uh It’s um Kind of a waste of property. Otherwise, I mean it’s not being used by anybody and I Would like to see it vacated. Just for fire safety and other issues like that. OK Thank you all right? OK, this is a public hearing. 00:36:12,070 Does anybody else wish to speak? State your name for the record, please Chair commissioners. My name is Alan. Liar. Um I am a trustee of the Liar Land Trust, which has land adjacent to that property. Uh, I I’m against closing the section line. For. No. Particular Reason is that I don’t want the section line closed. 00:36:33,570 It’s a passable section line if you want to pass it, but that’s I just don’t want the section line closed. Much as I got to say. OK, thank you. Hey, anybody else wish to speak? Once against public hearing. Anybody else was to speak on this item. Third and final call Anybody else wish to speak. Seeing. None. I will close the public hearing. Um Marcus. 00:37:14,670 I I didn’t know if you had anything else to add. But, you know, as as I’m looking at this I can understand. Landowners desire to have a section line closed, but I don’t See Why. We would do that at this location. We have to approve a public benefit, right? I don’t see it either. Right. 00:37:40,570 Um, they reserve some gonna be a road here or what’s What do you know about the commissioners? At this time? I don’t envision a road any time in Any time in the future. At some point maybe a road will go in that area. Uh, but we do have section lines all over. 00:37:58,330 Uh, the hunters sometimes use them granted this one at this time may not be used, but some point in the future that may be used for that purpose. Um, there may be access needs as high water tables. 00:38:14,830 Get up, you know, every once in a while we have issues with that, Uh, areas become impassable and they have to use section lines to get in. But, um At this time. I don’t have any additional information that it would you have a an opinion on a public benefit to doing this, Uh, commissioners at this time, I don’t see any public benefit to do on it. So Comm. Schwab. 00:38:36,130 Have you been down and looked at this? Uh, commissioners. I’ve been down on the road. I haven’t driven up to the section line itself on that. I don’t know so Zero. Is there a fence along there? Yeah. There is a fence on the Can’t drive on it because there’s someone who put a fence on it. Is the fence going right down the section line. 00:38:56,530 Yeah I if the fence is going down the section line you can go on either side of the fence and drive you can still be within the rights of the the statutory right away. Yeah, it sounds like it’s right on the section line, so It’s not supposed to happen either, but No. So. I’m not commissioners. 00:39:14,670 I’m not seeing a public benefit. What are your thoughts? I? I’m At the point where Seems like every other meeting. We’re abandoning section lines and then start on. You know it’s starting to worry me. 00:39:33,870 You got to put roads in and This is right in the middle of You know it isn’t like it’s on the end or anything. It’s right in the middle of everything, I. I can support it. OK? Well, commissioners. Make a motion. I move that we do not abandon the section line. Motion motion, the second any further discussion. See an uncalled roll. Please Comm. ban. Yes Comm. Schwab? Yes. Comm. Munson. Yes. Chair bitner. Yes, thank you. Thank you, Marcus. 00:40:18,300 OK, next item. Tony planning director Flanagan Baker Subdivision Final plat and then a public hearing. Welcome, Mitch. Good evening. Commissioners. Um Like to present the findings of the April 10th Planning Commission meeting for the Baker. Sub vision final plant. 00:40:45,070 Legal description is this part of the Southeast Quarter, Section seven and part of the Northeast Corridor section 18 all in one township, 137 North range 79 West. This is in Missouri Township. We were first approached in November of last year to discuss the Baker subdivision. It is a two lot subdivision that’s in your packets. Um lot. One lot. Uh, Two for the subdivision. Not. One is 54 Acres 50. 00:41:12,670 14 Acres or 04 Acres. Lot two is 14.47 acres Total of 69.19 acres. The stormwater management waiver was approved on March 21st this year. The paving waiver was approved on February 21st. The public hearing to vacate the section line easement was approved on January 7th. The Final flat contained four revisions to meet Article 33. 00:41:42,000 The, uh Back. On the other end. That The section line is right here on this dash line. Um, it was vacated because there’s access to, uh 1804 right to the north of it. This section right here is, uh, 66th Street. With the right away. The, dedicated 75 ft ride away. 00:42:22,600 Uh, this here is the, uh, dedicated easements for the stormwater management plan. The vote to approve this was 8 to 0 at the Planning Commission, based on the supporting documents and findings of that commission is my recommendation to approve Baker Subdivision Final plan. Think Comm. sad. Uh, mitch has, uh You been checked to drainage on that. Uh, the stormwater waiver was approved What. 00:42:50,330 They did include that easement. I mean the the drainage goes towards the south towards this is going to be another one that we add to our list at the back where the county’s got to go in and fix things at high cost. No. 00:43:07,030 Um, we did they did their storm water management waiver on it, And because it’s Pretty well drained through that he has been through the rest of the pro. Thank you. Any other questions. What are your wishes Commissioners? Move to approve. Second. I have a motion a second to approve any further discussion. So. You. Call the role, please. Comm. schwab. Comm.. Munson. Yes. Comm. and Chair yes motion carries. 00:43:38,500 Might as well head into that public hearing. Commissioners, Um This is a public hearing to amend article 21 floodplain regulations is become necessary to demand the current article. 21 Flood Plain regulations to correct and position our ordinance in line with the North Dakota Department of water Resources and FMNF IP technical requirements. The final. 00:44:05,130 The first public hearing was held at, UM at the Planning Commission on April 10th, the other, um This was notified in the paper. I believe on the 13th for this meeting. The Before. We, Get into the, um, ordinance. I’d like to describe the development of this. And on March 29th. 00:44:31,930 FEMA notified burly county of creating and validating the new draft flood plan, Uh, flood insurance rate map firms. Uh, database for the flood risk project of burly county. This is the initial process for making the 2024 preliminary maps available to the public. After release of the preliminary flood maps on August 22nd. 00:44:53,130 FEMA, North Dakota Department of water resources, Burly County and the city of Bismarck held AC CO meeting at the Bismarck Event Center, in which 100 and 65 burly county residents attended the public hearing a public open house. Sorry, those citizens were able to view the 2024 preliminary maps have their property floodplain determination completed. Inquire about the floodplain mapping and speak with specialists about mitigation. 00:45:17,570 Insurance floodplain management and engineering engineering data. On 20 on December 12th of last year, the letter of final determination was issued by FEMA on these maps. Basically. They closed the appeal process. Which was a six month period when they opened up the P preliminary maps and they had six months for county residents to appeal these maps. 00:45:38,470 Those appeals were based on technical errors that FEMA could have created. None of the appeals were approved. But they were revalidated on the new maps. All the all the Lomas and Lomas were revalued revalidated. The develop in the development article, 21 multiple stakeholder groups. 00:46:01,530 Meetings were held with the county and the city of Bismarck, the North Dakota, uh, state NF, IP coordinator and FE MA region, eight representatives were an integral part of the ordinance review and changes. Public hearing notices for the draft were posted on April, 10th and April 23rd to date. 00:46:22,470 We have not received any comments, either in opposition or in support of the revised Article 21 Changes to the draft ordinance were highlighted and underlined strike through strike throughs to include certain new definitions, technical requirements for the enclosures. Basically. Those are the bottom section of a walk out basement or a walkout garage where it’s all it is is designed to hold the girl, Uh, car for parking. 00:46:45,870 Um and reduction in the size of accessory buildings allowed to be built below the BFE within a special flood hazard area. Uh, and mention in the firm. Uh, map is adoption pre firm is basically June. Uh, excuse me. 1985 Uh, the firm date of adoption is is June 6th. And. 00:47:11,470 Um, no changes to the base lead, elevation, Free board Heights and the 1% special Flood Hazard area and the 2% 500 area. We’re not changed from the original 2 ft requirement. Any questions, OK? Commissioners. Any questions? OK, Thank you, Mitch. I will open the public hearing on the, um Floodplain Zoning ordinance amendments. Does. Anybody wish to speak on this item. This is a public hearing. 00:47:40,370 Does Anybody wish to speak? Third and final call. Anybody wish to speak. Who closed public hearing. Um, about the only thing I need to point out is on page 17 of 22. Mitch. There’s, uh, right about the middle of the page and section C. 00:48:02,600 Accessory structures that are not enclosed and do not have more than one. Rigid. Well, not ridged. Rigid R. I ID. So. If. We approve this. I would like to see that word changed. OK? Remember I. I Yeah. We I. 00:48:28,830 Yeah, There was a couple of changes since that meeting, and I Uh, one of the meeting, one of the comments out there was a question about the RVs. Right and I mean this is gonna be hard for FEMA for us to enforce. But the idea is that if they’re located within a Shifa or the a special F had hazard area They can’t be permanent. They have to be moved every six months. 00:48:50,670 So if Somebody owns an RV and it doesn’t have tires and doesn’t have current plates. You know, it’s I don’t know it’s against FEMA regulations. And. I will change that rigid. OK any other questions or comments commissioners. I entertain a motion to approve. So I moved Thank you, Comm.. 00:49:20,300 With the one change of the one word with the word rigid right, OK? Second, no motion in a second to approve with that change. Any further discussion. See no call the roll, please. Comm. Schwab. No Comm. munson. Yes. Comm. Bakken Chair bitner yes motion carries Um, next item. Sheriff Leben Retirement release of law enforcement, canine and burly East Renovation Project Welcome Good evening, Mr Chair Comm. 00:49:51,530 is the first, uh, item. The retirement and release of a law enforcement canine. That’s pretty straightforward. Um, we’ve been here before on this, uh, just to give you a little background in 2016. We restarted our canine program. At the sheriff’s department. 00:50:18,370 That was the first time in many many years uh, that the department employed canines and canine officers. Uh, since the program’s inception. We are currently on our I believe our fourth canine and we’ve had multiple canines at different times. We have retired three of the canines. Prior to this. 00:50:44,530 This will be one of the original and the last original dog that will be retired after eight years of service, basically, um, the original handler left our agency four years into the service of that canine. Uh, we re handled the dog. 00:51:06,930 Meaning gave a got a new officer that trained with that dog, and now the dog has is reaching the end of his life span for police work, and so, basically what we’ve done with the help of the state’s attorney’s office in the past, as we’ve drafted in agreement, uh, between the handler and the county. Some of $1 takes possession of that canine for the rest the canines life, thereby absolving Burleigh County of any responsibility, both liability wise and financially. 00:51:36,470 And so what’s going to happen here is we have one of our existing canine handlers on family medical leave, he’ll be coming back about mid July sometime. The. Other deputy leaves for training. To, get the new canine and be trained this Friday once his training’s done, he’ll come back, start working, and then eventually as that other deputy returns back to work. 00:52:01,970 This K nine, handler will retire the dog and take possession with your approval. Okay? Commissioners were you wishes? Um, moved to approve. But Kelly. What is that where we at is far as Um, number of canine officers currently and what’s their scope of work? I just I just want it on the record for Because it’s such a instrumental program within law enforcement. 00:52:29,600 I just want to get that out there. What, what we have in service. Perfect. Good question, Mr Chairman Comm. bark and second Emotion Is there. A 2nd 2nd motion is second. Go ahead. Um so, basically, we have currently two canines. This. 00:52:52,100 One will be working at one time We did have three canines, but then that that was kind of a It was a donated canine. And then that officer took a promotion went out to the jail. It was it was a good idea. But it was hard to put it into reality because he was in a command position out at the jail didn’t have a lot of time to dedicate to a canine. 00:53:11,570 In that facility, which it’s a good deterrent for drug activity of people being arrested and coming in, so currently we have two dogs in use The One dog of this of these two, will retire probably late June early July somewhere in there, And then this other officer will already be back. 00:53:37,430 From training with a brand new canine. And, then as far as scope of service because I know that’s changed a lot over the last several years from narcotics to search and rescue to bringing down Perpetrators so can correct found on that a little bit, please. 00:54:02,100 So basically, our dogs that are what we get them trained on is their apprehension dogs so they can be used as a use of force. They also have some track in the building. When I say some tracking ability. Obviously, you look at like, please dogs for tracking the bloodhound. 00:54:31,330 Is by far superior that’s usually single purpose dog, and that’s what we talk about is dual purpose dogs, narcotics detection and tracking and apprehension. Thank you and commend those officers that work with those cannons and those canine officers as well. So Great program. Thank you we’ll do one last thing, Mr Chair. Just a reminder. Basically, I believe every one of our dogs has been purchased with donations from members of our community. Now. 00:54:55,930 We do Budget line item for maintenance of the dogs? Um, you know, food care, medical anything like that. But the actual purchases if I’m correct in my thinking we have purchased all of them with donated money. Greatly appreciate people donating for that purpose. Yes, exactly. Okay there any other questions, comments? Sitting on call the roll, please Comm. swab Comm.. 00:55:22,630 Munson? Yes. Comm. bacon? Yes Chair Bittner. Yes motion carries next Burley’s renovation project. Thank you, Mr chairman. This one is going to be a little bit more complicated and I’ll walk you through it. Hopefully we can Make it as simple as possible. And I forgot Comm. woodcocks was going to be gone tonight. 00:55:44,100 If you guys would like to table it. We did put it in as a request for action if you’d like to table it until he’s back. Um, I’m perfectly perfectly fine with that. Just basically want to get this information to you like Comm. 00:56:06,530 months and said it’s budget time, so we’re looking at different things and different scenarios. So to give you a little history and some of this will be, you know, pretty elementary, but bear with me. Um And. I hope I got my dates, right? I think they’re pretty good, basically. 00:56:31,130 1989 Burleigh County builds property at 2000 North 52nd for the highway department, the Highway department occupied that building up until 2014, at which time They went out to their new property off of 52nd and the Sheriff’s department took over all the property up at that compound for lack of a better term. 00:56:57,600 To the best of our knowledge since 1989 when that building was first occupied, we’re not aware of any major renovations that have taken place on the main existing building, which was the original Highway department and the shop area. In 2014. Our department took possession of their property and moved our patrol section. 00:57:22,200 Into the main shop that office building and in addition, at that time, we had hired a full time mechanic or close to that time and put him in a deputy assigned to our training section, which oversees all our vehicles and other equipment. We assign them up there to oversee and maintain all the equipment that was up there and also the property. Located in that complex. 