We pray that, uh people will show up to, uh, have their civic duty, uh, to be a part of these elections and God. We, pray for those that will be elected. 00:00:46,600 Those that are here and stay and I pray God that you will just, uh, guide them. Uh, we always pray that, uh Uh, it’s always, uh, for the betterment of everybody else that we do what we do, and so I, pray for our first responders out there. 00:01:05,800 I get the privilege of being able to be with them and protect them as they protect us, and, uh, we’re grateful for them, Uh, all across this county, and, uh, we do this in the name of Father son and the Holy Spirit. Amen. I pledge allegiance to the flag of the United states of America and to the Republic for which it stands one nation under God, indivisible, with liberty and justice for all. Thank you. Hey. 00:01:34,230 I’ll call the June 3rd meeting of the burly County Park board order. First thing is, uh, roll call, please. Comm. Bakken here. Comm. Schwab Comm. Bam Comm. Herman Comm. Woodcock Comm. Munson Chair Bitner. Next item is consideration of the May 6th 2024 meeting minutes and bills Commissioners I would move to approve. 00:01:59,200 Motion second to approve any further discussion. Non colorable Comm. Schwab. Yes Ker Bam Comm. Herman Comm. Woodcox Comm. Munson. Yes Comm. Bakken Chair Bitner. Yes motion carries Next item is a K old boat ramp. Dredging. Who’s Got that Thank you chair. I’ll Ask Dave to come up. OK? Welcome. Chair and commissioners. Good evening. 00:02:25,870 Uh Yes the knife bolt landing as you remember, we, uh, last meeting The board approved going out and requesting another quote and bringing that back. We did receive one quote in the amount of $10,200 From Midwest dragline. Um, unless there’s any questions or concerns we would recommend moving forward with that. Mr Chair. Mr. Munson. 00:02:48,270 Dave, This is a little bit lower than you were expecting surprisingly, yes, That’s good news did Did, the contractor. Were they able to hook up with a homeowner to try to get rid of some of that spoil or are we hiring or hauling it away? Completely. 00:03:08,330 I wasn’t I wasn’t able to get that confirmed before this meeting. We’ll try and follow up with him, Um, in conversations. Uh, like I said last time. Uh, this is the same company that that did Kimball bottoms. Um, if they are able to, I’m sure that they probably won’t charge as much. Um for the board, semi confident that’s put words in his mouth. 00:03:24,630 But I’m hoping that that would be the case if he was able to dispose of it at a closer location, um, that he would probably reflect that in his final payment. Uh, I did for, uh, Chair Bittner’s, um Question. 00:03:43,270 Last time I did talk with The core of all, possibly disposing of some of that in the Campground area at Nel. Uh, I went up there and took a second. Look with my eyes. Um Unless. We’re going to take out some trees or Possibly compromise the trees in the future if we put too much sand over top, the roots and that kind of thing it causes the problem with them. I. I. 00:04:00,970 Remember last time the conversation when when we did put it there. It was put in a lot of the lower spots and then gravel was brought in over top and packed down for kind of the parking areas. Uh, so I wasn’t able to find anything to dispose of in that location. 00:04:15,930 The core was OK with doing something like that. Um, but I wasn’t able to find anything. The. Unfortunate spot is the only thing that I was able to find was right when we had the drain field for the fish cleaning station, and we can’t do that. Thank you. We did it. Go ahead. 00:04:30,900 We did have AAA local resident who was building a house and reached out and wanted to know if he could use it for F. Uh, we did check with the corps. We checked with the building officials to building inspectors. Everybody was good with it. 00:04:45,900 So we exchanged numbers between the two of the contractor, the building owner and hopefully if it’s worth three quarters of a mile or a half a mile from the bottom bottom mile, um, so it’s a lot less of a haul, so we’re hoping that they’ll get that all figured out in our bill will actually be less than theirs. In the event that doesn’t work out. 00:05:00,300 I do have, um I do know people that live right up the road there, and I’m sure they find some place to Deal with that? Sure, if yeah, if you like to share that information, I can get that to him as well too. I would move to approve the the bid of $10,200 to Midwest dragline. 00:05:23,270 We have a motion in the second to approve any further discussion. NCA role, Please Comm. Schwab. Yes for your beam. Fisher Herman Comm. Woodcock? Yes Comm. Munson Comm. Bakken Chair bener yes motion carries Anything else. I. Wanna invite the public, um to come on out and participate in this, Uh Errol had told us that there is, uh, eight millimeter film in there of of, uh What they were doing or maybe early. You. Want to talk about what they actually have out there. Well. 00:06:10,700 I talked to a gentleman Bob Gellner, who was There when the Capsule was placed And. He indicated that it contained eight millimeter film. Perhaps even a player. 00:06:38,500 And some, uh Um Sound recordings of interviews that they took with people who had been in attendance, so I don’t know about any of the other, Uh, contents of that capsule, but it it’s gonna be interesting. To give you an assessment of the location of that capsule. I think it’s a good question. Yes. I said It was right in front of the monument there, and they had that separate square and it’s below that Concrete Square where the uh black is black is Yep Makes sense. 00:06:59,730 Good? Thanks good. Appreciate you following up on that? Thank you. And Errol had, uh Told me tonight. Now If you read in in the little pamphlet? 1978 the well rigger drillers from unit 916. He was the crew lead of of that Well drill drilling outfit, so Thank you for for drilling drilling that well for us. 00:07:23,900 Hope still working. Yes. Very good. I had a request from Bismarck Rural Fire department to add them to The agenda, So. 00:08:13,070 We’ll put that under other business, any other changes. Chair If. I could I had sent in a late request on Friday after we had done interviews for our investigator position and requested to add that on we can add that under other business as well, that will work for you. Yes, OK. 00:08:29,400 We’ll add that under other business also, and I did have one question Is there a member of Summit carbon Solutions here this evening. There is not OK. Thank you. All, right, so spec one. They say they show up at all the meetings. 00:08:52,400 It was kind of a joke at the PSC this one Um Any any other things to add as far as other business or anything, OK that I didn’t entertain a motion to approve the agenda to approve a second motion the second you further discussion call the roll, please. Mr Schwab? Yes Comm. Woodcox? Yes Comm. Munson. Yes Comm. Bakken Chair Bitner yes motion carries Next is consideration of the May 2020 24 meeting minutes and bills. Comm. Munson, Mr chair. 