00:00:06,430 All right, good morning, everybody. We’ll go ahead and call the uh July board meeting the Burley K and Water Resource District to order. Wendy roll calls, please. Smith, I’m here. And. Here Baker Chair La here we have a corn we will continue moving on to item 2, approval of last month’s meeting minutes. 00:00:34,830 Mr. Chair, I move for approval of the June 12 minutes. Uh, it was, uh, there was just one. Sentence under the Burt Creek spring that needed to be That needed to be added to should be Travis Johnson has offered to complete that work. So with that small change, I would second that motion. 00:00:58,930 Fine, yes, you’re right. Amend the motion to. Include Travis and he has been out there to come one time. OK. Any other changes? Hearing none, all those in favor of the amended. Minutes from last month. Say hi. Hi. Oppose Motion passes. Its are approved as amended. 00:01:30,900 Moving on to approval of this month’s agenda or if there’s any changes or additions this month. Move for approval. 2. Got a motion by Man Biggar, seconded by manager Jones, to prove the agenda as presented. All those in favor say aye. Ay Aye. pose Motion passes, agenda is approved. 00:01:52,200 Uh, just to keep in mind we do have a executive session at the end of the agenda that we’ll move into for McDowell Dam easements, so we’ll kind of go through the McDowell Dan first, those portions and then. Say the executive session for the end of the end of the meeting, so. OK. Uh, moving on to comments from members of the public, not seeing any this morning. 00:02:13,230 Move on to McDowell Dan this morning, Man vinegar. Yeah, I’ll just call on Dave right away for update on McDowell Dam and the budgeting process, yeah. We indeed. Good morning. Uh, update, water is still cold, uh. Still pretty high and things are going well. Uh, we did, David and I did meet with um Jeff Huel. 00:02:43,470 From Uel Design to go through the um shower building and the bathroom to do that evaluation comparing. You know, the The access audit that was performed and the building giving his professional opinion on whether or not we can renovate or we need to replace or. or things like that. 00:03:03,330 So we plan to meet with him, excuse me, uh, within the next week to kind of see what the results are and then I can bring those to you at our next meeting. He said he’s pretty far along in that now, so, um, had a good conversation with him when we met him out on on site. And he thought it would be uh something fairly uh. 00:03:20,430 You know, quick response, reasonable for him to get back to us, so um other than that, um, everything is going really well out there. Yeah, heard you had a, was a triathlon triathlon out there. It was 100 and. Yeah, about 170, 10 participants and David said that uh Every parking spot was full. 00:03:45,370 Even when we open it up for like cross country meets the overflow area that we have in the trees that was full. For, you know, racers and spectators. So good turnout. Good day, good weather for it too, I believe, right? It’s kind of cool in the morning, yeah, it’s good uh good uh triathlon weather. Yeah, good. And it was a good events. 00:04:02,630 Everybody I talked to about it said it’s just a great, great facility to have events like that, so it works out really good for him. Yeah All right. I guess the the other item uh was the budget. Um, I had, um. Emailed Manager Reef with the proposed budget the Park District worked out. 00:04:23,930 Not much for changing for the general day to day things that we, that uh that that are performed out at the um. Out of the dam. The biggest thing was what we had discussed with projects and improvements, um, for capital outlay, um, we included the, the potential for adding that playground and adding another 3 inches of sand, and then purchasing. 00:04:47,600 Another 2 paddle boats. So those are the 33 things that we identified. So those are all on the proposed budget, OK. So now if Uber comes back with some, some other changes or additions would that just be The next year’s budget, or could we maybe work that in next year if we exactly that would be, I 00:05:04,930 think what it would help us determine is where we go with the next for 26, can we You know, we had discussed. The um The secondary bathroom that’s out by the by. 2 and 33 and 4 by 3 and 4, I always get those ones mixed up, um. 00:05:25,400 That one There’s a little bit more work that needs to happen to that to even make the building accessible, um. And then once you do. I, you know, one or two stalls enough. So he was kind of look at that based off of what else is out there, you know, we have. Two shelters really close to that. 00:05:45,370 A third one that’s a decent distance and then if we talked about adding that other shelter out, you know, in the future by the uh um the field, the playing field, that would be 3 shelters and a new playground, so you’re gonna start seeing that in traffic and now now is. two stalls enough. 