00:57:47,270 One other point of interest is when the department when our department moved into that building We had acquired used furniture from North Dakota Association of counties as a cost savings measure so that we didn’t have to buy all new office furniture office furniture to move in there. Um, since 2014. Our department has relied mainly on budget dollars to maintain and update that property. Some of the examples of budgeted repairs include window replacements, fuel pump replacements, parking lot work. 00:58:15,530 Fuel, tank maintenance and gate and shop door replacement. In 2022 R Department requested and received DARPA funds in the amount of $324,312 for inside and outside repairs to what we refer to as Burley’s, like Comm. Bittner pointed out. 00:58:45,070 The inside repairs we identified in that request and completed where the replacement of the heating and cooling system, which was original replacement of three walk through doors. That had rusted out and the replacement of the pressure washer and venting system for the pressure washing machine. When. We came into that building. We stayed with the original pressure washer. Eventually that failed and we had to get a new one because we eliminate car washing. 00:59:11,570 Um through gas stations by having that pressure washer up there as a cost savings measure. The outside repairs that we identified and completed where the replacement of the roof over the administrative area of the building And repair to the damaged brick as a result of that failing rough, and basically what happened was the, um Comm. Bittner. 00:59:34,270 You’re going to know this better than me, but basically the roof cover membrane head shrunk over time, which is part of the life of it. Um, and as it shrunk, pulled on that brick wall. And actually damaged the brick that had to be replaced as part of that roof repair job. 00:59:59,100 One major repair that was deemed unnecessary and not completed was the repair of the or replacement of the roof over the shop area. Comm. Bittner played a role on that meeting with us and advising as we looked at that roof. Up there. 01:00:20,470 So what we learned is that when we replaced the heating and cooling system in the shop that the roof Or the heating and cooling system throughout the whole building the problems we were experiencing with moisture, which we thought was a failing of the shop roof actually turned out to be a caused by the heating and cooling so, basically now what’s going on in that building? We still have a little bit of a leakage. But. 01:00:43,930 It’s on the roof cap, which is caused by snow or moisture blowing in there and fallen straight down. Basically nothing. We determined that house to be fixed. And so we saved a lot of money by not doing anything to that shop Rough. 01:01:08,000 Due to the age of the building the gender makeup of our employees currently using the building damage caused in the administrative area by water leaks during the roof issues, The general wear and tear of the building over years and the fact that the building transition from a long term shop to a quasi office building With. No refresh or UPDATES. 01:01:28,570 We felt there was appropriate to come up with a plan to refresh the building. Determine approximate costs and identify potential funding sources to pay for the cost. So, one of the things we did do was we took Comm. woodcocks up there, and I was hoping he’d be here tonight to explain his tour of the building. 01:01:53,870 But basically Over time that building as you can imagine being used as a highway department had a lot of heavy use exhaust different things. Um, also when the heating system was failing in that building, there was a lot of dirt and debris that was generated by that. So. Basically, when you look go into that upper office area, you know we’re coming up on. I said roughly 1989. So. 01:02:18,030 You know we’re looking at 35 years from the start of the building. So if you start at the top of the rooms in that administrative office, we we’ve got tails that are damaged from the water leaks when, prior to that roof, getting fixed the lighting’s old the computer wiring that was put into the building isn’t 01:02:41,870 what we need. Today. Um The walls still have the original cover on them for all these years, which have gotten very dirty over the years, also the electricals original, and the flooring is original. And what we’d like to do to continue on is look at the bathroom. Refresh up there. 01:03:03,630 Um, currently we don’t have a room for our server. Obviously a lot of the equipment were running in the squad cars now requires a bigger server. So. One of the recommendations was to build a just a A small server room, which will protect that server and increase the life of it. 01:03:26,200 I think it cost us I want to say like $25,000 when we bought that, so definitely want to protect it as best we can, And. The. Other thing is that furniture is still Original to the building from when we moved in, so we’d be looking at new office furniture. In, the downstairs shop area. 01:03:49,200 Um, what we need to do is right now we have a makeshift female locker room and the original locker room when it was a highway department. Basically we have met with some builders, and they give us ideas on how we could build equal facilities for male and female in there that would provide them with lockers and a bathroom and a shower area that way, if they 01:04:12,270 encounter anything you know at work, they’d be able to come back. Change clothes change uniform. And go back to work. The other thing we’d be looking at his new lockers for the locker rooms and also a refresh of the mechanic office, which is down in the shop area where the highway Department had their mechanic based out of 01:04:34,600 Based on preliminary discussion with contractors and some of the estimates we received. We’re hopeful we could complete the project for less than $500,000 in discussion with the department staff and finance Director Jacobs Funding sources we have identified include the following, Um we would offered to rededicate the remaining RP funds originally dedicated for 01:05:03,970 the repair work up at Burleigh East. Originally. We received $324,312 142,000 to 72 remain from that fund. If we weren’t going to do this. This is money that originally before we looked at this project we were looking at just returning that money. 01:05:32,330 But now that we’ve identified this project, we just thought it’s an option to consider to help fund this. If. I’m correct And in my conversations with Lee. I believe that money has to be dedicated by 2024 the end of this year and spend by 2026. The. Other funds were looking at is to rededicate. 01:05:56,900 The remaining are but funds originally dedicated for PPE purchases for Burleigh County, If you remember back during the height of Covid? I came to you with a request for funding for personal protective equipment for all county employees. And. We would oversee that. 01:06:20,330 We have now reached the point with covid and with our supply build up that we have We feel comfortable that we’re not going to make any more purchases out of those funds so again out of the original $374,440. There remains a balance of 1 42 3 84. That can be Redick rededicated either to this or other potential uses. 01:06:52,870 Another amount of money in speaking with Lee, and also when I spoke to finance Director or whatever his title was Justin Shoals at the time, there is a local assistance and tribal consistency Fund of $100,000 that was given to Burleigh County. As part of The Post are by believe is probably the best way to describe it. But basically, there is $100,000 that hasn’t been spoken for, Um, in looking at the the Um, rules or requirements for that money. 01:07:22,200 Um, they do address public safety buildings to where you can make improvements on so that would be one of the potential sources for that. Ah, also and speaking to leave. There’s, according to his calculations, there’s 11,512 remaining of RP funds that have not been dedicated to any project. 01:07:49,200 So basically if the commission wishes that could be money that could also be dedicated to this project. So. When, you add up the potential the money that’s out there that potentially could be rededicated. 01:08:11,370 We’re still approximately about $80,000 short and that’s why I felt I needed to get this before the commission and kind of get some direction on what you’d like us to do. If this is something we’re going to consider doing. And obviously, we think it is a priority. 01:08:34,800 That building hasn’t been addressed in a long time, so this would be a good chance to move forward with that if the funding is available, so one of the options is I could either budget for that in our sheriff budget or next on the agenda? Lee is going to get up and speak to you about the old jail maintenance fund. And so basically a little Overview is ever since we’ve had the jail in the courthouse, there’s been a maintenance funding some shape or form. In speaking with Lee, there’s roughly about $1. 01:08:58,330 2 million in there that was still remaining. From the old jail in the courthouse since we moved to the new jail burly Morton detention center there separate funding that’s done by burly and Morton county that is putting money into a maintenance fund for that building. 01:09:21,800 So these going to explain that to you, there’s an option on you know, you’re gonna have to make some decisions. What you would like to see done with that money. Either way I just throw it out there that there’s a potential at that point, if you were looking to shore up this project with 80,000 of those dollars That’s basically what I have for you tonight. Um, Like. 01:09:44,670 I said I was I Yeah slipped my mind that Comm. woodcocks wouldn’t be here so again, however you want to proceed, but I just felt we needed at least start the discussion on what we want to do and how we go about doing that. Okay? Well, thank you, Sheriff. Commissioners. Your thoughts. You don’t Comm. 01:10:13,070 Winston, you know, with this being a pretty new subject, at least for me, Um and Comm. Woodcocks is not here. I wouldn’t mind tabling this till the next meeting to give some time to think about it. I’m not opposed to that. 01:10:32,270 Um, I think it’s a worthwhile project and, uh, you know, I’m like to hear from Lee to on some of the places we can address because there’s some funds out there that can Go towards this, but I would second table in this until Comm. woodcocks is here as well. Mr Swan. You went through so many funds there. Could we get this at the next meeting in writing. Um, do that exactly. 01:10:56,330 Information We’re getting Yes, we’re doing it would really appreciate it. I agree with table ing’s, though But I would like Perfect. Something new Look at here. I will do that, Okay? Okay. So is that emotion in a second? Okay. 01:11:16,070 Any further discussion? Um The only the only thing I want you to keep in mind is that it’s looking like based on conversations with the architects. That. We’re going to be needing additional funding for the provenance, rebuild or remodel up there. That’s going to exceed what we set aside for the for the artist stuff, So just keep that in mind moving forward, okay? A further discussion. Call the roll, please. Comm. Schwab. Yes, Mr. 01:11:36,370 Munson! Yes Comm. bacon Chair Bittner. Yes. Motion carries two table to the next. Thank you Sure. Okay finance director Jacobs County Jail Maintenance. Fun. Yeah, um early Morton kind of detention center, Bond Update and budget committees slash hearings sleeve Welcome Good evening chair and commissioners Following up. Uh, Sheriff Leven. 01:12:03,030 We We do have a county jail maintenance fund. Um, this is a fund that was, I Think funded with a some property taxes. Uh huh. And. It predates the existing jail. So, um, when we built the jail, one of the things we did is we we created a joint powers agreement with Morton. Morton County. 01:12:26,530 And, So we fund maintenance and capital improvements of the new jail. With $255,000 per year and Morton contributes 45,000 a year. And so what happened is that, um this fund had a couple million bucks in it when we signed, the new Joint Powers agreement and what we have been doing is rather than writing a check, so to speak for that, $255,000. 01:12:51,130 We’ve been just carving it out of this. You know Pool of cash. Which is fine. It has been fine and would be fine in the future, to be honest with you, but the concern that I have is right now we’re co mingling funds. 01:13:08,800 So we We’ve really got this special revenue fund where we’re sort of obligated to set aside this money and that is now sitting mixed in with this other cash. And so like concern is twofold. That You know, maybe I get hit by a bus or something like that. 01:13:28,630 And we all forget about this that we’ve got this money in the fund, and then it gets spent on the jail thinking perhaps that it is, you know, appropriately allocated for this new jail when in fact it, you know, predates the jail. So. I’m concerned that that might possibly happen. Um not that I got hit by a bus, but that maybe we would spend some money that we shouldn’t be spending on this jail. Um The. 01:13:47,300 Second concern I have is that perhaps we continue to fund it as we have been where we just carve out this quarter million and then it’s going to be a shock in the future. When you know, we we ran out of money, and now we’ve got to scramble and fined $250,000 in the budget, So. 01:14:04,200 I just present to you as you know, for your consideration that we Move this this cash out of this fund and basically what I would prefer to see is a fund that that only has the J P. A. Money in it. Um, that would just be easier. I think down the road. The. 01:14:24,770 Best solution would be to actually put this in a bank account and, you know, have Morton’s money in a bank account. And we just both have this joint account but that that would be a discussion for Morton County, too. Um And so I with Within the agenda. 01:14:44,270 Pack that I have, um, you know they’ll be fund balance in this fund. $2.9 million As of January. 1st and Best we can tell is our financial obligation under the joint powers agreement began in 2018. And. So we think that up to this point we, uh we contributed about 1,785,000 under the Joint Powers Agreement to this fund from which we spent. 01:15:11,530 A little bit of money about 95,000. And so what? Probably If. We were to separate out these funds. What would remain in this fund is about $1,689,000. Um Yeah, And, You know, as Sheriff Leoben said he She would probably look to this, You know pool of money for that additional $80,000. 01:15:37,070 And then the other thought that I had is, If this is something you think is worth considering. If. You wish we could also fund next year’s, You know obligation out of this, so that would be another 255,000 that we could probably just leave. In this fund so we don’t have to think about it at budget time. And. 01:15:55,970 Then as far as what becomes of if we did it if we did that we’d have a little under a million. Maybe 900,000 if we left 80,000 for Sheriff Lee been what becomes of that money is entirely your decision If you chose to do that. Okay. 01:16:14,200 So is that is that current fund sitting in some sort of an investment, or is it just it is it is, uh, We have some part. Part of it is invested part of it is in cash. Um, so there is a 1.1 Million I think is in a CD. 01:16:35,330 Yeah, right? Um, do you have any idea what the return on that investment is? At this point It’s about 5% right now that CD Okay, so that that’s not enough to cover that, 255,000? No, but we did We. We considered that that you know. In my mind what would be ideal? I? Don’t think Morton is actually writing a check to us, for example for $45,000. 01:17:07,330 It would be ideal in my world to have you know, both of us Write a check to a bank account and so that you know, both Morton and Burley’s cash sits in an account somewhere. Is invested and just accrues interest, and maybe that interest goes, you know, to To help both of us meet this. This. 01:17:27,900 Ongoing, um, obligation, but no right now that the amount we have invested current interest rates would not, you know, pay our Our yearly obligation. Hmm. The second question would be for the state’s attorney. If if that budget was put together with Property tax dollars. We move it. You know how we we You know, I’m asking. 01:17:57,630 I think I do and I need to look into that before I gave you an answer. I figured you would Please. So. We’ll have to look into that. See if we can See if we can even Do that we had that thought we had that same thought. 01:18:17,400 Believe it or not, And, uh, at a minimum, I think if it is allowable, I I’m not going to speak for the state’s attorney with just my understanding of fund accounting, would it would require a commission action to basically recommitted? That would be, I think at a minimum, we would have to do if it’s even allowable. 01:18:36,400 Well, I’m not going to consider an action to commit that money to anything else until we have that, Uh, until we have that opinion from the state’s attorney. So. We’ll keep that on the burner here. Second item is a detention center Bond update. When we spoke last. 01:18:58,930 I think it was in the middle of March at that point in time, we still owed a little bit of money on our portion of the bond. Since. Then we’ve We’ve received two months of sales tax and we’ve now essentially we have enough cash in the bank to to meet our obligation. Under the current escrow estimates so that could change. I mean interest rates and just the timing of when it’s invested. 