00:09:15,900 I reviewed those bills today and approve them and I will move that we approve the minutes as well. Thank you. I have a motion and a second and a third by the ice cream cone. Any further discussion called the Roll, Please Comm. Bakken Comm. Schwab. Yes, Mr Woodcock. No Comm. 00:09:43,670 Munson Yes Chair Bittner yes motion carries Next is the consent agenda Commissioners you want to remove anything for discussion or what are your wishes? Move to approve. So motion a second to approve the consent agenda any further discussion. See no color at all places. Comm. Schwab. Yes Mr Woodcock. Yes Comm. Munson Yes Comm. 00:10:08,730 Bakken Chair Bener yes, motion carries excited planning Director flanagan had an appeal of complaint. Welcome, mitch. Good. Evening commissioners, Mr Chair. This, uh, in your packet. Is a notice to owner that was sent On, the 17th of May to, uh, Doug and Kristen Schultz at, uh, 8520 south for Junction. 00:10:40,270 This is regards to their, um storing of Ah Tree debris and tree limbs, tree stumps that sort of thing from the, uh, Beaver Creek Tree Service. I was, um Contacted by, uh Anton. Sailor with the really Bismarck Health department. And. He had a complaint and he asked me if that was our jurisdiction, he said. I said Yes, so I went down there and looked at it. 00:11:02,200 A neighbor up the road had complained about it and Basically what he’s been just putting his, uh, tree stuff there. Trees trash and stuff left over from the job sites and taking it back there and burning it. Um And I know told him that he can’t burn commercial trash on a on a residential private property. 00:11:21,330 And. Then he had 30 days to clean it up or to appeal to you guys. I called them. After The meeting started here tonight and they said they’re on their way They want to see if they can extend the 30 days to six months out from the date of their appeal. To. 00:11:40,700 Get A to get rid of all that, Uh, tree debris, the pictures and in the packet showed different locations. Um The. Uh, The idea is he’s gonna Mulch most of the smaller stuff and take out some of the other stuff. That’s That’s not burnable or whatever, Take it out of there, and he wants to keep in. 00:12:04,070 There’s one picture of larger logs. He wants to keep those on site so we can rip them down for lumber. OK. Were they aware of the date and time of the meeting? Yes. And I. I just called them after you started the, uh, the previous meeting. 00:12:29,770 I went up there and I called and they said they’re on their way. They might not know that this is the building they need to be in, But. I told them it’s at this county Comm.. OK? And I’m not sure if they can add anything. This is what they’re requesting. They do intend to clean this up. 00:12:45,870 I told him that you know, that would be up to you. If you You know if you allow them to the six month Grace period. There is a lot a lot of stuff to clean up. Mr Bach. Uh, mitch, How long have they been dumping this commercial? Waste at this site or various sites on their property. 00:13:07,170 I Since the flood OK, cause there’s a lot of it, so that’s kinda There is a lot in the pictures Don’t really do it. Justice that there’s once you get once you get out there. There is a a I wouldn’t say tremendous, but it’s it will take him at least six months to clean it up. In. 00:13:24,670 Your discussions with them is there Um Kind of a methodology to to going through and cleaning. This up is as far as Different areas or different types of debris because there’s a lot of various sizes, some for mulching, some for Starting some for And then what? Um what is their plan for the stuff that’s not multiple, or the stuff that cannot be removed 00:13:48,130 for Lumber purposes. Where are they gonna Ha! That off to That. I mean what we discussed was no more burning for sure. Um the other one is that he wanted intended to keep the larger 12 inch 24 inch logs for ripping down into lumber. And the other stuff. Here they are. 00:14:11,730 I believe they’re here now. OK, Then you can talk. You. Um So do you wanna come up with? I just explained to him everything that’s going on. Uh, we’ll ask him the same questions. So. Do, You have a plan as far as, uh, State your name for the record, Doug Schultz. 00:14:33,700 Um So do you have a plan? As far as removing this up because some of this, uh Uh, Mitch had mentioned was gonna be used for lumber and logs. We cut into lumber for our personal property and the firewood we cut up For personal use to because we don’t burn hardly any propane. 00:14:57,070 OK and then the stuff that, uh Is not multiple or lumber or fire. Get. They get. I’m assuming there’s going to be a bunch of this, and it’s gonna have to be hauled off. What’s the plan for that we’re we’ve been approved by the state that we can burn on the property. We just can’t burn green stuff. Because. 00:15:13,430 The state is also involved in this, too. But. Our firewood is contained in one area in the center of our 21 acres out by Apple Creek. The neighbors have a community burn pile between four houses right in the center of the property. And. They had just burned it. It’s been there for nine years that we live there. 00:15:35,600 And then all of a sudden, a month ago, they decided to burn it, which I knew why they did it. Because they were turning us in for our personal would But. Ours is not a community. It’s just personal Use. It is segregated away from any buildings. Any property. It’s green all around it. We. 00:15:56,270 Um if we do burn in the pit, we go by the local laws if there’s a burn ban all we turn it into the County for Rural fire rural fire, So they know what’s going on. But. It is never out of control. And. 00:16:15,700 Actually, a lot of the wood that’s on the property is still there from when the 2011 flood and the fire that went through down there. We’re still in the process of getting rid of most of it. But of course, when you do this all day long you go home at night. I mean none of it’s out of control. There’s no branches or anything. 00:16:35,670 No roughage, which it’s states in there that would roughage or whatever they call it. But. It’s all for personal. Mr Chair. Comm. wood. You’re requesting a six month extension. 00:16:56,070 Would you have it done, but that six months But, I’m wondering because we we also hold hold would home and we cut it up every year and utilize it over the winter because we have wood stoves and So this property. I’m concerned about the property. Is the property Gonna be cleaned up by six months from now. But how much clean up Because? It’s not all gonna be removed because we have logs on there that has to dry the firewood has to dry. Then be cut out to be used. 00:17:14,270 OK, but it’s never out of a manageable control. I mean we have skits on the property. We have everything to It’s down by the creek. We have pumps and everything, if if something would ever to happen. But. We’re always gonna have some. There is a little more there. 