00:06:03,870 So he was looking at the idea, can we add on to it? Because there’s room to add on the back fairly easily and there’s plenty of space before you get to that parking lot. So he was going to evaluate that or is it easier to just replace it, OK so definitely something to look at for 26, I think. 00:06:24,100 And then the sand got we had the 1st 3 inches brought in. We had 3 inches brought in. We end up what we did is we pushed more towards the, the shoreline because that was really um just kind of walked away or floated away or. Thrown into the water by kids, you know how that goes. 00:06:40,500 Uh, so we pushed more. In that area, so we got started to get about 6 inches down towards the shoreline and then the next. The next 6 or 3 inches I think we might do the same thing with just so we can keep because that seems to be where I mean obviously where everybody kind 00:06:56,170 of hangs out closest to the water. Yeah, makes sense. Mhm. OK. My last question was just like usage, I know if you guys got any updated numbers maybe next month it’d be kind of interesting to see I can get you the numbers for next next month. I’ll get them ahead of time, um. 00:07:13,070 This is about the time that we’re usually pulling the numbers for the the the uh trail counters that we have we have a vehicle counter and a trail counter. I, I’ll get those updated for you. We can give you a. Kind of halfway through the season numbers and monthly. Sounds good, so. 00:07:35,530 Yeah What’s the, what’s the elevation we, we, we nearly overflow or we’re we’re continued overflow, yeah, OK, Yeah, OK. The the consistent rains that we’ve been getting, it’s just staying right there, perfect amount of range really just kind of half an inch every few days, you know. Yeah, very good. All right. OK, thank you, Dave. Thank you. 00:08:02,170 So, um, Uh, also on the agenda, um, that we’re gonna. Move off to the executive meeting following this meeting, uh, is an update on the easement negotiations, and then it’s a part of that I’d like to get an update from uh Michael on the uh water supply simulation, but I thought it uh. A little bit ironic. 00:08:24,530 As you know, this project is to bring supplemental water from Apple Creek up to keep the, uh, keep the, keep the lake high. And I, I received a call, um, a couple weeks ago from a gentleman who was complaining that the uh the level was too high on the lake and it made it dangerous for him to canoe out there, um, so 00:08:42,170 it’s, it’s, it was just interesting to get a different um perspective from someone, um. As far as emergency spill bankways stabilization. Michael, you wanna give us an update on that? Yeah, basically that’s um still in progress we’re looking at that this fall, we do have the full survey and everything’s done. 00:09:02,200 We just did on the plans and specs ready to send out soon. OK, that’s all I have on McDow down for now. OK, all right. Thanks, Randy. OK, we can move on to item 6, financial reports, Mandarin. Yeah, Chair board members, page 6 and 7 in your balance sheet, um. I’ll go through the the monthly summary. 00:09:26,700 Um, we started out with a checking account balance of $968,736.42. We paid bills in the amount of $55,679.26 we had. Income in the amount of $29,475.64 which was by and large real estate tax. We did get a disabled veteran credit associated with real estate tax, which I don’t know that I’ve seen before. 00:09:52,970 Um, state aid distribution and homestead credit. Small amount of special assessment collections for OM and, and, uh, other special assessment projects. some interest and that makes up the total income. It does balance out we have a reserve fund balance of $700,329.62. Uh, which is unchanged from the previous. 00:10:21,930 Reporting month and we have those CDs and and so uh with that I move approval of the balance sheet as presented. OK, got a motion by Man Reap and seconded by Manger Jones to accept the balance sheet for this month. When do you take roll call vote? Any, any questions, I guess, before we go to vote. OK Smith, yes. Yes. Manage your job manager Benegar Chair. Yes, motion passes. 00:10:49,300 Balance sheet is accepted. Uh, moving forward to the profit and loss statements on page 8 and 9 of your packet, um. They appear in order, I guess one thing of note is that our I think our real estate tax and other collections as far as taxes go are slightly behind what the budget allowed for, 00:11:09,570 but, um, all in all, we’re doing fine. Um, Everything else checks out without a I move for approval is presented. Second The motion by Man Reap, second by Man Jones to accept this month’s profit and loss statement. Any questions? If not, we’ll take I vote, Wendy. Manager Smith, yes. Mandatory. 