01:19:24,530 That escrow number is going to change a little bit. Um, so we are sitting at got it in here somewhere. About About half a million or so ahead of of what we what we need to pay off the bond, and we’re in the same situation. Morton that we were last time Morten met on April 11th. 01:19:50,770 We are as we talked about before we are basically tied to Martin, and this is an all or nothing thing. The Bond is either defeated or it is not defeated and once it’s defeated. You know, Essentially, Morton would have no further obligation to pay on it. 01:20:12,070 It’s done but because of our timing differences, um you know, we’re we’re waiting on Morton essentially and they met April 11th. I watched the meeting and long story short as they voted not to Morton voted not to commit any money to And S Girl Fund and so were were were in the same situation. We were, um six weeks ago, Essentially Lovely. Comm. Munson Lee, When. You watch that beating. 01:20:39,270 Did They give a reason as to why they chose not to Move money from a Reserve account to the bond account to defeat it. One of the reasons that I recall was that they they But they understood from. I think the treasurer and the county auditor. 01:21:06,070 The Morton County auditor that they would have to forego some interest on some that they have the money. It’s invested and they were. They understood they would have to forgo some interest by transferring that over to the Bank of North Dakota was one of the same. How much $20,000. 01:21:27,600 That was one of the reasons there may have been more they would lose $20,000 in interest by moving money. Over. That that was there. Understanding. Okay. We have money invested in B. N D. So I, But. I don’t know what their situation was. I know we have money. We have investments in B and D. Um, but their rationale was that they would lose this 20,000 and interest. Hmm. 01:21:51,930 Did you have any conversation with bond counsel or anybody else about them extending past that November date? Are? They able to, um carried out even further. What Morton is doing, um, is they are expanding on their renovations. They had done some renovations to their courthouse. So. 01:22:19,670 The Bond is really a Jail bond to build a jail and also a renovation bond to renovate what was previously the jail So. We did the same thing. Um 90% of the sales tax has to go to the jail bond and 10% can be, you know, retained for this renovation, so, yes. 01:22:45,270 What they’re doing, Uh, Chair Bittner is they are they are extending their repayment because they are expanding on their renovation. And, so they’re going to continue to contribute 90% to the sales tax portion and the way I understand it is that once they are, their bond is paid off than 100% of their sales tax collections will go to this renovation. So I think up to this point, since he’s still have a renovation bond. 01:23:05,070 They have only been contributing 90%, so really nothing has changed from our timeline because they’ll still be contributing 90%. If that makes sense. But, but there they will continue to collect sales tax and Morton County, um, to pay off their expanded renovation. Okay that that makes sense. My. My question. 01:23:29,070 Really? Then is that drag us out past the November? Um Uh, defeats mint date. I think that would Right? I mean there. In theory if they didn’t have these other renovation bonds, and I suppose they would pay 100% on the bond, right? So. In a sense it’s It’s It’s extending the period where they are withholding this 10%. 01:23:54,800 So if they didn’t have their innovation, Bond 100% will go to the jail bond would be paid off sooner and so I. Think under the current, you know, Estimates, um It will be around November when we will have collected enough cash or when Morton will have and then we would have to give notice. 01:24:14,570 So we still have that 90 Day period, so we’re into Q one. Right. But if they’re adding to that bond, then that’s going to carry that. Pay off further into like next year or the way I understood. I think that’s right. Yeah if I can change Comm. Munson. So. 01:24:39,000 My understanding is if they once they have the jail bond paid In November. We can stop collecting at that point. They can still collect for the renovation Bond. And pay their renovation bond with their sales tax, but we could Stop. That was my understanding. That’s why I want to clarify that We’ll need clarification because that’s not my understanding. 01:25:00,370 My understanding is that they’re joined at the hip. I know that that the renovation bond is part of the Jail bond, and I understood this once the jail bond was paid. They could still collect for their renovation, but it would release us from the defeat. We can defeat the bond at the time they collected. Okay. 01:25:21,900 That’s that’s the question. I think it’s It’s yes, and both because it’s that’s clear. That’s it. It’s a 90% of the sales tax collection goes to the to the jail, No matter what. 10% is the maximum that they can that they can withhold to serve as this renovation bond. 01:25:42,530 And So I think that? Yes, they did some of this jail bond, I think did go to the renovation. I think I might be wrong, but they’re taking out additional bonds for a renovation. But 90% has to go to the city to the to the jail. Um At a minimum. My. 01:26:00,570 My concern would be as chair Bittner is asking. If they add on to their renovation bond is going to force us to keep collecting taxes until their renovation bond is done. My understanding is no. Get that it’s not going to do that. I would like clarification on that can. In fact we will do that? Tomorrow. 01:26:23,230 We are we will, uh We’ll speak with Band Council. Thank you. All, Right? I. Appreciate that and I’m just so the public is aware of the reason that we’re so concerned about that is because it is our goal to stop the sales tax. 01:26:43,930 When the when the funding is sufficient for the paying off of the bond, and unfortunately we have Met that already. So now what’s happening? In. The in the reason this is a concern is because we’re actually Because of this whole bond thing. We don’t have any choice, but we’re over collecting on the sales tax today, and it’s going to end up Candy and the mega millions. 01:27:06,400 Um, and nobody anticipated That sort of thing would happen, But. Um, I think the last I heard if if we were to pay it off at the end of November. We would probably have over collected by like, Say what 12.4 million or something along those lines. Yeah. This goes on. We’re collecting in the neighborhood. At a half cent. 01:27:29,270 Of roughly a million dollars a month, so our concern of it goes into 25 or anything else. Well. You can see it. You know it was 12.5 in November. December 13.5, and you know, it just keeps growing like that. And that is Something. We didn’t anticipate happening. But. The. 01:27:50,130 Good news about that is that that money will be used as intended for Burleigh County purposes, and it’s likely to result in an offset and a reduction in property taxes over some time. That’s Our. I think that’s our common understanding here? And. That’s where we’re at. 01:28:11,330 So Morton County is kinda Um, the hitch in the giddy up on this thing. So I think at this point. We’re really we’re taking this quarter by quarter, And. So now we’re into this next quarter, And, so we really can’t do anything until the end of June. Um, but we can revisit this. 01:28:33,270 You know at that time and CFR situation has changed, but it really is just a quarter by quarter thing. Once we get into the next quarter. We have to wait to To give notice. Unfortunately, You could All right. Um Budget Committee. We had we had a discussion. 01:29:03,800 And, um Ah, the question is, is whether We want to do the Budget Committee process again this year or do something a little different? Um, Commissioners. What are your thoughts on that? You know what I’m asking. Um Last year. I was that was too busy to really be involved in the in the budget committees, but I’m thinking that this year I probably will need to be Um And. 01:29:25,130 So what I was thinking as far as if we do the budget committee. I would suggest that it obviously would include me and one more Comm. auditor and probably assistant auditor, Brandy. Probably. It’s a at the discretion of the commission, and I believe last year it was the auditor, the deputy finance director, a Comm.. Um, and then maybe HR. I don’t know that. 01:29:49,370 That’s where I was headed with it. I was just curious about in your office. It was just my just myself. Okay. The deputy that would probably be sufficient. Um And then Obviously the HR director, because everything we do revolves around salaries and benefits and and whatnot. And then, of course, the finance director. 01:30:16,500 I didn’t leave anybody out, right? Okay, one or two commissioners and possibly another Comm.. If. Somebody wants to auditor. Finance, director and HR director. Yeah. I think that’s that’s my understanding from when we spoke. Okay? Do you think commissioners? Sounds like a good plan moving forward. Yeah, I was able to be part of that committee last year. 01:30:39,870 I felt it very actually, You recommended that I be part of that group as a rookie. Um, and it was it was definitely a learning experience, and I think we should do that Same process again. Okay? With us. Hell. I’ve gotta weed board to set up not Oh. You’re interested in Senator. Um, has a question. 01:31:05,570 Did you want one Comm. too? Um, it’s up to the commission. Really? I would kind of prefer having a second one would be beneficial to have to Volunteering. Are you volunteering me? Yeah, sure just volunteered. Thank you thank you for your volunteering spirit there Comm. bucket that, Okay, so that’s gonna be our committee. 01:31:30,330 Um There is some important Saying that has to get out as far as Budgets schedules, right? So. And And. If Lee doesn’t mind me, Uh Taking the reins a little bit on this, uh, in in Preparation for the possibility of the commission’s approval for the committee hearings. 01:31:56,930 I did go ahead and lock down the Tom Baker room for certain dates, just in case it did work out. We can we can unreserved them? That’s totally fine that wanderers or, um, just in case and so it would be June 18th, 19th, 20th and 21st. Some of those are for me to noon. 01:32:17,070 Two and then three of those in the 19th 20th and 21st are reserved from 8 to 5. And, then the 20th is reserved from 8 to 430. Okay, Could You send that out in an email. 01:32:31,870 I can sit out in the email form and if we need to adjust those dates or times we can certainly do so I just wanted to go ahead and reserve those days just that we had them. Reserved for our purposes Perfect. Thank you. Anything else? Nope. That’s all I have thank you appreciate it. Next item on the agenda. State’s attorney lawyer request to convert an attorney one position into an investigator position. Welcome, Julie. Thank you. Commissioners? Um I want to start out with? I talked to Comm. 01:33:00,970 woodcocks about this already. He’s my portfolio holder. He told me he wasn’t gonna be able to make it to this meeting, so I knew he was going to be gone, But. He indicated that was fine If. I presented this in his absence that he thought it was important enough that we needed to look at it right away. 01:33:14,870 Um, so as the commissioner’s No, we have a difficult time finding attorneys. We still have six open positions for attorneys within our office. One of the things that we have as an investigator who does help with a lot of the background work that we need done for our cases that’s with looking through files, making sure that we’ve 01:33:32,870 got everything we need, um, retrieving evidence if we need to get that from witnesses, Um, one of the big things that he did with our last homicide trial was make sure witnesses who didn’t have rides to the courthouse made it to the courthouse. Um Provide extra security. That’s one of the things we have them. 01:33:51,170 Do we have courts security in the courtroom, but sometimes they just need that little extra face in the crowd to know that there’s somebody there for them to. We had a lot of, um, Juvenile’s. In that case that had some special needs like that, and he filled that role really well. 01:34:10,200 And so with the things we’re having, our investigators do, he is swamped right now, and we can use another investigator to do those types of things. Um, what we have again we have our investigators do is what I’ve just said, but that it also includes conducting follow up investigations. 01:34:28,230 Um, sometimes when we get reports in from law enforcement agencies, there’s a little bit more that needs to be done that the investigators in the other agencies, particularly the Bismarck police department, may not have time to do so. Some of the little tweaking work that we need done, and so we send our investigator out to do that. Um, he actually prepares reports. 01:34:48,670 We will have him initiate investigations regarding like violation of court orders. If someone is violating A. Um, a court order while they’re in the detention center will have him do that, and also like failures to appear in court will have him initiate those and then he does a lot of helping us get ready for trial going through exhibits. 01:35:07,700 We need making sure we’ve again got everything and going out to get things that we need. So we do have a need for another investor. Gator and what my request is tonight is to have one of those already approved attorney positions that we can’t fill. Converted to an investigator position. 01:35:29,730 The attorneys are at, um, grade 14 I believe, and the investigator position is that grade seven. So actually, that’s accounted for in the budget and converting that position to an investigator. Position will actually lower the salary and benefits that are needed for that position. 01:35:45,730 Um, and so that’s why we are doing that, because that will help the attorneys that we have, and we do have a need for a second investigator. So. There are no questions. I’m requesting that that motion be made. Good commissioners. Any questions? Do. You. Have somebody in mind? No, we’ve We’ve mentioned the fact that we need others and we have had people. 01:36:08,800 I don’t think it will be hard to fill is what I’m trying to say. We have had people with a lot of great experience. Ask about that and when it will be available, what sort of qualifications Just so the qualifications are that they have to be eligible to be a licensed peace officer in the state of North Dakota and have at least five years of investigative experience. 01:36:30,600 Okay, So. Julian. What is your motion. My request would be that you make a motion to convert an attorney, one position to an investigator position within the state’s attorney’s office and allow us to fill that position. Moved. Second have emotion in a second and the third. Thank you any additional discussion. Seeing non call. Roll Comm. Bacon. 01:36:56,370 Yes Steve Schwab Wayne Munson Yes Chair Bittner. Yes, motion carries. Thank you very much question. Julie. Um, just where does that put you? Because? I know your office is a little strapped so Um, how does that man help manage some of the workload and some of the other spaces. 01:37:13,530 So one of the things that we’re having. Our investigator do now is we have a backlog of uncharged cases. And. So, some of those, um Less intense cases. He’s reviewing those to see if there’s enough there for charges, making sure it gets to the right person to get things charged out. 01:37:33,170 We do get reports in without affidavits when an officer investigates a report and thinks that there’s enough there for charges they’ll send up a charging affidavit with that that’s required to be filed with the court when we get those reports without those affidavits, that generally is a signal that the officer doesn’t think there’s enough there, so we’re having him review all instead of having an attorney review. 01:37:49,230 Those reports were having our investigator review those reports to see Maybe there’s more follow up that needs to be done or other witnesses. That need to be interviewed to see if that’s a viable charge. And. If not, then he’s letting us know that too. So you’re taking swamp, but this is going to help you. 01:38:05,230 Yes, and take some of that workload away from the attorneys. Thank you. Thank you. Thank you, Julie. Okay. Next items Comm. Munson, You’ve got a request for funding for Lewis and Clark development vote on that. We did Okay. Short term. Sorry. Try to keep up there. No, it happens all the time. Right. 01:38:32,330 So the first item on my on my agenda. My list today is the Lewis and Clark Regional Development Council. Um, we had them present last meeting regarding a our involvement within their group and be the amount of money that they had been requesting Burleigh County, too. That. Don’t eat, but participants sip eight. That’s the right word. 01:39:00,670 Um, I would like you guys to to reconsider this with only four of us at the table. I’d like to table this until the next meeting. That emotion. That’s a motion to table table. Motion in a second to table this till the next meeting any further discussion. I don’t think that’s necessary, but Gold. Roper’s Comm. Schwab. Yes. Comm. Munson? Yes Comm. Bacon Chair, Bittner. 