00:17:31,830 We were gonna work on it over this winter. But Skitz are we bought? The motor went out and it took him all winter to fix it. But. It is gonna be cleaned up more than it is. I’m leaning towards a shorter time period. So we can see some, uh Movement forward. 00:17:58,000 We’ve already started cutting the firewood up and stuff for this next winter, so that’s gonna take quite a bit of out of it. And now we’re going to start splitting the wood or turning the wood into lumber that’s ready. Mr chair Comm. Munson. So. How, would we measure improvement? This is an operation that is ongoing. He Springs Wood home to cut split to burn. 00:18:24,600 And this would be more of a MICH question. You know, so How should that be handled? How? Should it be prepared. How should it be stored And how do we How. Do we gauge improvement, but the thing of it is a lot of that wood is from the property that was there before. 00:18:42,500 So if I took 90% of it and spread it back out on my 21 Acres. You guys wouldn’t even know it was there. But the Guy across the road. He still has a big pile of that They didn’t finish burning. I’m not trying. I’m I’m. No, I and I have no issue with what you’re doing other than it needs to be. 00:19:00,500 Managed, you know, but my question is again to Mitch. How do we Gauge improvement. And. That would be more of a Mich question, Maybe instead of of you question See there. Yep. Bitch. Come back. Uh, commissioners. It’s the first I’ve heard that the state’s gonna allow them to burn. Um And it. 00:19:26,300 It’s commercial trash I we’d have to get a statement from them. We’re not allowed to bring So. What. That’s there is personal would we are not allowed to bring any wood home from the business. And burn in there because it is green yet. 00:19:46,930 And, according to the state, which we never knew is you’re not allowed to burn any wood that you made money on. And the wood. That’s there now and none of its Unless it’s bark or None of it’s really gonna get burned. Except for the rotted, decayed stuff that’s been on the property since the 2011 club. Understand your neighbor’s concerns. I totally get it. But A. Lot of them. 00:20:15,770 They do their own things. One was dumping horse manure over the bank into Apple C. Who The other ones down there with the deck on it. That’s Not A didn’t get a permit or nothing. He’s refusing to do anything with it. The Guy down at the corner of the property. 00:20:33,500 He almost burned down the whole loop because he wanted to use his neighbor’s property and he cut a bunch of it down and just burned it on safe. And. The Real Fire department was even there. I mean just pile is definitely gonna get smaller. Like. 00:20:51,530 I said it was a lot of it was supposed to be done over the winter and We just schedule was not there. So what you and there will be improvement within six months and I guarantee you there because we have already. What. Do you propose that we look at for a way of knowing that I also live on the property. Uh, step up to give your name for the record, please. 00:21:13,400 Kristen Dunbar, um, step up to the we have We have a log mail like he said, Um which I’m Sorry, you turned away and I still couldn’t hear you. Yeah. We have a milk. You speak into the microphone. We have a log mill to rip lumber to make your own lumber. 00:21:30,930 All of our buildings are made out of rough cut lumber to replace any of that we make it ourselves. You can’t cut a A green tree to rip lumber. It needs to sit. We have just started this within the last, probably four years and that’s about what it takes to dry logs. 00:21:54,100 What is there has already been set that it will not go out of that containment because it is for our wildlife. We raise pheasants and let them go. We have deer repopulating in our woods. We don’t allow hunting there. Um, half of our property is considered a As far as we are concerned, um, where it is. 00:22:16,400 It is currently stacked is then to pull out the firewood. The only thing that comes home at this point is maybe a pine log to be able to rip. Uh, we have more than enough firewood on our property. Um, that we don’t need to bring more home. 00:22:38,870 Um, previously before this was brought to our attention, we were bringing home trimmings from work and disposing of them to save on taking to the landfill where they get ground up and The. Same thing happens to him. Um once we were informed of that we take everything that we make for work to the landfill or dispose of it off property through private, Uh, agreements. 00:23:01,900 We have one person that takes firewood. So, um The issue at hand was that we were bringing wood home and we are no longer doing that. OK, um I’m no stranger to this kind of this kind of work, cause I’ve probably had more semi loads of wood cut up and hauled and what I mean. 00:23:23,130 I can’t even imagine the amount of loads that we’ve hauled and handled and and processed and whatnot, including a lot of sawmill operation. So. I understand what’s all behind that? Um I think really. The. Only concern is is The way the neighborhood is kind of heading. 00:23:44,030 And also, I guess as a contractor, I would have a little bit of a concern in what you use that wood for as far as construction because being a general contractor, we know that you have to have graded and stamped lumber to use it for construction buildings. Our barn. Our Our barn or RV Building. Our Little shed is all rough cut Lumber. It is not plan. 00:24:05,830 Don’t say that again. OK? Don’t say that in 1985. Yeah, That’s that these? Um uh, building codes been in existence a lot longer than that, So. I wouldn’t you know, citing I can understand, But I wouldn’t be. That’s what it is. I know. And of course, you know it’s rough, cut lumber it. 00:24:28,970 I know a lot about I’ve been I’m, the Guy that built all the earth lodges at Fort Lincoln. I was involved in the reconstruction of the stable project. We’ve done a lot of historical reconstructions. I understand that. Do Um I. Guess. I. 00:24:49,070 Guess the simplest question I have is is what do you think you can get done in an amount of time that can be verified? Can. You work with Mitch and and have since what do you What? Do? You? Tell me what you think you can do? We can get a lot of the stuff that needs to be at the wood cut up for the next winter and the next summer. 00:25:02,570 Cut up over the next six months, and it’s gonna take a lot out of it. And just some nice stacking of a few logs that we wanna keep is definitely gonna make a difference, but we’ve never had a problem. We’ve never. 