00:11:38,530 Yes Andrew Beer Chair Lin, motion passes. Profit and loss is accepted for this month. Continuing on, we do have a certificate of deposit coming due on July 12th. Um, we do need to take some form of action with it. Um, if we do no action, it’ll roll over at a 0.3% return rate. 00:11:58,770 So we do need to take some type of action. We do have a 10 day grace period, so up until about July 21st. Um, I was quoted those interest rates you see on that hard copy I shared with you in the bottom table for various um durations. 00:12:19,600 Um, We don’t have to renew it, but we would have to just tell them to remove it into our, our savings or checking account if we choose not to renew. Um The other thing that maybe plays into this a little bit of Sibley Island, um. you know, there’s a reserve fund balance there I think that we could potentially. 00:12:40,330 Invest as well, but that doesn’t have to be decided at this moment either just um I do need to Again within the next week, call them and tell them what our wishes are for this, for this one particular one. So there’s one that’s coming due now on July 12th was that that was a three month that we did. 00:12:55,770 It was a 3 month, yes, at the at the 506 and now be so we could do another 3 months at 5:01. Is that kind of what they’re offering? That’s a 5 month 1 to 5 months, so we could choose any duration within that 1 to 5 months. is my understanding. 00:13:14,600 The Do you have any recommendations? I mean, that’s I don’t, I’m not necessarily a financial Guy, but I mean, I, this is typical, right? The, the, the shorter duration have the higher interest rates at this time just in case they do drop and they’re talking about rate cuts I saw in the paper here again, so. Um, I don’t know. 00:13:31,600 I, I don’t have any strong recommendations. I think as far as a cash flow. Uh discussion. I think we’re fine for whatever duration we choose, we have um 2 more coming due in October. That’s what I was thinking, um, for very, very large amounts and so. 00:13:53,400 So could we maybe look at any thought on going to a 5 month with this one, basically push it to the end of the year and if we had 2 more coming due up in October. Yeah, I, I, that’s. Mr. Chair, I’d make the motion that we go to the 5 months. Uh, considering we have more money coming due. In a short period of time. 00:14:12,900 And then look for an instrument for. The entire amount. OK. I’ll second that. and just uh for discussion for clarification, this is the assistant principal amount. There will be some interest that would be in that same fund, would we roll over that? Is that the wishes? I would roll the whole thing over interest and all. OK. 00:14:35,770 you’re good with that? I’m good with that, OK. OK, got a motion by Magic Jones and the second by manager Smith to look at it and extending well, basically renewing that CD for 5 months at the 5.01% interest including all the interest that we gained in this last 3 months on that CD, so. 00:14:59,670 Any thoughts or questions? When do you take roll call vote, please. Smith Smith yes. Chaman line Yes, motion passes. So Dennis, you’ll reach out to, I will. OK, thank you. Item D under 6 is a budget update we did present to the budget committee which consisted of At least 3 of the board members. 00:15:27,970 I can’t recall exactly, but on June 25th, Um, shared a, um, and I think we talked about it this last month, but basically we had put together a budget requesting 1.5 mLs which roughly equates to, you know, a little over $1000. So that was presented in the discussion points I shared. 00:15:52,530 With them Um, I get this up is you know just our statutory limit of 4 mills, uh, 2024, I think the appropriation was 1.58 mils. Um, our major items associated with our budget are McDell Dam operations and capital improvements which are about 45% of our annual budget um income. So, um, talked about our projects that we’ve had, um. 00:16:20,370 The Freshwater intake for McDell Dam from Apple Creek, uh, Missouri I Ihos, Hogue Island in particular we’ve had and the potential very large potential for continued projects up and down the river. So, um, with that, they really Not really any questions or discussion at all and um. So we’ll just let the process play out. 00:16:41,700 I did have one follow-up question from Mark Splokowski just clarifying that our budget request is 1.5 mLs and uh because our budget actually includes some other incomes, interest being one of them, so. And just for some history, I mean, I think we have been as high as 1. 