01:39:33,200 Motion carries next item Missouri Valley Complex Committee request. So as the commissioner. I had reached out to The county Highway Department and asked markets for a little bit of assistance in laying out the Missouri Valley complex with their expertise and drawing roads and laying out different areas that could be used within the facility for Campground to 01:39:57,330 make sure we had everything lined out for the motocross to make sure we had The areas and parking areas for the, uh um Four H the extension the the Oval track but also delay out some area for, um Buck stop Junction is looking at adding a barn. For, some old fashioned barn dances. 01:40:22,930 We wanted to look at an area for Carnival and Midway wanted to try to make sure we had an area set aside for that. Um and also for the question center to make sure we had an area set aside for them, Marcus said. Let me know that. Uh um he was not allowed to Do. 01:40:44,270 You work at the complex so it brings it brought some questions up. So number one. If I’ve got a paved road out there If I need crack sealing and chips ceiling. Is that something that I can request from Burleigh County Highway department or is that something that the fairground or that the complex needs to hire privately we’ve got some gravel out there 01:41:02,870 needs on some of those roads. Is that something that I can request Highway Department assistance. Or is that something I need? To spend money privately and get a private contractor involved. 01:41:26,930 And so I’m bringing the request to you to help guide me in the direction that I need to go with the uses of the land and Uses of Burleigh County assets for Burleigh County property. Okay, I guess I can weigh in on that. Somewhat. Being a sour Had that portfolio years ago and and whatnot. Um First off the notion of changing roads and doing anything else. 01:41:50,470 You need to understand that that That entire facility is part of what’s called planned unit development, right? And so anything that goes on there as far as you know, Changing the light lines are changing the road locations and whatnot. 01:42:13,930 I would have to go through the process through the city Planning Commission, not County Planning Commission, which is interesting, but Um That that really has never been in the wheelhouse of the Highway department. Engineering. Okay. That’s That’s A, uh, generally will see you probably are aware you’ll see firms like Well. You know the firms and we don’t need to name him, but The That’s a specialty. Sure, I, don’t I don’t think I’ve ever seen Marcus and his crew be involved in something like that. Now. 01:42:36,930 We have utilized them in different fashions over the years. You know, with Sometimes. They have done some blading. Sometimes they have done some gravel in or sometimes they’ve done that. But often other times we’ve used private contractors to do that. And it and it really comes down to whether we burden Highway department was something that’s really not in their wheelhouse. 01:42:59,330 Um and then how we pay for it because in any time That. The Highway Department has worked on a park. Type of Project the park budgets have had pay. So. It’s not a question of getting it for free. 01:43:20,130 Um You know, so there’s a cost either way, but I know I had quite a few projects where we had private contractors provide quotes and bids essentially for doing those various things so So. One of the reasons we were looking at changing roads, and this is a Bismark development. The City is actually in our meeting. We cannot have an access to highway 10. 01:43:43,630 And currently that P U D has a road accesses highway 10. So the first thing I would like to do is obviously eliminate that from the map because again we are not going to gain access to highway tan from over zone coming on there. What do you mean? Um, that P U D granting that access was duly Approved at the city. 01:44:09,270 My Understanding is the Dottie has Now that we have access through Missouri or Midwest drive and that way that road is very Mhm is I understand that I know what the deal is, as far as you know, the distance from one road to another and all that kind of thing. Doesn’t change the fact that that is a Legal Document. It’s. It’s done. 01:44:33,370 It’s permanent and then the city can’t just up and say. No. I can’t because that would have to be changed because that’s an actually recorded Document. Correct, Correct so I don’t know who was telling you that you can’t have that driveway but that would take More than just somebody saying So, right? Right. 01:44:56,270 So that’s that’s the direction I was going with that part mostly To. Make sure that that land is being utilized the best for right now, all of the different thought process that we have out there if I need to put money in budget for 25 to hire a contractor, I needed to know that from this group 01:45:17,000 finding I will get roads are get bids for gravel hauling and I will get bids for crack sealing for the asphalt that we have out there, so I’m ready for 25. That’s The safest bet, Okay? You know what? Nonetheless, you know, Marcus felt a weighing in on that, but Comm. swab going away on that. 01:45:38,400 Number one. It has been a habit from previous commissioners to go up and have Marcus sign off on things. He was never involved in That happened when the water and the sewer Deal came up. He signed off. And. I think he’s still has nightmares about it. The problem I have with With people going up. To. 01:46:11,030 Ask Marcus for something. Is that that is taken advantage of him to have him have to sign things that he is not involved in. Just to get validity to a document. To me that staff abuse We’re using him. 01:46:34,730 He is being used and then if something happens well, that damn Marcus, he signed off on it. He should have known better and never had a thing to do with the job. However. Let’s Forget about that right now I’ll tell you I have some suggestions for you out there If you want to. You’re going to go out and you’re going to dig for that deal out of Driscoll at time capsule. 01:46:54,270 Do you understand that you cannot move any roads or do anything out there until you find all of them covered up manholes. Sure there is a bunch of them. I mean there’s a map available for that. The first thing you need to do is do that. And. 01:47:16,170 I don’t understand how you would one of the design roads in there. Without knowing where your utilities are gonna run, you can’t run water lines under the middle of the road. They’re either gonna freeze or have you got to break them? Got to bust up the road. The first thing recommendation is that place needs to be cleaned up, Pigpen. 01:47:36,500 And I’ll admit it and the thing about it is or the whole back there in the East side that I Mentioned last year. Full of ciders. Tire tubes, and they’re still there. Nobody authorized that guy to go out there and dig a hole and build the racetrack. 01:47:59,930 I couldn’t find it in any of the meeting minutes and yet You’re considering him or did we put him on as a stakeholder? Do? You want stakeholders out there? Just digging holes and stuff. Not really. I mean there’s there’s a process for developing this and I’m just As excited about developing. This is anybody else but You got to start with the basics. 01:48:24,930 And Going up and not even having a plan and saying Well, Marcus designer plane he actually doesn’t know what the hell you’re talking about, And he’s gonna get in the buying to be the fall guy, and I’m not gonna let that happen. That That’s me. Is very important because it doesn’t mean he can’t go up there. 01:48:46,900 Maybe this fall and stuff, but I would suggest anybody that that Doubts me go up through the yard up at the highway department. You’ll see the enormity of what we’ve got ahead of us this summer. In crushing rock. Hauling rock in We’re going to do highway 10. We. Gotta stockpilers. We’ve got vacations coming up. I don’t see how you can have The Highway department go up there. 01:49:14,070 And do a good job because they’re not going to be able to hang on to it and then slough it off to another contract that isn’t aware of the thinking behind it. It just Comm. once and it just isn’t gonna work. I I appreciate your far as the crack sealing stuff. Are. 01:49:32,470 We done crack sealing Yeah, we’re done practicing. I drove that road name. Wonder. Why? We didn’t seal it. Is that are owed. Yes, it’s our room. But. It’s It’s A observing a complex, so I don’t think that would be part of Marcus’s. Normal. Process. 01:49:55,730 You know something like that when they got tart kettle heart and stuff like that doesn’t take long to go through and I noticed. It’s gonna need some work. County Road. I don’t have a problem with that. I mean we got to get on the schedule, Correct because we are really swamped and we got vacations coming up to and I wouldn’t think this would be a 24. 01:50:13,930 This is a 25 or beyond, but it’s it’s all pieces and parts of the program that we need to start writing. To. Make sure we’re all on the same page. But. You know the thing about piling all these dirt’s up, and you weren’t you didn’t have that portfolio and all this stuff was happening. But it is such a miss out there. 01:50:31,470 It’s got to be cleaned up. And that would be Where I go first, and I would find the man holds. You hit a manhole You’ll find out how fast you can spend money if you busted him. So And as far as you know, you’re calling me I. Don’t Maybe. 01:50:55,500 My phone wasn’t working, but I didn’t get a call from you. I sent you an email. I didn’t say I didn’t call I told you my phone works. 24 7. Keep calling. I did not. I’m not in Seattle, so I don’t say. Well, you got email. I don’t check that. 01:51:14,130 Ah, I will call you the easiest way to get me is to call me I will do that. Okay. Call you what Yeah, That’s it. I’m getting them kind of calls to me on account of the road, so don’t even bring that up. Okay. All right. Thank you thank you for your help. Okay. Yep. We’re good, Okay? The. Next is me. 01:51:32,800 Um I had a couple of things put on the agenda here. One is e to stormwater drainage and the other is carbon capture utilization and storage Comma line update Um, the whole reason behind the E T. A stormwater drainage item was to provide that make sure that that information is provided to commissioners. That’s a little. 01:51:55,570 It’s. Well. The reason that Yeah, The public. You probably haven’t seen the list, but, um, I was having a conversation with one of the city commissioners and I was talking about how much work Burleigh County has had to do, Um, outside of the city in the city’s jurisdiction, so I wanted to make sure that when 01:52:15,530 you’re having these meetings at the City County Committee That that this starts to get talked about. Because, frankly, commissioners, we have spent boatloads. I mean large dollars in my Right, Marcus. I mean and a immense amount of money. That. We haven’t been able to recover. And and that’s in the past. 01:52:43,870 It’s been city actions in the extra territorial area, and they have the jurisdiction but they don’t have a responsibility. And quite frankly, I’m tired of that Burleigh County has all these road needs the stuff that we’re actually spending real money on. 01:53:04,730 And we just don’t need to be cleaning up after the incompetence of something going on in the city, and it’s a lot of money. You saw the list every one of those projects is is incredibly expensive. Um, So if you have any questions about those I want to thank Marcus and his staff for putting that list together. And will continue paying attention to that. 01:53:25,030 But the idea is so that we can start to get these folks to understand that if you have the jurisdiction, you need to have the responsibility. Because I also had a thought. And I mentioned this to Marcus and I’m not sure that this would be something that we would do, but you know we could go ahead and do a home Rule Charter ordinance. 01:53:43,670 It says that if any political subdivision Is going to Cause costs for Burleigh County that we’re going to go ahead and build your back. So I would like for you to think about that because I’m done. I’m done paying for, um Ah city of Bismarck mistakes out in the E T a. We spent way too much money. Thanks man. 01:54:10,330 I’ll! Get off! Get off that. No, I’ll! Get off that soapbox with that. Um, but it it really is a big issue. Um So. The next I put this carbon capture utilization and storage on here because I wanted to put out a little bit of information that I’ve Come to find out and then 01:54:29,770 I’ll talk a little bit about the pipeline afterwards. Actually Comm. before you okay. Christer Buck. Um is there a representative from Summit here? Anybody speaking for summit There’s not okay. 01:54:55,270 The reason I ask, and this goes back to summit taking place in the middle of April that leave Blank was speaking at the CEO of Summit carbon Solutions, and specifically, he was asked a question about community engagement. And he said. 01:55:17,130 Well, he’s not sure they’ve done it well and I’ll Skip down to the relevant part here, he says, and I quote we’ve met with every county commission supervisory meeting that we cross, which is 80 to 90 counties were expanding a little bit. So. The numbers changing so ultimately were at every one of those monthly meetings. Oh that that’s complete. I Yeah. I have an issue with that There has been nothing but a lack of transparency and lies through this entire process. 01:55:40,130 Just, I want to iterate that again? Um, so ultimately were every one of those monthly meetings and there’s no representation here from Summit. There’s not been representation to the best of my knowledge, any of our county meetings. 01:56:01,430 And I have issue with that, he says those types of engagements are necessary because ultimately politics or local and so you have to have an educational process on a granular basis to help all the stakeholders, including the landowner that you’re going to be working with. To understand what you’re trying to accomplish. My advice is start that early. As someone else mentioned. That’s maybe where we didn’t do a good job as we have, And. 01:56:20,200 He says that he thinks that they are doing an excellent job of it Today Once again There is no representation from Summit carbon solutions here at the moment. Um and I I don’t know how they’re doing a good job of that. But again, uh He also iterated Politics are local. Uh, we’ve got something being shoved down our throat by the state of North Dakota and I. 01:56:42,030 Don’t see the localism in that I don’t see what’s protecting our local landowners. In, our Burleigh County residents and I have a big front with the statements that Mr Blank has made and what is going on with the Public Service Commission as it’s supposed to be representing residents of the state of North Dakota, and 01:57:00,730 specifically in this case, Emmons and Burleigh County, So that is all I had, and I just wanted to make sure that there was not somebody from Summit carbon solutions here at this meeting. Okay. Well, let me pick you back on that before. 01:57:17,270 I kind of jump into what? I was going to talk about, Um, at the last Public Service Commission meeting. There was testimony by, I think as a guy by the name of John Schmidt. It was towards the end, and he said that they have met with every we’d board every county we’d board Um, along the pipeline path. 01:57:40,730 And of course, then that caused me to spend time I research the agenda. The Burleigh County. We’d board agendas and meeting minutes, going all the way back to the beginning of 2021. And I was almost late for a meeting because I was doing that. But Not one word, and I also talked to Comm.. 01:57:58,270 Schwab because that’s his portfolio, and he’s been attending all those meetings when there was wheat board. Of course. Now. We’re the wheat board, but, um not one word not one person was ever on the agenda or mentioned in the meeting minutes, although they gave testimony that They attend these wheat board meetings and by God, they’re going to control the weeds on this pipeline, So it’s you know, on 01:58:20,330 the same lines of testimony, and that’s why some certain members of that are under perjury investigations at the moment, so right and more of them should probably be involved in that little thing because, as I sat through every one of those stinking meetings, I heard things that I just simply no or not true. 01:58:39,930 I mean there, you know, just just from what I know, Anyway. I want to talk a little bit to get some information out to people that maybe Uh, I don’t know about the situation with easements and leases for poor space so that hopefully this informs public And although those Poor space leases are not happening in Burleigh County. 01:59:02,700 I thought it would be good for us to be able to get the information out. Um My family was presented with a possible lease well with a lease that we are apparently having to participate in Because the land around US, which is owned by the companies that are involved with the project. 