00:25:24,270 We abide by all the laws if it’s even a bit drier bit when we have never done anything. And this this concern with the neighbors goes a lot beyond our wood pile wave usually does. And if you want me to get into it, I can get into it. 00:25:40,500 But This is a lot of revenge stuff from a neighbor that wanted something done in the loop that did not get it done, and he was pretty much told to By quite a few. He wants the road. It’s a gravel road South Fork Junction was developed for the people of the horse community with a gravel road for the kids to go around and stuff, and there’s four of them. 00:26:00,830 Straight down the line that you go in their yards and it looks like a golf course. They mow it every 2 to 3 days, which is their right. But they are Mad because we would not pave that road. We would not sign that piece of paper. And since we own the 21 acres. And have the majority of the vote for the Area down there. 00:26:27,330 He’s He’s not happy about it. And. He’s the one who At a Dey bill without a permit and pretty much told Mitch to go. And. This is from somebody else. I heard so. This is just a lot of revenge. It’s stupidity it’s child playing in the neighborhood. We have never done anything. 00:26:51,930 To you can ask Couple of neighbors down there. We. Don’t, even we never even burn when it would blow in the neighborhood unless it was blown towards the creek. A little bit, then we did it. The Comm.. And I grew up. 00:27:12,730 We burned wood when I was growing up because my grandfather was cheap and didn’t want to spend money on fuel oil for the most part, and we went through about 1214 chords of a winter, so I know that rotation on, uh, heating a home and how much that goes through, and that’s a sizable pile of wood. Um Mitch is familiar with the site. 00:27:30,330 He’s aware of this, uh, probably is the best handle. I would, uh Make a motion to get a report from Mitch in three months on what the property looks like and that there’s been improvement and I think we can allow mitch to be the the meter stick to that, Um and just get an update in three months. If I’d I’d make that a motion. 00:27:51,670 Second OK We have a motion in a second to essentially Rehear this in three months, OK? And. Obviously, You know the expectation, right? Oh? Yeah? No I. I understand? I didn’t come in here. I’m gonna tell you guys the way it is. I and I. 00:28:11,730 Totally understand what you where you guys are coming from, too? OK? Mr Chair. I wouldn’t mind going down there and looking at it, too, because I didn’t get a chance to go down there because you’re talking about wood siding and rough cut. Is this a business So. You’re selling rough? No? No, You’re not commercially doing anything. 00:28:29,530 We live in a log house and all of our our barn or or we call an RV building because it was big enough for that It was literally rough cut slabs. So. What is Beaver Creek Tree Services. What is that? It’s our tree business. Or you do tree business Besides this, you know. 00:28:51,400 Are you doing tree trimming in the city of Bismarck or wherever wherever you can find, And you are you hauling that tree stuff down, Do you this? No OK that we we ever since mitch contacted us, We have not hauled a single thing home and we’re not gonna halt and from this point on if we need firewood, it’ll come home at a load at a time and be 00:29:10,270 cut up. OK? We never knew that since you’re in the county that You guys can come in and say, Well, You’re 21 Acres doesn’t look good enough that But it like I said. It’s just a thing of appearance alone. You know, like, for example. Um, before Mile. 00:29:30,930 My Usual time of getting up this morning I jumped up out of bed because I could smell a skunk outside in a around and got a shotgun and went to try to find this skunk. So. It’s, You know there’s bigger concerns, and that’s probably why it went through Anton at the city because that’s the the public health concerns. 00:29:47,030 You know, And so it’s It runs into those kind of concerns. No. I understand this too, Because. I can tell you. I’ve done that same thing in my yard, too. And we never and like I said, semis that we’ve processed. Thousands and thousands of trees. I understand it. We just obviously care about the neighborhood. And. 00:30:09,930 Um Oh, and we do, too. That’s why Half of our property is still the natural river bottoms and The other half is grace to the ground from the horses so the fire couldn’t spread that way. And the woods currently right now are so green that I don’t even want to come to work. OK. 00:30:25,570 So, We have a Mr Chair. Part of trying to mix looking into this, I think should be you said you have a state permit, and I don’t know how that works. Whether that conflict with what we produce that permit right? OK, so That’s part of the report. 00:30:45,270 He’ll come back with that’ll be included in the motion. The second OK. So. You’re gonna produce that, Um Permit from the state. There’s no permits from the state. The State just says you guys, we We will allow you to burn in that pit as long as it’s stuff that’s on the property, and it’s not green. The. 00:31:05,470 You realize that somebody’s going to have to confirm that right? OK Mitch can call. I’ll get you OK? Perfect. All right. I think we’re good with that? Is there any further discussion? Whole role, please Comm. Woodcox Yes Comm. Munson Comm. Bakken Comm. Schwab Sharon Bitner yes motion carries Mr chair. 00:31:30,570 The comments on the permit the unpermitted deck. I issue him to stop work order the last week or last month, and he did come in and get a permit for him. And he has. He has six months to, uh, begin the work on it. So that was down the road. From. Where where? Uh, these folks live, OK perfect. And. 00:31:48,170 I suspect that Comm. Woodcox would like to coordinate with you to have a kind of a site visit. I’d love to. OK. Thank You Comm. Thank you. Next HR director Binder time keeping timekeeping. And payroll. RFP update I Did get your email about meeting over budget. Chair Bitner commissioners. 00:32:14,330 Um, I was hoping to have a decision or a recommendation for you guys to make a decision on today, however. In looking through the RFPS that were submitted. We had one from Tyler Technologies. Who is our current vendor. And when reading that We discovered that our HR payroll module is truly integrated with the General Ledger system. And. 00:32:40,600 There is a update for the General ledger and all of our Tyler technology school. ER P pro, uh, modules that the county uses as a whole So. We would like to request A bid and I. I have done that from our rep for Tyler Technologies to upgrade everything to see where that puts us. And, then have a group of stakeholders. 