00:17:00,930 3/4, I think at times and I don’t think we ever got close to 2, and I think you know, I think in the states that we can go as high as 3 or 44, so for you. Just so you guys know, I mean, we’re, it’s a pretty limited budget, so we were pretty good at kind of keeping that down, which is good. Good OK. 00:17:19,030 Any questions on that? And just, you know, they’ll finalize, I think Mr. Jones says September is when they actually finalize and improve it, so it has to be this date in September. OK. in August. OK, so we’ll find out that process. OK, um, audit, um, I forget Wendy, if you shared that with the entire board. I read it. 00:17:44,070 OK, well, I got a copy of it. I don’t know why, but I did a previous meetings we discussed preliminary audit results. That was finalized and secured with the board and now it’s public record and so those those steam um material weaknesses they call them, are still present, but I think we’ve addressed them the best we are able to and we’ll 00:18:01,730 continue to address them that way. And indeed you had some comments in the letter as well. Yes, I did. I believe it’s in the agenda uh packet. It seems to me that um it, it’s um a bit harsh to call this material weakness because in my view I’m not a financial person, but this board certainly has backup 00:18:22,200 with manager Reap, uh, looking at the budget and working in tandem with our executive secretary, uh, on a consistent and thorough basis. Yeah. OK, thanks, Dave. All right. 00:18:44,600 Anything else on financial this morning, Dennis, and just to associate with that audit, you’ll see in the bills that we did get invoiced for it and so that’s part of our bills this month. But less than previous yes. That’s good news, good. OK, if no other questions regarding those items, we can move on to items 7 and 8, Andrew Jones, I’m not sure there’s any updates regarding any of the letters have gone out, Mr. Chair, there isn’t grass lake, Gibbs Township. 00:19:11,600 We have never received a formal complaint and so we’re dismissing it. I believe we just missed it last month and then we wrote a dismissal letter to Mr. Schaffer, Sha Shaff. I’m having trouble with my tongue today. Sorry, um. And I believe Michael said we have one new one. 00:19:34,700 There was a request from a landowner to take a look at a culvert. Down in I forget what the township is, but it’s southern Burleigh County I visited with Casey from the highway department and we’ll be consulting back and forth on that to see whether any more action is necessary. 00:19:51,730 Yeah This is the one that’s kind of near the county line that we near Emmons County. OK. More to come then. OK. Any questions for Man Jones this morning. If not, we’ll move on to projects. First one up Sibley Island. Yeah, Mr. Chair, um, I’ll start. Michael can finish. Um, we did, um, ballots were due on June 20th. We did uh. 00:20:23,200 Um, James and I and Wendy uh gathered at her, um, office on June 25th to allow for any mail-in ballots to get delivered via mail. Um, we received 54 ballots. I think we were able to count 53 of them. There was one that was unable to be counted due to an inconsistency. 00:20:44,530 On the uh On the response, but um that one did have no effect on the final outcome we had of those and we had a total of 90 ballots possible, so, um, You know, Slightly over 50%, 60% responded. Uh, the final tally was 35.34% for the project 64.66 against the project so the Assessment District vote failed. 00:21:19,200 Um I guess In in um Summary then. Um, we do have cost share with the North Dakota State Water Commission. Um we do have to get that in for the close of their fiscal year at the end of June 30th, so we do have some invoices from Houston Engineering that will go in for a cost share request or reimbursement 00:21:36,870 request to the state here shortly, shortly, um, other than that, we’ll tidy Michael and his group will tidy things up. Um, From a project. perspective, certainly want to thank. 00:22:01,070 You know, some of the proponents and all people in the assessment District for their their thoughtful um pursuit and consideration of the project, um, also Bismarck Parks and Rec for their cooperation. Burleigh County Highway Department for their cooperation, um, and so I guess that is the, that’s the report that I have, um, I don’t know if Mike, if you want to add anything else to. Mr. 00:22:22,200 Chair and Dennis, from our perspective, obviously, um, there’s a lot of materials that, uh, in my opinion, you know, have value to down the road. Uh, so we’ll be basically, if you want to call it shuffling the deck, putting all the pieces together, making sure that the record reflects the uh the complete aspect of the project and that the files are available to the board for whatever at some 00:22:39,870 point in the future. A couple of things that we need to complete, obviously like Has pointed out the uh cost share reimbursement request to the State, uh, get that processed. I do need to finish the final public hearing document record. 