01:59:26,600 Um they have sufficient ownership to where they meet the 60% threshold, So. Our land is automatically included in that based on state law. And. So while I was reading that easement one thing kind of caught my eye and well couples through a lot of things caught my eye about it, but one of them was Um and I come to 01:59:46,130 find out from the legal counsel for the company that this is a standard lease that apparently was started with Min Ko to power, So they’ve been kind of handing this lease off. And. One of the things is, uh One of the first things that caught my eye as they pay you. 02:00:07,600 They pay the amalgamation a certain fee, which ends up being a dollar 70 per ton in our Case this is up at Bulent, so it’s not the ones up around center. I understand they’re offering those guys 50 cents a ton, So, that’s you know, a whole different deal, but that’s just my understanding. 02:00:26,730 I question what if you as a landowner found a Better offer for that. Oh. Well, I guess because the state of North Dakota is forcing me into this lease against my desires. I guess so if somebody wanted to give you $20 a ton, you tough, tough. Well. 02:00:46,400 It’s not a dollar 70 a ton because the dollar 70 a ton goes to the amalgamation, which means all of the land in the unit. And. So then your payment that you get in your pocket. Is based on your percentage of land in that amalgamated units. So what That really boils down to is that my family we will make 2.5 cents per ton. And. So then I thought, well 2.5 cents per ton. Originally. 02:01:10,530 I thought the carbon sequestration pore space was basically like a sandbox down there where you could just pump this stuff down there into like sand. Well come to find out It’s a saline aquifer. So I don’t know if you know what that is, but that’s basically salt water, So. 02:01:28,730 I did some research on of all things to quote North Dakota Department of Mineral resources website. And they told me About all these minerals that are actually in that saline solution in that poor space. And so then I started looking into it. And When I realized I forgot my notes at home. I was in a hurry. Obviously, you know, I barely made it here on time. 02:01:48,800 But I forgot my notes, but One of the one of the key things that a friend of mine mentioned, he says. You should understand the value of salt. Because. This is a saline aquifer. So. I did a little research. I said. Well, how much salt is in seawater? You know? And well, that’s 32,000 parts per million. 02:02:10,330 That is seawater. So, a cubic mile mile by mile by a mile of seawater has approximately 100 and 20 million metric tons of salt. I thought, okay. So, according to the Department of mineral Resources, the saline Aquifer, the Broom Creek. Has between 133,000 parts per million. I go. Well, that’s a lot of salt. 02:02:38,170 And so I just picked the number of 64,000 parts per million because obviously, that’s double. What, the seawater is and understand that you know the broom Creek maybe anywhere from 200 Ft 500 or 700 ft. Thick depending on but a cubic mile. Of Saline Aquifer. The Broom Creek contains approximately 240 million metric tons of salt. 02:03:05,870 And so if you take and you want to pay me 2.5 cents per ton. To poke in, uh, C 02 into my my salt. I have an issue because the price of salt in Burleigh County I I asked Marcus and he provided me with the most recent Delivered price of road salt, which is probably the 02:03:27,670 most worthless salt you don’t put. You know that table tape. You. Don’t put table salt on the highways and byways, right? And so The price that delivered price for salt from Marcus was 108.37 $808 per ton. So if you take 240 million metric tons. Of salt in a cubic mile that ends up being 26 billion. 02:03:58,670 $10,720,000 worth of salt and just a cubic mile that stuff, But we want to go ahead and stick. Some of the 02 down there and And and then Oh. There’s also things like there’s also things like the light straw me. 02:04:17,930 Um, uh, silver and all these other I have a list of what the Department of mineral resources set in every one of those things. Has a substantial Value, like one of them might be $15 a pound. Now I’m not saying it’s economical to go down there and retrieve it. 02:04:37,700 But I really don’t think it’s a good idea to put on C 02 down into mineral space, and I can say that because not only are is my family, the surface owner. We also are the poor space owner and we’re also the mineral rights owners. So I’ve got some skin in this game. So then the next thing that I learned while reviewing that easement hope I’m not boring if folks but The. 02:04:57,600 Next thing I learned Is that in 2009. There was two different Senate bills that created changes in two different laws. And again since I forgot my notes, like one site, the actual law, But, I can tell you that one of them related specifically to pore space because at the time they were, they were debating on 02:05:18,270 whether the poor space was a surface. Title or a mineral title. And, so they decided that poor space is a surface title. Right. So the person that owns the surface owns the poor space. 02:05:43,870 Okay, So, um What happens at the end of the project, like say, in our case, they’re going to pump CEO to down there for about 12 years. And at the end of 12 years. They’ll let the Industrial Commission know that they’re done. And. I think they apply for a certificate of completion, so it starts a calendar than after this 10 year period. And. This is why it’s important for people to understand these easements. 02:06:03,700 But after this 10 year period. Title to the poor space and the storage. Substance, so it’s the storage facility and the storage stubs. Substance passes to the state of North Dakota. And it says exactly in the law without payment of any compensation. Repeat that without payment of any compensation, the poor space transfers to The State of North Dakota. Now. 02:06:35,670 That’s a direct violation of constitutional. Ladies and gentlemen, and I kid, you Not. So, Then I thought, Okay. Well, that’s pretty bad. Then I come to find out that another section of law that was passed at the same time. Says it’s illegal. To sever Poor space title from the surface title. 02:06:56,000 Any contract or anything that you sign or do is void. If, You try to sever Pore space title from the surface title. Okay follow me on that. So. What That tells me is since the poor space title transfers to the state of North Dakota. 02:07:14,830 Well, it tells me two things, but if the poor space title transfers to the state of North Dakota, and it’s illegal to sever The poor space title from the surface title. Then what must happen, it must drag the surface title along with it. 02:07:32,830 Because it’s you’re not allowed to sever them right? Either that or it makes the contract that started the whole thing null and void, So I don’t know how that’s gonna play out yet. But. That, in a nutshell. Is kind of what I wanted to run past the public for the significance of that carbon sequestration. Any questions on that. So, in essence, the It equates to an illegal taking by the state of private property. Correct. 02:07:53,670 In the end. You know the stunning part about it is it actually says in the law? Without payment of any compensation. Which you know that’s a that’s you know, eminent domain is used, and it requires just compensation, which, in this case, the state is requiring me to participate in an easement that somebody else decided. 02:08:17,630 What the value of that easement, or that rental payment was gonna be. I didn’t even have a chance to negotiate. We couldn’t say now will take five bucks or we’ll take 10 bucks or No, it was just get your land. Yeah. How do you like that, huh? And. 02:08:34,630 So you say all politics is local. It is And and I know Burleigh County is is certainly active in the Opposition to this pipeline that leads to the sequestration site. Um, another big concern that was pointed out. 02:09:05,370 Um, is that There’s an application coming up here shortly before the both the Industrial Commission and the Department of mineral resources concerning summits application for an injection site. And in there, I noticed, they put they’ve got a computer model that shows, um what’s going to happen with this pressure or this plume of some sort over? I? Think 20 years and you know they they’ve got these blacked out lines that show you okay? This is the project area. Their own application information. 02:09:27,630 Gentlemen shows all of that migrating outside of that area. Into land where they don’t have easements. They don’t have anything. But. It’s doing what they call moving up dip, and I have mentioned that word before. 02:09:46,400 And it’s just stunning to me that we could even be having a conversation where somebody can poke something in the ground over there, and it’s going to come over here under your chair and And we’re just supposed to be okay with that as citizens. And I. Just. Don’t think that’s right. Um Anyway, I should probably get off that subject. That’s probably enough of that one. But pipeline update Um, at the current time. 02:10:06,470 We are scheduled for what’s called a technical hearing because our attorneys were not able to attend the Ah, the most recent meeting public hearing at the PSC. And. There will not be opportunity for public comment. Um, at that meeting, but it will be I’m a chance for the attorneys to cross examine any other witnesses, um and whatnot. 02:10:32,630 And so just so everybody knows I have put together a list of some people, um, that we definitely want to have his witnesses and then I also put together a list of people. Um um, that had been threatened with imminent domain. 02:10:53,170 There was there was a time frame where some people were going around, and basically they were telling people Hey, you got to sign this because we’re going to do eminent domain anyway. So, if if anybody feels a burning desire To be on either the witness list or this, we’ll call it the threat list. Um, you know, I’m I would like to know about that. And. 02:11:12,230 So this is going out to the public. Anybody that has concerns or has been threatened or intimidated or Or, you know, like that have signed under what correct has been deemed false pretenses correct. 02:11:34,170 That’s that that would be more helpful to us that if you signed an easement, and you felt that it was under duress or under some sort of threat, and we definitely want to know about it. That. That pretty much gets me to the end of end of my thing. On that Unless You guys have any questions? Comm. swab. Yeah. Could you speak a little bit on the, uh On the What happens if there’s a winter brown out up here. 02:12:01,470 Do the people freeze in their house and they get the electricity to run their pumps. Okay, I can speak to that a little bit because you may or may not know that I sit on on a board with Capital Electric. 02:12:22,130 On, the member’s advisory committee and then I also recently I have been serving on the nominating committee for the border directors, and we just recently had a meeting and I asked that question. So, according to the manager of Of Capital Electric. The residential customer has priority. 02:12:51,170 They say that the industrial Customers will be the first ones that get cut in the event of a Brownout or a shortage of power and that’s based on policy. Um, And While I have no reason to doubt that, um, I can tell you that I reviewed reviewed so many studies and things on this, but There was a A third party verification on a Plume model study that was done based on that navigator pipeline that they canceled. 02:13:18,200 I’m pretty sure it was a navigator. But they said in there that The pressure in the pipeline dropping below 1200 P s. I is an operating condition to avoid. No. I’m I’m not a Um I’m Not? Sure yet. 02:13:42,470 What happens if you drop below that, 1200, see if it changes the volume, or if it does something magic with the pressures or what? But. You definitely do not want The pressure in the pipeline. To drop below 1200 PSE, which Begs the question. Then what if the power goes out? What is the you know what really is going to happen will change from the nature of is it? A Gas is a liquid Well. 02:14:06,270 It changes from super critical to a gas phase is what it’s going to do. I know there’s people here that can speak to that. Yeah Liquid. Okay, Power. You Re about water Hammer water Hammer That was just going to get to that. If, if if you have an incident where suddenly the power goes out like that. 02:14:22,270 That’s the whole reason gentleman that I own. I own four generators. You know, Two of them are at my son’s house now in tumor at my house because we have power outages in the wintertime, and I’m not going to sit there and freeze right? So we have these power outages. 02:14:40,670 And and if that Pump stations suddenly just locks up from a lack of power. I just can’t imagine what’s going to happen in the Up and down the line. Yeah, it’s that’s nice way to put it. Not good. So. Does that answer your Question question. Kind of long winded way to Yeah. Of course, of course, come to expect that. Um Ah! Anyway. 02:15:04,570 I think you would put together some information there Comm. swab and you wanted to share some of that with us If. You look at your I have kind of a A two page cover. Just For the purpose of when this originally started. Some it was going to be stored 10 million tons of carbon dioxide annually and that has gone up. 02:15:35,430 I. Think 1218 million thought so, guys, aren’t they talking 18,000,018 to 20? Incidentally, I learned those I don’t want I don’t mean to interrupt. But. Incidentally every there’s five Permits that I’m aware of that have have already been approved for carbon sequestration and some it would be the sixth but all five of them together. 02:15:57,870 Or less than what some it wants to plump in there, And based on this most recent dissertation that I read The problem is more the speed of injection. As. You’re as you’re injecting and they intend to inject very, very fast. These other guys are Or a small player. 02:16:18,230 But these guys are looking to pump an incredible amount in a hurry. Go ahead. Comm.. Schwab. Okay, I First off. I I think Burleigh County if the Public Search Public Service Commission and the governor and that whole crew up there. Watch. This is how you have an open meeting. 02:16:51,330 And I went and did some A I on The propaganda that we’ve had with his pipeline. We’ll go out a one here. Okay? And. Basically. I asked a I What is the carbon footprint. To bring a ton. Pump a ton of carbon From Iowa. Up to North Dakota. This says not include injection. Well, now, remember, this is a walk. 02:17:30,730 Hey, I offer Microsoft It came out to they will produce The, same amount of carbon 4% short of a ton. So, basically there They’re telling us how they’re going to do all of this. And you turn around and you look at the specs. Which by the way they would not give us give them to us. When. 02:17:57,100 They did appear here because it’s proprietary stuff They didn’t want us to know because they’re liars. And. I’ll say it, So. Just think about that. The Ponzi scheme We’ve got going here. One Ton to move a turn up here. They’re never gonna run out of product. And they’re going to make a ton of money. That’s the first thing You have to remember. 02:18:22,470 On this day I This was ideal conditions No up and down. No injection. Straight pipe. 2000. Miles didn’t take in friction from curves or anything. So. I’m guessing the rate at about Probably producing 1.25 tons would be My educated guess on it. Okay, Then. I went and I ran. What it costs would to the environment. Let’s see here. 02:18:56,970 What page is that? Just to manufacture The pipe. And Now. This includes mining getting it over to where they’re going to. To the foundry. Two manufactured. Just 2000 just doesn’t need me included the feeder lines. They are going to produce 92,000 tons. Of carbon And. 02:19:32,670 You want to keep that in mind because, as he’s told, keep coming, You’re going to find out. They can’t even clean up their own footprint. The next one. I believe it’s page 11. Two. Produced corny. Um ethanol. 100 gallons. There’s 1000 to £ 1000 of C 02. And around 5 to £ 800. That is indirect. 02:20:16,670 To that so you’re anywhere between if you want to be Nice to him, 15. 100, Johnny £ 300 of C O Q C. 02. For two. Batch out 100 gallons of ethanol. The thing about it is why is this important? The people. With the big money into these pipelines. 02:20:46,530 On the ethanol plants and found a product that they can pump through and get on the hind teeth of the government for the rest of their lives. That’s basically what it is perpetually. They don’t even have to Go out and get an environmental impact statement. It’s It’s crazy So we go to the next item. Let’s see here. By the way it was, I would like to say that. 02:21:17,670 The Public Service Commission. And them guys up at the Capitol had staff To check all this and did nothing but not their head. Yes. Not to us, but to Summit. You know you can I interrupt just a secondary. There’s two things that made me think, and I don’t want to forget him. 02:21:42,130 He wouldn’t mind because you you got Written down in front of you. Um, I, don’t for the life of me understand why we would give up the competitive advantage that we have here in North, Dakota, the North Dakota ethanol producers currently are pumping C 02 down underground. They’re permitted and they’re doing it locally locally locally. 