00:33:04,000 So, the auditor’s office tax equalization. Um, I think there’s some GIS components recorders and ourselves to see Kind of explore the technology that we have the last thing I want is to award a bid for a timekeeping and payroll to another vendor, which there was another vendor that was lower in cost and would give human 00:33:25,870 resources what we need. And then to come back two years later, and we have to do an upgrade for the whole system for everybody else. So then we’re spending more money than what we need to So I’d rather Kind of pump the brakes and and see what Tyler technologies what it would take if we needed 00:33:43,670 to upgrade all of our systems to the cloud. Right. Now. We’re server based, and that’s Causing some issues with, um IT with Conversion. Of the burly county IT. 00:34:08,200 And the Building move because our servers with city IT in this in this building, and we have Our IT and the Provident building, So it may be in our best interest to move to the cloud, but we don’t know and I want all the stakeholders involved. That seems to make sense to me, so I don’t need a decision. I’m just explaining why our RFP results are delayed. OK? OK. Well. 00:34:25,970 I’m OK with delaying it unless the commissioners have any, you know, delay it and follow that path. It seems to make sense. OK. Thank you? Thank you Appreciate that. She of Leben, Burly East renovation. Welcome. He’s changed. Same hair design, though. Uh, evening. Uh, Chair and commissioners. Obviously. 00:35:03,700 Sheriff Liebman is not able to attend this evening on the burly East, Uh, renovation project and all this is discussed previously and there was, uh One issue that had come up that basically needed some clarification. I know, Uh, state’s attorney lawyer was looking at that. And. I believe Lee, uh, was also looking into that as well. 00:35:22,870 Uh, you should have the packet with everything if you have any specific questions, I am up to speed on this, but I think the main question was, uh, with moving the, uh, funds over so and again, I would ask Lee to probably speak on that, or uh, state’s attorney lawyer. Right. I. Think If I recall, Right. 00:35:47,400 The question was, um, since we had taxed for Jail maintenance and that need has gone away since it was that I believe 100,000 if I remember right if that can be moved over, Um Turn lawyer and thoughts on that. Yes and looking into that once you’ve collected something for that special purpose, and you’ve paid off that special purpose than anything that was collected over and above that goes to the General fund. 00:36:06,600 My recommendation is to use it for things that align with that purpose that you originally collected it from. But. By law, it can go to the General fund to be used. 00:36:25,800 However, the commission wants So, would, would you? Would You think that Pairs and maintenance on Burle East is similar to repairs and maintenance on the jail just because the sheriff’s department and again you can use that fund for whatever the commission believes it needs to be used for because it goes to the General fund once that purpose is paid off if there’s any extra money, um, but yes, I would I would agree that that would be an appropriate use for 00:36:39,800 those extra funds. The. Only. Other thing that question that I might have is, I. Don’t think that those available funds were quite going to cover it is that, um, it should be actually very close. Um, we did account for a, uh, an overage going through the numbers today. Obviously. 00:37:01,000 We have old estimates that are several months old, Uh, looking at those again, Uh, for the upper floor was just over 200,000. The lower floor was about 200,000 and I did a little research today, too on my own. 00:37:18,170 Uh, for some of the other miscellaneous items that would fall into this, uh so you’re looking at another 25 there and 12. So right now, a total of 400 roughly 50. We are asking for the 460. So. Not. A lot of cushion. Uh, but some and again those are, um Those are estimates and they’re getting old. So. We all know those tend to go up, not go down. We all know Mr Chair. 00:37:41,530 I did visit with the sheriff last week, and I knew he wasn’t going to be here. But. Uh, we’ve all heard the presentation before and and and so we can use the that gel maintenance fund for the entire amount. 00:37:57,600 Is that what we’re looking at? Um yes, again once that special use is paid off anything extra goes into the General fund to be used as the commission sees fit, so I think we’re ready to go as far as letting bids? Is that what we’re is that where we’re at? Correct. We would write that up and then open up for bids within the next couple of weeks. 00:38:13,130 Leave that open for a certain amount of time and hopefully get some bids in and start the process. OK and I. I would go ahead and move it. We go ahead, allow them to proceed with getting bids and then coming back to us with the final total, and and we do pay it out of the jail maintenance fund. 00:38:29,670 OK I have a motion. Is there a second? Motion second, any further discussion. Um I’m. I’m going to recuse myself from the vote on that. Just in case my company decided to bid on it. 00:38:53,830 Don’t anticipate that we would, but I’m just going to go ahead and stay out of it, so I’d hand that off to Any other discussion. The motion is second call the roll, please. Comm. Schwab. Yes Comm. Woodcock. Yes. Comm. Munson Yes chair and Vice Chair Bakken Yes, motion carried Thank you. Thank you. Thank you. Thank you Comm.. I appreciate that. Uh, engineer Hall. Vacated section line and a storm water easement Welcome. Good evening commissioners. Two items on the agenda. 00:39:24,270 The first item on the agenda is North Dakota Century Code does allow the county board, uh, to close a section line if there, uh, the request for closing the section line meets certain criteria. Uh, the property owners of North Cape Properties LLC have filed a petition to vacate a portion of a section line. 00:39:44,930 Uh, the application is included in your packet. Uh, in addition to the applications, I’ve included a couple of pictures to show you where that particular section line is out. Um, the first step in the process, uh, is to conduct a public hearing at this point. 00:40:04,600 I included a proposed resolution in your packet that’s basically just accepting the petition and setting the public hearing date for that petition for July 1st, um 2024 at five o’clock. I’d be happy to answer any questions you may have. Um I can see that. From this map. It appears that there’s a building on that sector. That is correct. There’s an old log building on that section line. 00:40:29,470 Actually, there’s a couple of buildings that are included in that that 33 ft on both sides, so Yeah. Mr Chair. I happen to go out there this afternoon. It took me quite a while to find it, but I did find it eventually. 00:40:46,930 And, uh, it’s in the middle of some woods and but it does run to the river, and that’s access to the river is very critical. And I. Wanna Make sure that I’ll I’ll move that we go to the public hearing, but Make sure that the landowners and the adjacent area because there’s homes all along there and around there in the trees. 