00:22:55,970 I just kind of waited for the vote just to see where that was going to go to complete that, so that’ll be necessary. And then uh. Just kind of the general close out of the project and putting files in place, um. 00:23:13,430 At your request or if you do request, we can give you a um thumb drive or a CD with all the documentation relative to that because at some point in time down the road, you may use that again, um. But I suspect it, you know, that could be a number of years, but I think that’s a prudent perspective given the dollars that you’ve invested in the project, so. Yeah thanks thanks Dennis, um, you had a question? I do. 00:23:31,200 Where are we going to store the thumb drive or the CD. Because we had this issue come up on another project and we couldn’t find the files. So are we storing it? With our engineer, are we going to start with Frontier Or David. 00:23:53,570 Where is the best place to store this? I asked, when do you, is there, is there somewhere at your office that we could store something like that just a simple thumb drive. labeled frontier. You can send a copy of the highway department as just back up, OK, thank you, Casey Casey. 00:24:13,800 Like I said, we’ll have everything on record with Houston, but, um, we will spend a little bit of time reorganizing files, as you know there’s a lot of version control stuff to, you know, clean some things out and make sure that we got everything in a final folder. 00:24:27,700 Um There’s a lot of things that I do and staff does that you know are unnecessary to the final document, if you will, they’re all um background information we want to just get the primary elements um in place so that they’re on the record. I question, Michael, and Dennis, I guess regarding Department of Water Resources and I know we’re, we’re. You know, working for some, some funding assistance there and things of that. 00:24:45,500 Is there somebody there we should reach out to if it’s somebody like maybe in Pat’s group or somebody just to let him know that. Yeah, I’ve already informed Pat relative to the to the vote process at one of the regional meetings kind of told them where that was at, um, I think the one thing that we should be talking about, obviously when we submit 00:25:02,530 the request, which will be um obviously we had to submit the request for funding, um, yet this month. To get it in under the under the guidelines, but uh I don’t know if you want to include it in this letter or a subsequent letter uh given the status of the project to release the remaining funds 00:25:21,000 under the uh cost share agreement. So that those funds can go back out for other projects because you’re not going to be using them with this request. 00:25:34,670 Maybe if you can, you know, you can do it as a separate letter with status, or you can do it as the same letter for the request for reimbursement, so. I can do it in one letter, OK, and then from that perspective, um, I guess I’d look for the authorization from the boards we’ll write the letter for James and the Chair can sign it, Dennis and can collaborate on that one is the uh. Portfolio holder so sound good consensus? Yes, Randy. 00:25:55,800 I think they want him in. Thursday This Thursday, so. 0,,, 1111 sticks in my head for whatever reason. I will, I will ask the question since, as you know, we’re gonna be gone this week, so yeah, no, just for the close out of the previous fiscal year to July 11, yeah, yeah, OK, I’m pretty sure it’s either that or Friday, but 00:26:20,370 I would say it’s 11th. I haven’t, I haven’t seen the notifications, so I’ll have to go back and check, but I’ll call Pat. OK. I’ll send it to you, Mike. OK, thanks. Mr. Chair, and maybe I missed this, but is there a process to notify the landowners of the of the vote tally. 00:26:42,370 So what we did right after the vote in draft form we posted it on our website. We talked about that. I don’t know if we if we want to. I wouldn’t stir them out. The the scenario you got and I’ll, I’ll just speak from my perspective, um, obviously they know they voted, they know what the results are, um. 00:27:04,670 It’s not a small expense to mail notices to everybody. Uh, it’s public information. It’s out there. I think the word is spread as to where it’s at, don’t know that you need to have the additional expense to do that, but it, it’s entirely up to you as far as notification goes. 00:27:22,800 We had a small group of um residents who provided email addresses, but I find it a little inconsistent to send to 15 when there’s 80s out there. So just my observation. 00:27:41,730 But to Randy’s point, I mean, we only got half of the folks voted and so I just wonder if that isn’t a good idea that we send that letter out just kind of letting people know at this point. You know, the product is essentially stalled and we can certainly do that, write a quick letter from the Chair and just say here’s the revolts of the tally. Um, it’s a 113 sentence letter in essence. What you’re thinking, Randy. Just kind of close it out, OK, that’s fine. 00:28:05,000 The consensus with that on the board, yeah, OK. I know Steve Isles was kind of the landowner rep, has anyone talked to I’ve talked to I, I talked to a few as well. OK. July 12th, like Friday. OK, gives me time to go to the convention and come back. 00:28:32,270 Thanks Uh, one more question, Michael, just regarding, uh, I know we had some kind of. Ongoing kind of permit. Processes with this project as well we have to reach outify any of them or OK, so there’s nothing been formally applied for anywhere. 