02:22:08,800 Now that gives them a low carbon ethanol product. And. Supposedly there’s this marketplace for this low carbon ethanol that the Iowa guys want to get in on. But, North Dakota guys are already in on that. So. 02:22:30,700 Why in the world, which many of these ethanol plants also have the same geology to be able to Inject locally well, but they are behind on the research side, so they need North Dakota and the Environmental Energy and Research Center to supplant that. Investment, right. I can confirm that because I was reading testimony of a guy by the name of Ryan Clark down for the Iowa Utilities board, and he works in the Iowa Geology Department state Geologist area. 02:22:55,270 He mentioned who the state geologist was, but that was that was actually something that he was pointing out that Iowa has their own geology for carbon sequestration. No, I can’t imagine why you’d want to pipe that stuff. 02:23:20,400 2000, Miles if you have your own geology unless they just don’t want it in their own backyard, You know I’ve heard people say that Burleigh County doesn’t want that in their own backyard. They don’t they say nimby? Not, Nimby, not in my backyard and I’m saying Wait a minute. How about your backyard dinner, Iowa or Nebraska And what? What? What, you know, but anyway. The biggest point I wanted to make up. 02:23:40,070 I interrupted You there Comm. Schwab was that North Dakota ethanol producers currently have a competitive advantage over these guys in Iowa, and I can’t imagine why we would want to give up a competitive advantage for our Farmers and our ethanol plants here takes Go ahead, Comm.. Okay? This. Is on C 14 at the bottom. Okay. 02:24:07,330 Ah! I’m not going to go through it. I’m just gonna Kind of give it to you. The. Next thing coming with this. It is. What is Creating harm to the atmosphere. Is of all things, water vapor. So evidently, we’re going to have to start sequestering rain. This is actually this stuff that came up from these brilliant people. 02:24:39,670 This is the green new deal. That this work thing spit out, Probably not going to spit it out for long, but Be aware of that. Because They’re coming after your ring. Okay, Next one. Fuel efficiency on cars. Uh, I believe water vapor carbon dioxide. And The thing about that is 15% h 20. 02:25:25,930 Is approximately The percentage of water vapor in exhaust. 20% of C 02. And I wondered why in the heck If you burn a gallon of gasoline that weighs maybe about £ 8. You create £ 20 of carbon It’s because they include all of this stuff. Including water vapor, which is heavy. In order to Up. The tonnage. So Carbon monoxide. 02:26:01,670 Unburned hydrocarbons, nitrogen oxide. And soot. Is 65%. Of. What is coming out of the exhaust so you might want to be aware of that. Kind of like that Ai guy. I wonder who he is. Nitrogen. Makes up 78% of the vehicle exhaust. And it’s not harmful. It’s plant food. And. 02:26:39,630 Of course The numbers change a little bit when you go to the C I, but 21%, but just let you know that When. They figure the tonnage. We’re going to save 10 tons here Ton there. There, including all of this other stuff and building it up because you get paid pump water. I. 02:27:01,130 Guess and all the other stuff now. The other thing is I checked out the depth of aquifer IRS, and they’re gonna have to be e mail guys. Let’s see here. And behavior, but anyway, the amount of carbon In a nutshell. And. It’s It’s a long, long deal, and you guys put put you through it. 02:27:35,530 I can explain it. I asked a I If. You took liquid carbon And put it in a cube 3 ft. Q one square yard And. If you line this thing up. From Bismarck. How far East. Would it go? And that’s one year at 10. Ton. You would cross the Minnesota line a little ways. 02:28:06,070 That’s the magnitude of what they’re doing. So that tells me that when they get done, Cold Creek might as well hang it up. They’re not going to have a place to get rid of their stuff, just like you said, You know they got their scrubbers. But. 02:28:25,670 Imagine if these guys Have 10 years of that picture that interstate with a 3 ft. Cube all the way down. They look over the whole interstate. Both sides. That is what we’re talking about now. I mean, seriously? What can go wrong with that. This status is available. 02:28:48,100 I’m gonna I don’t know We can put it on the website or not, or it’s right to do it. I. Don’t see why not another thing I want to bring up by the way is if you go on the Internet type in dead Sea of Texas. Where they injected saltwater. At a lower pressure. And you can see the plumes. 02:29:10,700 There’s a CBS did a news story and it’s about eight minutes 37 seconds. And. The Fix on that is put a fence around it. And. It has a lake. It’s bigger. Move the fence. But no trespassing. Coming to the people up there in Mercer County, but the problem with Mercer County is Liquefy IRS. Feed the river. It isn’t the river feeds the aquifer fires. If. That thing breaks loose. 02:29:37,800 We’ll have pollution from here all the way down in the Gulf of Mexico. Believe me Well there. There’s kind of some science behind that Comm. to that one of the things that happens when you mix C 02 in with water. You know it. Also with saltwater, Um, is that it creates carbonic acid. 02:29:58,730 Yes, one of the geologists that’s in the room here, pointed out to me after one of our recent meetings that in the area where they’re doing this injection, there’s a substantial number of what they call Legacy Wells. So. These are old Wells. 02:30:16,630 They have old cement casings and who knows if they’ve been properly plugged or not, you know, according to today’s standards, Maybe they were. Maybe. They weren’t because back in those days nobody was checking. So Carbonic acid while it’s a weak acid, what it really is good at dissolving is guess what limestone Which! What do you suppose is made out of limestone cement concrete so that that Really raises some questions to me on a common 02:30:42,570 sense level, You know, just this aside on that because you mentioned the rate of injection and There’s an interesting study on the Colorado geologic. Um, survey and the reason I was aware of it. 02:31:03,400 I was I used to work in the oil companies that was experimenting with some salt water injections and what they found when they overdid the rate. And the pressure of the injection when they were experimenting with injection wells for salt water disposal was they were creating earthquakes and So Threw up a bunch of flags with the State Geological society and they went well, What’s going on here. 02:31:24,530 Um, and then the whole company said, Well, that was us and they’re like, Hey, can you replicate that We want to study earthquakes? Anytime you’re injecting at a higher rate because you mentioned the other permits that are out there and at a higher rate, higher quality, higher, higher quantity, higher pressure. There’s a lot of unknowns that are out there right now, and none of this is vetted. 02:31:45,430 None of this is that it? Well, what I want to know is who is gonna pay me for the incredible valuable of the minerals that they’re just going to move because they’re basing this on permeability and porosity. 02:32:02,530 And so you put two down here and it’s going to do a couple of things that will either go into solution with the saltwater solution, you know, salt water, or it will displace the salt and the other minerals. And so I want to know who’s going to compensate me for the incredible value that they’re putting down there for 2.5 cents a time. It’s just ridiculous. 02:32:21,730 I want to know who’s going to compensate? And if it’s even possible to compensate, somebody loses. Cattle or their family and stuff. Do one of these breaks in this pipeline. You know? This deal down in Texas is very Interesting because You can bet Summit carbon solution probably isn’t going to own this pipeline very long. They’re going to sell it. 02:32:45,670 And they’re they’re going to sell it and sell it and sell it and pretty soon They’re going to get to that one Last Buyer who goes bankrupt and guess who’s stuck with this thing, and I haven’t seen North Dakota. Defender position or even come down and say, Well, you know somebody gets hurt, working to help. 02:33:02,900 I mean, I guess we gotta call China because China’s got 14% of this thing. Hmm. Maybe. They’ll send the plane over something to help. But I wouldn’t count on it. Well. You know, I was a lot of lot of things here that are They don’t look good. 02:33:25,500 I was I was just reading something today that somebody sent that talked about that sulfur Louisiana break that you’ve probably all heard about lately. I guess it sounds like it took an hour and a half for some county or some company men to show up there to try to do something about that leak. 02:33:42,970 So, you know, they tell us they’re going to have some folks out here, you know, staff out here someplace or another, and we don’t know where they’re going to be, but they’ll be out here someplace so, you know, rest assured that maybe they’ll they’ll Be there in an hour, two or three years, something Um, that’s really kind of the main information that I wanted 02:34:00,130 to get out. I’d like for us to continue having those sort of conversational. Yes. Um, I do want to make it, um, pretty much an open mic for people in the audience that that maybe you wanna put in some input on this thing. Um You know you guys are welcome. This. The whole. 02:34:21,330 Yeah, Yeah the whole point here in doing this was to share information. So You give your name for the record, even though I know who you are. Curt Walth John found this very enlightening and and pretty entertaining at the same time. Uh, you’re using AI. 02:34:42,100 You’re way ahead of myself and a lot of folks, But all I need is the scientists that can Say, Yeah, that’s right. But the last one Said. I think your little by 50%. That’s him. That’s him. You I, and I. Think you’re right. So Ah, boy. 02:35:03,130 There’s there’s so much to unpack and everything you all said, but I want to go back to chair Bittner here on some of his first comments. So what it looks like. Is that the entire amalgamation area Based on 2009 Legislature legislate legislative wisdom that at the end of the So they get their certificate of completion. And, then 10. Years Later the whole amalgamation pore space area liability perpetually goes to the state of North Dakota. Basically all of us. 02:35:31,370 So are you saying then that the surface that’s tied to that amalgamation pore space and its entirety goes to the state of North Dakota. So, every surface owner that signed an easement for the sport space will lose their surface. That’s the way it looks to me, Kurt. That’s. 02:35:46,900 That’s the way it appears, because the law says you can’t sever the too so If You know either the law is the law or the law is not the law, but I think the law is law. So. It says you can’t sever pore space from the surface title and I think you’re incorrect, And. 02:36:04,470 One thing is whether you sign the easement or not, It’s not just those that signed the easement if you don’t sign the easement. You still fall into that amalgamation as long as they’ve got the 60%, right, and I do in my case, that’s that’s right boy that Uh, How many Signed easements how many surface owners and the amalgamation area Have any clue of that, because that is 02:36:27,470 absolute. Theft. Hmm. That’s pure horseshit. I mean that is, uh, that is absolute stealing. I couldn’t believe it. Curt Walth You know what we have the outhouse and the roll of toilet paper. That’s what we’re left with. 02:36:52,200 You know if that so, um You know I come from a farming background and Pierce County and I know what land meant to my grandparents? And I did get to use the outhouse to once in a while, even though they had running water, But That I think Folks need to really That have signed these easements in the amalgamation Eri for poor space that needs to get vetted out, 02:37:11,630 and they need to go to their legis Legislature. The Their representatives and that needs to get sorted out. Pretty damn quick. That’s number one Absolutely. Number two. I think the reason that some. It’s not attending your weed board meetings is because they’re probably attending the We Cannabis Board meetings, So. 02:37:36,170 I’m thinking it’s just a different wheat board probably got a little confused. So. Maybe you want to check and see if maybe they’re attending those? And. I’m Sorry. But after 18 months of watching everything that I’ve watched, and All these public. I mean, I’m Coming from a pipeline background. Never ever happened. Ever Talk eminent domain. 02:37:58,600 Um Gosh having more engineers and we had lawyers building every asset we’ve ever built, sitting watching this Ah, endeavor probably involved more lawyers than engineers. Um, there’s so many things wrong with this and leave blank. Um, talking to you know, talk is cheap. 02:38:17,730 I mean there’s been so much I mean it’s actions and words that really means something and that’s what’s been missing. I don’t know how they backpedal. Um you talk about the ethanol. Okay, so one ethanol plant going into this The others don’t need the pipeline. The coal industry I predicted many months ago will distance themselves from it, which they started doing now they don’t need the pipeline. 02:38:36,070 But because of this whole moving of Ethanol plants now up to 57 1 56 1 57th 1 from North Dakota. And this the whole garbage dump thing in North Dakota. We did all of a sudden the oil industry had to come into play here to save the day. And so the friends of age and energy came about. 02:38:55,730 Because North Dakotans weren’t buying that We’re just going to store I Will, Nebraska, South Dakota’s garbage up here. So. They had to come up with a reason to show North Dakotans. How valuable valuable. Invaluable. This is so watch What comes at the Williston Basin Petroleum conference coming up here. In a week next week. 02:39:16,000 It’s basically going to be a carbon conference, and it’s going to show us that this is absolutely needed because of the oil industry now. And. You’ve got Bruce rat setter from Iowa. Who’s going to tell you how We need this to save The egg industry. Corn. Well. North Dakota doesn’t really need it because we’re talking one ethanol plant. 02:39:38,970 But he will get 55 cents to a dollar a gallon when that C 02 starts coming off his stack. I don’t know how he’s going to share that with the corn drawers. I’m sure the guys really generous snicker snicker, but I just This is what it’s all about. 02:39:55,670 So now the oil industry is saying we need this. They came in to save the day. Well, if you Go on, Um I want to say it was April? Whatever, the Legislative Council energy development and transmission. It was Middle of April. Um, that all day went from nine in the morning until about 330. 02:40:21,800 Um Jeff Jennings and I attended late and spoken about three o’clock 310. But. I watched it all day and then I went up there, Um Lynn Helms. I’ve had a lot of respect for, um, he spoke and he talked about What. The oil industry Has they don’t know what the secret sauce is. 02:40:43,700 So whatever is said next week, they may need more C 02 than were being produced from coal plants and we’re building about $4 billion worth of new natural gas fired generation in the state, and it’s going to be a lot more by the time the oil industry needs C 02 for enhanced oil recovery, but they still don’t know how much and when they’re saying, maybe 10 02:40:59,670 to 12 years, so there’s four test projects going on right now. Two of them aren’t even using Seo to recycling of wellhead gas with water slugs. One of them is using all surfactants. Two of them are using some combination of C, 02 and other it’s all proprietary. 02:41:18,870 So then just last week if you watch the Bismarck Tribune The D o e awarded the E R C $11.6 Million to study the use of C 02 and enhanced oil recovery. In the Shales. So. I mean, maybe we’re gonna need it. But you know what? I might need a heart transplant. 02:41:39,300 But that doesn’t mean I’m gonna go out and put one on ice here, you know that I might need in 10 years. I mean unless any of you are willing to donate, I guess I might reconsider, but but, you know, I’m just I’m just telling you that the We’re being sold something that is resulting in the greatest transfer of wealth. 02:42:01,530 From an already bankrupt national debt country. To, a group of investors and individuals, a lot of them foreigners. Um, this country can’t afford it. We are in dire streets. Economically, and we’re just transferring wealth. From, the state the federal government taxpayers over to pay for something that we absolutely don’t need. We don’t need the hydrogen economy. 02:42:27,770 We don’t need green anhydrous ammonia. We don’t need Ah! See, See see us. We need none of it and there’s there’s more sustainable jet fuel. We need that? No. We don’t need that. 02:42:49,000 Everything is going just fine and all of the The C 02 and the carbon footprint that’s being created on everything I just said practically over over does any of the savings ethanol creates a greater footprint than any benefit that it gives Do. You agree with this? That. It’s going to take a Ton. It’s one turn Footprint print one ton up here. I mean we have no doubt that that’s right. It’s going to take more than that. When. 02:43:09,270 I look at the full life cycle of building a pipeline and operating a pipeline and all of the energy that’s going to be used and Yeah either they’re gonna have backup generation all the pump stations because if they don’t I don’t believe that their power is going to get cut before ours. Capital Electric interrupt And can I interrupted. 