00:41:02,600 You don’t even know what they’re there, but, uh, that they are aware and that we have informed that there is a public hearing and Go from there, but I would move. We move. We move it to a public hearing status. A motion. Is there a motion in a second. Any further discussion. Soon on Calder office. Comm. Ban? Yes Comm. Schwab. Yes Comm. 00:41:25,800 Woodcock Yes Comm. Munson Sharon Bitner yes, motion carries to schedule a public hearing. Thank you the next item I have on the agenda is on June of 2018. The County board accepted, Uh, the Whispering Ridge Second Subdivision plat, uh, in this particular plant there contained several stormwater drainage easements. 00:41:47,270 Uh, the owner of Block one Lot two, has requested a realignment of that a particular easement that goes across their property. There’s several maps in your packet that shows the realignment and this basically has to do with their the usage of their lot and where they want to build their house. 00:42:04,270 And stuff like that, as far as the Highway Department is concerned, as long as the drainage the water is taken care of, appropriately through that particular subdivision. Um, we’re OK with it. Uh, this particular proposal does do that. And. Uh, we recommend accepting the proposed resolution that’s in your packet that is accepting the new proposed drainage easement on this particular lot. So moved second. Uh, motion. Bunch of comments. Seconded. 00:42:34,200 Who Commission will go with Any further discussion. Seeing no call Comm. Woodcox. Yes. Comm. Munson. Bakken. Yes Mr Schwab Chair Bitner. Yes motion carries. Thank you OK? Hey next item. Comm. Schwab, Uh, discussion on amending the 2024 Wheat board budget. I’m gonna have Lee handle that. 00:43:09,000 OK? He’s more in tune with He the budget Guy, let’s put it that way. Good evening, Uh, chair Benner and commissioners. We are discussing the Landowner Assistance program. I’ll just briefly read, uh, the background of the program and, uh and sort of what’s required and then get into it briefly. 00:43:30,270 The Landowner Assistance program provides weed boards with cost share assistance for noxious weed control to be eligible to receive LAP funds. Weed boards must levy at least three mills for noxious weed control or budget, an amount equal to the revenue. That could be raised by a levy of three. Mills. Um So I think in the past, this was an item that Clyde Thompson he did every year. 00:43:48,930 I look back at some previous budgets and, uh and and Clyde made sure that we had the appropriate um, you know budget each year to qualify. I think this is one of those, um, sort of items that just it sort of fell through the cracks in transition. 00:44:13,500 Um, after Clyde retired, and I think Part of the Part of the confusion surrounding this. This this program was the value of a mill. I think there was some confusion that perhaps it was based on the Countywide value, which is $667,000. So at three mils we’d be at, you know, nearly $2 million Looking into the century code. We. 00:44:34,630 We found that the the value that they’re describing here is based on if you draw a square that’s burly county and the city of Bismarck. It’s everything outside of city. It’s inside the county. Uh, limit so essentially country property, so at that it would be AAA value for 2023 of 100 and $65,115. So. 00:44:57,900 We did we did speak to the state? Uh, the AG department about this and a budget amendment would be appropriate. It would, um, we would qualify then for the program this year. Unfortunately, it’s not retroactive, but it would start as of the day we applied, which we would apply tomorrow. In the event that you approve this. So, um We. 00:45:16,270 We included quite a quite a lot in the pack. I think the relevant um, piece is is the actual amendment itself. We would we would require, uh, an additional $93,171 in a budget amendment to reach the three mil. Uh, amount. Um, of that. You know some of that we would bill to land owners. 00:45:39,470 Um if we spray it on their property, And, then they would in turn, go to the state and get a 50% reimbursement. So just because we am Budget in that amount doesn’t mean it’s actually going to cost us that amount. 00:45:54,500 There’s gonna be some revenue that we’ll see to, um so I the the recommendation would be, I think just to be safe. We. We may round up. Uh and that would be to, uh, amend the weed board budget by $100,000 of which I would anticipate 35,000 in chemicals and another 65,000 in in spring. You happy to answer any questions. The, Uh, the additional 30. What. Did you say 100,000 in spring. 00:46:25,330 That would have already been included under the original budget, though, right we would be increasing. The budget. Yes. You’re correct. I. Maybe I misspoke we would be increasing it by that amount. I should have said no problem. Don’t worry about that, Um, because I did. I actually had a chance. 00:46:48,330 Uh, for whatever reason, had a conversation with the State AG Comm. concerning this and exactly as he stated, That’s the impression I get from from the state and the egg commissioners. I have no issues with what That request is it doesn’t look like that increases. Kind of property tax, uh, property tax issue for this year. 00:47:08,100 I don’t know what it does for next year, but Cross that bridge. In the budget session. Well next year. We’re going, We’re going to have to watch What. The Milly does according to the state so that we always meet this criteria. Yeah. Now. That doesn’t mean we go out and have to spend it all. 00:47:30,600 However, we’ve got to meet that criteria and then hopefully is around to help me out with that. Well, and that’s very important that that’s done. Oh. Yeah I. I Think I Think it is, I think it’s It’s It’s a real important program for the citizens of the county as well, Um, but if we budget if we do a Budget amendment And, then that money is not spent, which I wouldn’t 00:47:49,670 anticipate exceeding the need that’s actually in the budget. Um We could probably carry that forward and then continue to utilize that, couldn’t we? Yeah. I Think. In fact if we if we budget three mils for this Program going forward that would be more in line with historically what we budgeted. 00:48:09,500 We just had this one year where it just it just kind of got lost in, uh, I Think in the in the turnover in the department, so it would be consistent with prior years. Mr Chair, Mr wood. 00:48:24,870 Um, we usually do the budget amendments and at the end of the year when we have eight or 10 of them different things that have gone over their budget line, But it, don’t we have reserves on the wheat board? With this so be something we could take out of out of our reserves. Or. Is it something that you have to appropriate it have to be three mills I. I Think. I can answer that. 00:48:41,530 This is just amending the budget, and it’s almost as if the money isn’t the question. Because. We. Don’t. We’re not anticipating spending it. No. It is back in the program. Yeah. It’s just gonna It’s It’s kind of a paper just so it’s legal. That’s All I’m concerned about. Yes, I Yes, it is we all look at Julie. 00:49:02,270 She’s shaking and I’m nodding my head. Yes, OK, then I have no problem with it. And, I think maybe to to address your concern. If we did end up spending the money. Yes. It would have to come out of reserves at some level because we’re not gonna increase the levier. 00:49:18,800 We can’t but it’s my understanding that we’re not doing that. Yeah. I, don’t I don’t anticipate spending The money, but it’s just to qualify for the program. You have to dedicate X amount. It doesn’t say you have to spend it, and we’re doing a catch up here so the farmers can You know have the benefit of the program. Yeah which, uh, did you I So. 00:49:42,330 I moved that we approved second. Motion to second to further discussion Comm. more more of a statement, and then both you and and Comm. Schwab have have said the same thing. 00:50:00,570 This is a very important program for our farmers, and we erred in not having this available and this is the right step to make sure we’re Doing our job correctly. Well. Last year. They determined that they didn’t have The weight off and the wheat board. Didn’t Me to qualifications, so they never put an application in and of course. If it were to come to the commission. We’d have taken care of it right away. But. 00:50:26,600 It didn’t so now it This is the fix. It’s it’s fixed. Yeah. OK? Any further discussion. See uncalled Comm. B? Yes Schwab Yes Mr Woodcock Comm. Munson Chair Bittner motion carries. Thank You Lee appreciate the help on that. OK other business, Uh, Bismarck Rural Fire. Please. Or. He was in line first. I Good evening, Comm. Bitner. And Her chair Been there and Comm. 00:51:02,970 , Um just coming forward with you tonight to let you guys know that, uh, our project for the Fire department is moving forward and, uh, wanted to come and extend an official invite to The Commission for a groundbreaking ceremony that we’re going to be having on Wednesday, June 19th. 00:51:24,330 Um We will be sending out like an actual formal invitement. Probably. Would it go to, um auditors planks to distribute out to you guys, but I wanted to get in front of you guys and let you know in a public being that way. If there’s a quorum you guys can Get, the posting out in the paper. 00:51:39,830 Whatever you guys need to do with that stuff And then, uh, also if there would, uh I kinda talked to Chair Bitner before. If they would somebody would be willing to speak at that ceremony. 00:51:56,800 You Guy as well, Because you guys have been very supportive of the fire department and this project, so I think it’d be great if Uh, if one or a few of you would wanna speak, that’d be great. That’s it just a quick informational thing and then ask from the commission to attend the ceremony. So Well. I. Um I offered that that I would attend. If I’m available Wouldn’t mind having a backup in case Something goes south I used for schedule. 00:52:18,330 But OK, Um, looks like we’ve got it covered. We got all kinds of backup here. A Bunch of volunteers. So, if you wouldn’t mind, just pay attention for any, um, necessary public notice and But. Yeah. 00:52:33,730 I’ll get that public notice here within the next few days to other spanks so he can get it out to you, but it will for sure be at Wednesday, June 19th at six o’clock. OK, good. Thank you very much chief. Appreciate it. Thanks thanks for your patience. OK, Next item. Um State’s attorney lawyer regarding Investigators, investigator position Thank you. Mhm. Thank you. Thank you Comm.. 00:53:16,130 I brought a copy of the email that I had sent out late Friday evening. Um, requesting this be added to the agenda. So. What. I just provided you is everything that went through email on Friday. But in case you didn’t get a chance to look at it or print it out. I brought it along again. Um, Basically. We had a great um applicants. 00:53:33,270 Uh, great pool of applicants for our investigator position I had come before you approximately a month ago asking to convert one of our assistant attorney positions to an investigator position. Um, because The workload that our investigator has, um when I met with Comm. 00:53:49,100 Woodcock and let him know that I was going to do this, he suggested Maybe we should look at how many we needed and do we need more than one additional investigator And At that time I said. No. I think we should just do one see how the workload spreads out? Um, and then we did these interviews and we got to, um, really good applicants, as you can see from the resumes that were there, um, that I had 00:54:06,070 provided to you and, um gave kind of a synopsis in that. Email. Um, the first applicant has 21. Of law enforcement experience with 15 of those specifically assigned to an investigative position. He was also in a supervisory position for a lot of those years as well. Um and we’ve worked. 00:54:23,670 Our office has worked very closely with him and his work is exceptional. Uh, the second candidate has 11 years of law enforcement experience with about 3.5 years specifically in investigations, and again, our office has worked with him for years, and his work is also exceptional. 00:54:43,200 Um, when I talk to HR about, um, potentially looking at maybe adding Another investigator for 2025, because we had these two great candidates and talking with the other attorneys in the office about the things that they’re doing that they could delegate to an investigator. Um, we do have a workload to add two more investigators. 00:55:02,170 Um and because we have the I believe we have three full time and are actually four full time positions that we need to fill for. We have a contract attorney filling one of those positions. Um, we’re asking to convert one of those other attorney positions into an investigator. Position that would still leave us with, um Three full time attorney positions to fill. 00:55:22,400 Um and we haven’t had an applicant for our attorney positions for at least six months. And so I don’t anticipate that we’ll be filling all of those positions anyway, if we left them open, um towards the end of the year and with the amount of work that we have, and that we could delegate the attorneys that we do have could delegate to an investigator. 