02:43:27,970 I forgot to mention that everybody knows that your capital electric bill is based on what you pay is based on certain peak use times. Right there there. Your. Rates are basically set by one or two different times during the day. So. Anything that comes along and consumes the amount of what did they testified. 2020 megawatts a year. 02:43:53,130 Um, yeah, I think it’s 20 or 28. Megawatts hours. Anything that comes along and increases the electricity consumption at those times a day is automatically going to increase our electric rates. Here in Burleigh County guaranteed they’re already going up. Well. 02:44:16,570 Yes, month We’ll get another 8% That’ll be 23% in two years and I’ve been writing emails to capital Electric, Brian. You know this and kind of raising a bit of a stink about it And. I’ve been told that we there wholesalers tell them that they can probably expect increases may have 25 and 26. That. 02:44:33,970 They won’t specifically come right out and agree with me that it’s due to the FX Solutions outlets power thing that went on in Williston, but I did bring that up at the Legislative Council in front of all those legislators. And they said. We’re gonna need to look into that. And. The guy from Williston, Um, remember his name, but the representative from Williston said. 02:44:50,670 It is a problem and we do have an issue with that, and our rates are going up and and M d. You filed a complaint with FERC. Now we’ve got, um all these other things coming online that are all very power intensive and one of the things they testified, one of their expert testified on the 22nd was what we’re going to be using $14 02:45:07,870 million worth of power. That was one of the benefits they were. We’re gonna using 14. There’s another $14 million worth of power up here that we’re going to be buying. You know it’s all we’re gonna be buying groceries and homes and things like that. That’s something we don’t have. 02:45:22,900 We don’t have 14 million more dollars worth of power to give you guys right now, and we keep putting the cart before the horse when it comes to hooking up all this huge load Now, you’ve got the Heartland hub hydrogen wanting. I mean they’re gonna electrolysis eyes water. 02:45:39,330 People need to be thinking about how much water this is going to take for all these things to do you think You know, I honestly believe that we’ve done a better job. And. I’m kind of proud of this commission. We’ve Not educated and we’re all beat the people, you know and have 300,000 to go out there and give them propaganda. But. Do. 02:46:01,330 You really believe that if And I had thought about this. If. I’m going to go out and invest right now, and these guys get this. Thinking gone. The best and best investment would be horses, trees and bicycles and spirit terrorists for him. Because. They’re going to ruin everything. I don’t believe Cold Creek can survive if they feel that thing up. But. Here’s. 02:46:24,730 Here’s What instead of first of all, none of the CEO to stuff or water vapor stuff has anything to do with the climate change when whenever you hear Then talk about the atmosphere. The atmosphere has five levels. We are in the troposphere. Then. We have the stratosphere. Then. We have the mesosphere Then. 02:46:45,500 We have the thermos fear Then we have the Uh, Experts fear So where the ozone IA’s is in the stratosphere. Okay There are light gasses that are lighter than air that do come from Earth naturally in ponds, lakes, anything that decomposes an anaerobic condition. 02:47:09,700 Those gasses do go up to the ozone layer and when they mix with old three, which is own ozone, guess what they produce. Water vapor and C 02 and you know that’s the atmosphere we’re talking about. But. I can answer your question. On why These people are doing this. It makes no sense. When. You really start looking at the the scientific stuff. 02:47:31,200 There isn’t a part of Goal at the end of the rainbow, but there is At the end of a carbon pipeline. And. That’s all they’re after It is all they’re after. But. You know what the it is a science project. A. Lot of good engineers A lot of good industry. 02:47:50,130 People did research on it for a number of years 50,000 plus tons of day injection rates never before done. Red Trail and Blue Flint. I think are 505 100 Ton a day we’re talking 50,000 tons a day. Okay. So it’s I. Don’t care what they tell you at the Mineral Department. 02:48:09,130 It’s It’s really turning out to be, it’s going to end up being like the Titanic. You know, I hope they don’t say that. Not even God can sinker because that was their doom. So. It’s It’s A. This thing is This. This thing has so many potential unintended consequences. 02:48:31,200 The list is really long, but I want to say one more thing, and then I’ll let someone else have the micro quick. Um I. Hope I don’t lose my train of thought here. Ah! Anyway, you were gonna say something else. Maybe I’ll think of it. I was gonna say to phrase it properly. This is going to be our sure honorable That’s all over, it potentially could be really will be. 02:48:54,730 I honestly believe that because These people. I don’t give a rest. But TUI what happens up here? It’s happening up here because of population density or lack of correct And. I. 02:49:16,230 Don’t see anybody from Britain or from China and stuff going to move up here and buy some land along that pipeline, But someone said, Well, it’s going to increase property values, are you? You got to be kidding. Property belts. See, talk is cheap. Well, and then you have your insurance companies. There’s a couple of them. I’m not going to name him because I haven’t had enough research on it. That will probably not ensure houses. But. They’re in on it. And. 02:49:32,530 You sit there and you see When people Finally admit enough is enough. When does the billionaire that’s worth $50 billion. Why. Would he need another? And screw people over. Well, you are right, correct about one thing. The investors, the stakeholders, all the executives, none of them are gonna live anywhere. Close. 02:49:57,400 To A C 02 pipeline, especially a 24 inch pipeline that’s equivalent to 15.68 inch pipelines. So on April 22nd 1 of the guys that spoke for Summit came from Southeast, North Dakota representative Mike, Let’s go Brandon Burger. I Call him and he, he said, Uh They asked him Well. 02:50:17,970 How far do you from the pipeline as he gave his whole Didi about why he’s for it and how the corn growers needed and the ethanol industry needed in the whole hoorah. You know I wanted to get up and, you know, start doing a happy dance because it’s going to be so great. And then they said, Well, How far are you from the pipeline, which is not a 24 inch pipeline. 02:50:31,800 I think it’s maybe an 80 inch Oh I’m 30 miles away, and the whole crowd just kind of groaned. So. I mean, this is this is the thing that is Very problematic is the people that are for this? I’ll have a financial stake or monetary gain from it. 02:50:51,370 So insofar as the environment if you’re for this, because it’s going to help the environment. You are attending the wheat board. Cannabis Weed board meetings, so Um one thing I want to say before I go I want to know what the Burleigh County commissions position is on what the PSC did because we have A corridor, citing permit And. 02:51:13,200 Once I get that Then I get a rope permit. But for some reason, they got gel together. And, isn’t it? The corridor Part of this That the State statue does not allow them to supersede county ordinances. But once that’s established And they’re trying to get the route permit. 02:51:39,130 Then you can’t supersede on the right that that is barely counties position, and we argued that And. The. PSC has determined that They didn’t agree with our argument, however, that will be part probably part of the likely appeal because you know the law is The Law’s the law and you know, I wanted to assist. It’s one of the best in the county. Are. 02:51:58,030 You all committed to seeing that through to make that an issue because we were done. Absolutely. Yes. Absolutely. Absolutely. Yeah, Yeah. Mr Botkin one of the questions to and Kurt Oh, but and you know how the processing works. One of the concerns I’ve got as well as there is someone keeps adding on customers to their project and When. 02:52:26,100 The Public Service Commission permits at a certain level. So there because it So many PSE. Yeah. So The pipe currently is 24 inches at approximately three. Maximum pressure 21 ps 2100 P s. I With. All these customers they’re adding on Is there anything that precludes the PSC or summit from going and requesting. 02:52:53,330 It’s like, well, that 24 inch pipe is going to serve our customer base. We want a 60 inch pipe or an 80 inch pipe or 230 inch pipes right once it’s through. 02:53:14,170 The gloves come off in the rules can change it anytime that’s correct, got some serious concerns about that aspect of as well because what there are requesting for a permit right now isn’t something they’re going to be held to. That’s correct They can loop what we do in the pipeline industries when we want to add capacity. We look pipes. So, meaning instead of just we don’t abandon a 24 inch pipe and put in a 42 inch. We. 02:53:31,230 Just put another 24 inch right alongside it, and they’re connected and essentially, they flow together. Yeah, they flow 48 inches, Although you know you have crossovers in them. They run the parallel to each other, Um, from the point where you need the capacity to You deliver it. So. 02:53:50,470 Ah, once they get the quarter, which is why I thought you know the quarter was like paramount here and and that we as a county in the U s the county commission. Writing that ordinance approving that after planning and zoning, um That they would have to get their corridor so once they got the corridor, then you know you can have, you know, fighting number 02:54:11,870 234 whatever and it becomes You as a county commission can’t Supersede. Anything that goes on in that quarter, which, by the way, did you happen to catch in April 22nd that Jimmy Powell. Their C 00 was so gracious and saying they’ve reduced the corridor with 2 200 ft. 02:54:32,130 Did You happen to catch that 300 with 100 ft variants? Yeah, thought, same difference. 300 ft difference. And then, um There was one of their is no transparency here. I mean That was something that was really Ah! That was another thing that was sort of shocking. 02:54:57,430 Um, but but I I really I’m glad to hear that You guys are going to stay the course on behalf of us in the county. Um I know Emmons County is going to do the same thing. Morton County I think they’re attending the wheat board cannabis meetings too, because I don’t know where they’re at in this whole thing, but not not to be critical, But. Yep. Yeah. 02:55:14,800 I’m critical because I’m wondering where Morton County has been in this whole thing, because this is his detrimental to Morton County and Mandarin citizens as all of us. So. Um, you know, I just I saw and heard so many things on April 22nd that we’re Really quite disturbing and Comm.. 02:55:34,600 Bittner was there the whole time because I saw in the sky in the camera the whole time, So. I’m glad I wasn’t there. I had trouble sitting still, but thank you guys, for everything you’re doing, and and our attorney she left. She got tired of listening to this, I. Guess so but anyway, I really appreciate everything you’re doing. So thank you. All. Right. Thank you. 02:55:55,100 Curse you then At some point I don’t need it. I got into copy Next one here too. So. All right. Anybody else feel free your copy. Good evening Chair commissioner’s claim feeling, um I live right up my words crossing and, uh You know it’s It’s kind of upsetting to me. One of the things the PSC did. 02:56:23,700 To this board sitting right here. It is. They basically, don’t acknowledge or supersede. They don’t want to be under burly counties zoning or or consider the weight of the zoning. Up where I live. 02:56:46,730 I, I’m told by Burleigh County zoning How big of an outbuilding I can have and In fact, a few years ago when I put in addition on the shop, it got reduced. And so I live in a delicate area and I’m supposed to think of my neighbors and all the speech I got, I think at the time. Um Burleigh County maybe didn’t even have a building department. 02:57:06,600 We used to fall under the city for a while. And. I could get into the eat a thing. I have a lot of negative comments I could make about the whole EPA thing. But. I look at this and I think of zoning. And something this industrial in nature. Coming past a state park. There’s a big state refuge up there. 02:57:29,870 Hell, we can’t shoot a gun. Where I live next to this, Uh, State Land, the double ditch Indian. Uh Recreation area or historical site. There’s housing developments all along the river. There’s people out on the sandbars. I can look for the pipeline is going to cross. 02:58:03,500 There’s a sandbar, where almost every weekend there’s about 34 pontoons congregated up there so heavily heavily, uh Populated area and Burleigh County doesn’t have any zoning authority when they when they moved it. Uh did they didn’t move it there, and that’s definitely a critical area. And so The State and Art Dakota. There’s a few things coming up here. We’ve got an election coming up. 02:58:28,700 I think the state of the Art Dakota in general has to ask a question. I’m never for expanding government but is a three person. PSC suffice. We have one person that admitted on the take and recused herself. Um We’ve got another one running for election here. Ah! You know we need to change the makeup of that board. Do. 02:58:54,370 We need to make it bigger. Um I to me. At the very least there should be a state moratorium when you talk about ownership. Ah Summit on Steve Botkins program this morning his guest was talking about and I actually took the information from there. And went on and watched the video with Lee Blank from summit. 02:59:21,470 Um they’re looking at 130,000 Acres. So. You’re you’re looking at six townships. This will cover every square inch of six townships in North Dakota. What? This It’s not deadly gas here. It’s just fine. Words that tonight. But you concentrate this at a high pressure level below all that area. What happens? And. 02:59:53,500 I just can’t believe the PSC won’t stand up for us for safety. Um, thank you guys for what you’re doing, and and I every time we hear about one of these meetings, a bunch of us are concerned We better go ours. Early county Gonna bail. I mean that summit. Get to them. Did they get their big checkbook summit here. 03:00:15,270 No, I think they said their present that everything, but I had heard on your radio program today, anyway, that there there at every meeting, But anyway, um I want to extend the thank you as well and Um, this has gotten into I want to throw out there? 11 Last thing that district conventions this year. 03:00:38,870 We have a whole bunch of people. Running. For political office and our Legislature. And. If. There’s ever been a more important time than now. I don’t know when to be involved in North Korea politics and watch what’s going on. We have people. 03:01:01,870 The chose not to attend the district convention because I was too ours and we have Some representation that’s pretty well engaged with what’s going on. Um I’m in District eight and all of a sudden we have Two newcomers that They didn’t come. They didn’t run for election. 03:01:24,230 There’s certainly not representing me or anyone I knew at that convention, but we’ve got it’s time not trust anybody. Because Just about everybody in government right now, that isn’t against this thing is somehow connected to it or being paid or has a vested interest part. So Thank you. Thank you. Bea Streifel Ah, Chair er commissioners. Thank you so much for your I’m sure hours and hours of research that you’ve done. 03:01:59,230 I’m wondering if there’s a way that you could put together the information that you researched Chair er and where we can share it in a in an effective way and get the word out there because I think this is a serious thing that you’ve come up discovered and I’d like to be able to Somehow 03:02:15,470 get it into an article and Dustin’s fry writing it. No, but I’d like to somehow get the information that you came up with. Where even like the notes that you don’t have, where we can put something together that can be shared. I’ll see what I can do. Thank you so much. Thanks. 03:02:38,000 The name is Jeff Jennings. I’ve been in the oil business since 1981. Oh my God an undergraduate degree in July. Geological Engineering. I’ve got a advanced degree in economics. I’ll state right now. Emma 100% behind putting so two out of the pocket. 03:02:57,000 It holds great promise, but probably 1015 years down the road, so that part I don’t have a problem with But as the economist. That’s where I have the heartburn. Uh, speaking of like the ethanol plants, Uh Probably economically. They’re probably margin economic. They wouldn’t be existed didn’t have the subsidies and the, uh, fuel mandates, but that’s not gonna change. 