00:55:37,930 My First request is to convert another one of those assistant, um as assistant state’s attorney positions that are not filled to another investigator. Position, um and I do have in the email that I had sent, Um what the salary is for an attorney versus what the salary is for an investigator, and that would be in within our 00:55:55,530 budget constraints that we have for this year as well. So that would be my first request. Move to approve. Second A motion second to approve any further discussion. I have some I’m totally supportive of this. Think. It’s a great idea. 00:56:18,470 Um, but in another email, there was an email string that was talking about a different issue, and that other issue was the contract Attorneys for the carbon dioxide. Issue and what budget we were going to take that out of my recollection. Is based on the overage in your budget that we were going to utilize your budget as as the funding source on that, and that’s just my recollection. 00:56:36,670 And. So I. I just wanted to make sure that we’re not endangering either one or the other. By doing this Well. Obviously. We’ve had those open positions for attorneys since the beginning of the year, and we haven’t paid out those salaries. 00:56:54,830 Um and then when we did have the discussion about hiring outside counsel, we did talk about how through the years the state’s attorney’s office has turned back over a million dollars the last two years in unpaid salaries, so that was returned back to the General Fund. And, so it’s in either place at this point. 00:57:12,330 And so if the commission wants to use our unused salary portion to pay for that attorney position, that’s fine. We just have to know which line item It comes out of, um, until we use up those funds. I don’t have a problem with that. Yeah I. I just wanted to clarify that. You know, this is kind of what we had already been talking about. And And and and so I. 00:57:26,200 I’m supportive of this, uh, request any other discussion on this? Role, please Comm. Woodcox. Yes Comm. Munson. Yes Comm. Bakken? Yes Comm. Schwab Chair Bitner. Yes, motion carries. OK so the second portion is, as I indicated the two candidates that we’d like to hire come with a wealth of experience again. I’ve included their resumes. 00:57:48,100 Um, the first one has 21 years of law enforcement and investigative experience. The other one has 11 years of investigative experience. Um, our Job application. Our job, um Our job description requires a minimum of five years of law enforcement or investigative experience. 00:58:12,130 And so they come with way more than that, so the most we can offer is up to step five without getting commission approval. Um, given their disparity in experience, um my request is for the individual with the 21 years of law enforcement experience, I’m requesting a variance to pay him up to or to pay him at the level of Step nine in Grade seven. That would be as I indicated. 00:58:33,730 Um, a 67,849 per year. Um, when he was at the Bismarck Police department he was making, um Approximately 97,000 a year, So it’s a decrease from his law enforcement job. He does have a different job. Now, as you can see within his resume, and he is making less than that step nine that we’re offering him. So. 00:58:50,600 This is actually an increase from the job he’s got now, but if we’re comparing his investigator experience, um it’s less than that. Of course he wouldn’t have a supervisory role either anymore, So. That’s why I’m asking for the step nine for that individual, Um, for the other one who’s got about 10 years less experience. 00:59:07,770 We’re asking for a variance to put him at step seven. Again. Um this would be a decrease from his current salary up to about $8000 a year. Um But. Given his experience level I would request that we, um have that variance to pay him at step seven. So mood. Well. 00:59:28,430 We got a motion and a second and a 3rd and 1/4 and I’ll just go ahead and second that five times over, But. Um, any other discussion? Call the roll, please. Comm. Munson Bakken Schwab Comm. Woodcox Chair Bittner. Yes motion carries. Thank you. Thank you. Um I can’t say that I’ve worked with both of them. 00:59:52,100 But I know I worked with them and certainly had conversations with one of them. When back when I had that portfolio for social services, and my recollection was that it was a positive experience. So OK, um Any other business for the good of burly county. I have two things. There’s something laying on on the desk here when I showed up. 01:00:13,930 That was the first OK so it’s gone, OK? All right. Thank you. Um, I. Guess just a little brief update on Uh, this past week was technical hearings at the PSC. Um, along with the attorney’s fees. 01:00:39,000 I also authorized us to have a, uh an expert witness who I don’t know if you saw the testimony on I think it was Thursday. That was a Jeff Stein bun from Indiana. Very very knowledgeable Guy When. It comes to, um uh, the science and everything behind that, and I think he did good for Burle County and my assessment. 01:01:00,370 At this point is that the attorneys that we hired Um, seem to have done a fine job, uh, in their representation of us and Uh, I. Don’t see any problem with that? One of the things I want to point out Is that tomorrow down in Linton is the last My understanding is the last chance for the public to have input on the summit carbon dioxide pipeline, they will be taking public testimony where 01:01:25,530 these hearings all week long was closed to public input. So I guess to get it out there in public. Tomorrow is pretty much the last shot at the Apple for the public to attend. Um That was all pretty clear. OK? Does. Anybody want to talk about anything such as a sales tax or anything else. Comm. 01:01:51,630 Woodcox, Um, let’s not forget that next Tuesday a week tomorrow we have a collection coming up and one of the major things on there as far as birdie count is concerned is the opportunity to reduce your county share of property tax by voting. 01:02:10,270 Yes on the amendment to our our home rule charter, which will, uh, create a one cent sales tax after the half cent sales tax expires. For the jail, it will start a 1% sales tax to reduce property tax by taking that money from the sales tax, applying it to the budgets of the sheriff first and the and the jail and then second, the state’s attorney’s office and 01:02:34,400 third was probably detention center. OK. And. It’s in that order, and, uh it is absolutely I mean I one person said. It’s not a tax reduction. I said it is a tax Of Verde County share of property tax, but we’re diverting it to a different type of tax. But. 01:02:51,400 The sales tax of that, Uh, one cent sales tax, approximately 40% of that is paid for by out of county people that are coming in from wherever California or whatever to with all the business. We’ve got going in the city. 01:03:10,230 Uh 40% of that is paid for out of Burnley County outside of Beley County residence, whether it be a business or a personal, so it’s a very important election for us, and it is Definitely a reduction in your sales tax or your property tax from, uh, the portion of the of the county, which we live with. So. Uh, that’s coming up. We from Merrill. 01:03:26,070 We when I I’d like to ask when do our open sites for elections at the Civic Center Open June 5th. Uh, yes. The.