03:03:26,030 I mean the industry obviously, as a large vested interested in that and But, Mike said. My heartburn is We have people in the oil industry. That are looking at getting a free ride on the CEO to basically it’s crony capitalism and I have a pathological hatred as an economist of crony capitalism. I even talked to one of the PRC commissioners, and I said, This is crony capitalism. 03:03:49,400 He agreed with me, 100%, we said, but that’s not We’re not responsible for that. We just have to make sure the I’s are dotted and the teaser cross and I said You’ve got to be kidding me. That’s what you get to follow the loss statement. 03:04:09,270 Ah, basically, that’s what he said Yes, but, uh, if you look at this, the They’re gonna be making billions of dollars a year, and this is virtually 100%, funded by the American taxpayer. They won’t be created a single job that’s actually an economic and possibility. Because for every job they create here in North Dakota, and most of them will be some jobs created here. 03:04:25,870 You’re losing two or more someplace else in the country. And. That’s not right Now. I know the oil is really want the CEO to, uh And. I can understand that. But why do we have to commit an act of crony capitalism to do this when there’s a much better way to do this? We have all this lignite coal. 03:04:44,100 Ah, obviously Washington the way they’re sitting right now. We can’t Build more power plants, but the power plants coincidentally, are located in areas of low population. 03:05:02,730 You build the power plants they can generate all the CO two we need for the bacon will be in low population areas won’t be threatening the major metropolitan areas and we won’t have to be putting in 24 inch or 36 cents pipelines and pumping it from Texas and Iowa and every place else that’s somewhat carbon has added to their list of donors and We would create many, many thousands of jobs probably be adding to the gross domestic product, the United States. 03:05:24,530 This carbon pipeline is going to be actually is not as it could be subtracting from the gross medic Process Products unit, but it will also Be inflationary. We’ve already got an inflation problem. We’re just going to add more to it. There’s nothing more than government spending. And as I said as economist, I have a pathological hatred of this And. 03:05:44,270 It’s got to stop I tell you Right now there’s people out there not gonna be happy with me because I am I’ve been oil industry since 81. And they’re not going to be happy with me at all. But, I don’t really care. I. Have. I have some moral issues with this and that’s where I’m coming from. 03:05:59,270 And I’m I’m going to be at the oil show here, and I’m guessing. I’m probably gonna kiss a lot of flak, but I’m also going to try to change minds. I don’t know if I’ll be successful or not, but It’s kind of my goal. But. That’s where I’m at, And. Uh, this is, uh I. 03:06:18,930 Guess that’s probably the end of list and we have some questions. They want to ask me? I’m You have any questions? Ceiling. Thank you must have done a really good job You did did you know? Did you know what I was doing some research on carbon fiber? One day just just because I had an interest in Welcome with my 03:06:39,270 hobby. I built custom fishing rods, and I wanted to do some carbon fiber. Stuff, So I was doing some research. Did you know That If, you inject C 02 in the seventies, low grade coal veins. Nothing else has to happen, but simple chemistry generates natural gas. Mhm, Who knows. No. 03:07:00,170 Apparently it’s you know. Been studied. Go ahead. I just wanted to speak on the er side of things because you bring up a great point on the enhanced oil recovery and and my point on this Is again. The lack of transparency and trying to fit a narrative to where they think that a narrative sounds the best. And. 03:07:23,070 This is right off the summit. Carbon Solutions website under Get the facts. And it’s the topic of enhanced oil recovery. And this is right off of their page. The Summit Carbon Solutions project will not be used for enhanced oil recovery. 03:07:47,730 The permits we have filed which specifies exactly what we are requesting from regulators note clearly that our project is about the permanent sequestration of Co two concerning the Iowa permit. The Summit Carbon Solutions Pipeline System pipeline Will Transport Carbon Dioxide Co two from participating ethanol plants in Iowa and other Midwestern states to North Dakota for permanent sequestration. The South Dakota permit. 03:08:16,400 The applicant proposes to build a carbon capture and sequestration project that will initially move up to 12 million metric tons per annum of carbon dioxide with the potential for further expansion from participating industrial facilities in South Dakota, as well as C 02 from facilities in Minnesota, North, Dakota, Iowa and Nebraska to a sequestration site in North Dakota, where the C 02 will be safe. 03:08:42,170 Early and permanently stored. Additionally, someone Carbon solutions Sequestration site outside of Bismarck, North Dakota is entirely separate, and apart from the bacon or other areas were enhanced oil recovery is possible. The company is investing $100 million in its permanent storage locations in North Dakota yet in North Dakota, we’re told that this is for E. 03:09:05,470 O. R. So Yeah. Are. They lying to us. Are they lying to the Public Service Commission. Are. They lying on their website. I would like to know. But. 03:09:28,530 There isn’t anybody from Summit Carbon Solutions here at every single meetings that we could ask so that this is off their website and you can check it out for yourself. There’s also nobody from the governor’s office. And there’s also nobody. This project comes from the governor’s office. This project comes from the governor’s office. 03:09:55,700 I don’t see them here defending their position, legislators had proposed eight different bills this last session to strengthen and enhance private property rights in North Dakota and every one of them was killed last minute by the governor’s office. So You, Tell me the implicit E of the governor’s office when it comes to who’s protecting North Dakotans. Who’s protecting the economy in North Dakota. It’s not out of the governor’s office, at least not the current governor’s office. 03:10:15,470 Well, I I think they’re going to need more than $300,000 to reeducate you, Mr Baca. It depends on where their camp is located. You know like that brings up another little deal here. This isn’t on the agenda, but it kind of shows you The focus of the governor’s office on these issues. 03:10:42,130 I have a problem with trying to being sucking money out of North Dakota and getting a free ride. And if you remember back up at Grand Forks where they had that elevator that was going to be the West, not a corn Milling Governors office. 03:11:01,000 To shut it down the city and the military had to shut it down actually that the city had bought into it be at the behest of the Governor’s office. I know the mayor of their very well up. It was the federal government. Hmm. Well. I want to hear our governors speak for the people not against Yeah, it’s not part of his agenda. 03:11:20,400 Good Point anybody else wish to speak on this item? I know this ran pretty late, but I thought it was pretty important to get some information out to the public. It really irritates me that they’re not even paying property taxes. The State of North Dakota for the 1st 10 years to pay the property taxes on that in pipeline. And. That’s US folks. 03:11:36,530 That’s us So anyway, anybody else want to speak? Alright. Ladies and gentlemen, we are adjourned. Thank you Oh, don’t do that. Oh you got you got you got some items in a weird board to go? No. Maybe someone will say Oh, let’s hope they didn’t shut us off. We. Don’t forget about me. Alright, thanks, folks. My bad. It’s okay, Go ahead. 03:12:08,670 Follow that they didn’t shut us up back there. Auditor treasurer. Response Godowsky bids for Missouri Valley complex for farmland. Yes, Chairman and commissioners, The Burleigh County Commission authorized the advertisements for bids on the rental of farmland located in the Missouri Valley complex. This has been advertised in one bid was received from Clark Holman. 03:12:30,000 He offered $50 an acre per year and suggested it be in a three year contract. We’re just looking for for some direction on how you wish to proceed. Commissioners would move to reject. The bed. Money asked him What ground, Sir, did you second it can have a conversation second for discussion. Correct, and that’s what I needed. 03:12:55,670 Um so My first concern is three years. Um, as we developed the complex and as things are growing This is one of the areas that we’re looking at growth. The first year. I have no issue with it because we’re not ready for that yet or I shouldn’t say we they They’re not ready for it yet. 03:13:12,330 Number two when we started talking about AG land right now it’s going for 75 Bucks an acre. And. He’s only offering 50. So for those two reasons. Now. If we want to accept it for one year. I’m on I’m on board. But not a three. Silver purposes and negotiation. 03:13:37,270 I think it would Well, we’ll have to vote on on that, but I think it would be Amenable if We did accept the one year and then Leave it on a year, two year negotiating basis at that I would let it fully support that would let it slide on the first year for at that offered price. But again three years with potential development out there. 03:14:00,800 I don’t think we can commit to that. That’s my concern. Okay? Okay. We have emotion to secondary further. Can’t Just. Leave it out there. Um, no, I I don’t weigh in the wind. Somebody’s going to have to know so well. I think we should. I think we should rent it for one year? Absolutely. 03:14:22,630 One year at a time that Yep. Okay, So. The motion is to reject reject the bids, as is Correct correct. Okay. Call room. Comm. swab. There’s a there’s a motion on a second on TV. Yes, Yes, yes. Comm. Munson. 03:14:54,200 Yes Mr bacon Brian Bitner motion carries I would make a motion to accept the financial offer for the lease of the egg property at the complex on a one year basis second Yeah motion secondary further discussion. Colorado, please Comm. Schwab Munson. Yes Comm. bacon? Yes. Chair Bittner. Yes motion carries. Thank you other business business business. I want to take a moment to invite everyone May 7th at seven o’clock The Bismarck Mandan Chamber e. D. 03:15:23,470 C is, um cheering and open house. To discuss the home rule charter one cent sales tax. Calendar just for clarification tomorrow. That’s tomorrow at seven o’clock? Yes tomorrow, so not only do I get to be here until nine. I get to be there till nine. Take one for the team there. Absolutely. All right. Appreciate that update. 03:15:48,600 Any other. Other business for the Burleigh County Commission. We will adjourn the Burleigh County Commission. And. We will convene as call The meeting to order of the Early county. We’d board first item is roll collar members, please. Sorry. Comm. bacon? Yes. Alright, I should say, uh Chair chair. Yeah Chair bark in here. Comm. Schwab. 03:16:21,730 Here Comm. Munson, Comm. Bittner. Here. Okay. Alright first set him up as approval of the January 17th 2024 meeting minutes moved to approve second. Emotions second and discussion. Call the roll, please. Comm. Bittner. Yes. Mr Schwab. Yes Wayne Munson. Yes. Yes, Uh, item number. 03:16:53,000 Next item up is discussion on wheat officer position and contracting applicators services. Well, we had To weed officers, one lasted five days and one lasted 5.5 days. We’re improving. We’re improving slowly and incrementally, but it’s an improvement cannot wait around. So we are Going to try to get somebody in there and we’ll train them ourselves. We Gotta try something different. In the meantime. We have found a place. 03:17:28,170 Up at the Sheriff’s Department store Chemical I did talk to Comm. woodcocks about it, and he was okay with it. That problem solved. The problem for the weed officer, though, is we have one. We kill her. That has to come. You have to be licensed to do that. My suggestion is And. 03:17:57,530 I think what we’re going to have to do is and I don’t know how this is gonna over Julie’s gone but I’ll have to take the test so we can get this stuff out. Then I’ll have to be the guy that they call up for. Weed killer. There’s no use ordering weed killer. If. 03:18:20,730 We can’t get it off the door for these farmers. So the question is, is that a conflict of interest? I wouldn’t think so. Hmm. It isn’t the power grab. I’ll tell you I wish I wouldn’t have to do it. Is there an opportunity for Subcontracting. 03:18:50,070 With, an adjacent county or Jason counties for application as far as the licensor or are there any avenues through the NDS you extension we can. We can Try that I I don’t think it will be successful. I don’t know why we why that job is overlooked. It’s a well paying job. You know about it for some reason. We’re not the only county by the way in this position. 03:19:13,330 I know we’re not. I’ve talked to several. And. Yes, and I think what’s happening here is that Everybody goes after the experience. We Officers you know they’ve got 10 years experience. And Who trains and starts the new ones. So we’re set up to do that. So if anybody’s listening and looking for a job Get the app in. 03:19:41,900 Until then, though. We have to make a decision I have to. I have got to get an RP out for sprayers and for this chemical Chair, but I need to head committee had a conversation with Morton County at one point you’re six months ago when we were having some of these issues, and there was interest in sharing indoor 03:20:08,600 US hiring their services as needed at that point, and I mean if that’s something we want to reach across the river and ask again, I don’t know. Emmons County. Same thing. I haven’t talked to him as county but Talking to one of their commissioners. Not too long ago there. 03:20:23,400 Was a possibility there as well. Why I think at this point. Um, if we have an opportunity to Share some resources or subcontract some resources from all of the adjacent counties. I think that conversation needs to be had it. We’re getting too late in the year. 03:20:47,000 We need to reach out and address this issue now because it’s not going through the hiring process. It’s just we’re not getting there. The only thing I can tell you is we And when I say we, me The extension. HR. You and Mary singer up there were we have really been trying to fill this job going out the stops. Just I don’t know. Cast that net very wide and it’s not Producing fruit. 03:21:19,070 So do you need Do you need some action in order to start ordering chemicals or I. Don’t think so. But the only action I would need is no. You have a budget for order in the chemicals, so that there you don’t need an action for that. 03:21:41,170 Do you want Do? I need action to be the temporary we’d officer because it looks like it’s the only way right now. We can’t be fooling around anymore. I would assume since were the wheat board. I don’t see it as an issue that one of us is licensed or Is, um I don’t I don’t see that as a conflict. 03:22:04,070 You just want me at the podium so you can be raped me. Absolutely. But if if it’s going to happen, we’ve got to get it done. You know, we I don’t think it takes long to get the chemical in. But when the sun starts coming out, they’re going to want weed killer already reads are already coming up. 03:22:22,600 Oh, That is that is some information. I would like to get out to the public that I had no idea. I was mowing my grass yesterday, and I couldn’t believe the amount of grasshoppers Of all things grass artfully early in the year, there was a Brazilian And. 03:22:42,870 I have never seen that in the spring, so let that tells me is your gardens and your yards and your trees and whatnot. You got to pay attention because it looks like we’ve got a grasshopper problem already. I know I’m going to be spraying for bugs here as soon as they get a break in the weather. Crazy. I mean I was moaning. I couldn’t believe it. 03:23:02,670 So I think that you getting? Um, um, taking the test and getting the license and whatnot is just probably a good first step. If you’re willing to do that? I’m willing, but temporarily, right? Want to be an official. We’d officer but I’ll act as a temporary one until we get somebody So. 03:23:25,670 Are you going to schedule a time to take the tests that are special time that that’s available, or I’ve got all the information on before I Before. I figured I’d go up and take the test. 03:23:49,330 I’d find out That’s what the board Wants to do, I would assume I wouldn’t be on the wheat board, then scheduling time for the tests. I’d be interested in doing that Same thing I I’ll send you that link. Okay, because I know it’s only offered its online study, and then you go up and take the test. Yeah. Well. I’ve I’ve been licensed for a long time. I. 03:24:05,670 Just let it slide during the covid because I didn’t want to go to their any other places, you know, and that would be a good idea. In case I take a vacation. Alright with that which is probably not going to happen. Alright, That’s alright, so Um Reach out to Jason counties and see if there’s they’ve got some capacity to help out. In. 03:24:28,600 The meantime, if you plan on Doing a little homework and taking the test, I guess And. We will we will put on r P? Yeah for the sprayer, and we will order Kevin. Wait. Hmm. Anything else? Alright with that This meeting is