00:28:50,730 The documentation is ready for the applications and would have been submitted had it passed, but at this point there’s no notifications required, so. And it’s probably early, but I was just curious, do you have any kind of ballpark, you know, the board’s gonna obviously take this expense on now because we don’t, we’re not gonna have the assessment district, but by putting you on the spot, Michael, but maybe you’ll have more updated numbers next month, 00:29:06,000 but yeah, I can have a final update, but you’re talking somewhere over the 300,000 at the time I at the time I was thinking figure there’s a couple of different anomalies relative to the transactions and other other costs, but it’s right in that neighborhood and some of those costs we’ve already paid for, yeah, 00:29:22,270 everything’s paid for at this point. So from an investment perspective, it’s expenses that we’ve incurred over the last several years and that’s a total number, right? I mean this is, I mean, not that it’s. Makes that much difference, but some of that’s cost share. 00:29:37,430 Right, yeah, and that’s, that’s one of the things if you want to, I will go back and pull out the cost share and give you a, um, You want to call it the The accounting version here’s the total. Here’s your expenses. Here’s the breakdown, and then what the cost shares are. Thank you Thanks, Michael. OK. 00:29:55,400 And I had to say one more final question I guess Casey, I don’t know if you kind of put you on the spot, but I’m not sure where this kind of puts as far as the counting kind of their projects and. You know, some of their great raises, things of that nature, but I’m sure people are going to be wondering that as well. Uh, you had a great timing. 00:30:09,830 We were just texting about it. Uh, so the gate that’s on Washington Street that goes to Sly uh General Silly Park, the county will get that gate finished. We’ll just take that over and we’ll get that elevated, uh, get the slow skates on there and be able to handle that and get that done. 00:30:29,670 The rest of it for the grade raise of where you’re looking at 28th and on in 48. If the, if this project isn’t done it, the rest of it’s kind of pointless on there so we’ll still honor our commitment of if it’s done, we’ll look at it within 2 years afterwards, but that part’s not done. 00:30:51,100 The flood annex plan will still be 48th, so that’s where we would put a trap bags or a temporary dike going down the roadway and we and we talked about updating the flood annex plan just so that’s it’s clear and that’s what we’re currently doing. 00:31:08,200 Make sure we reiterate it and just clear it out, OK, so I’m sure we’ll get that question now moving forward that probably is what’s gonna happen if there is another flood, so you can speak to the addicts in 48 then. 00:31:25,870 Yeah, we’ve just gotten to the point we with that gate on Washington every time the water comes up, we have to go out there and plug the culverts and we’re well if. This isn’t happening under this project, we’ll just take that over and we’ll get that it just needs to get done, so yeah, OK, appreciate that. Thanks, Casey. Mr. Chair Casey, as we go forward, we did some updates on the plan set for that section. 00:31:43,270 I will share those plans with you and you can use them as you see fit to. Um, do whatever improvements you guys select to do. Yeah, sounds good. Thank you. Yeah. OK. Anything else on Sibley, not seeing any public in here for the public comment portion. And your thoughts, if not. Move on to Hogue Island this morning. Manger vinegar. 00:32:07,430 Yeah, we actually got a few uh loose ends to tie up on that project, um, and, uh, as far as the, uh, Expense review. When that project was originally set up, there was just 11 account number associated with it, um, but of course it needs to be split up into the section 32 revetment works and and the uh 00:32:30,300 work for the uh For the for the residents that were down there and Mike is Mike has done that. Um, And um it it may create some accounting questions as to how, how that was was completed, but it, it is, it is all documented. 00:32:53,800 Um, and then if Mike you wanna touch on that and the bond sales and and then the uh access easement revisions. Yeah, thank you. Um, on page 14, you’ll see kind of the breakdown that we’ve done. It is basically by lot this is what we anticipate the final assessments will be. 00:33:12,030 There are probably a few numbers that’ll be tweaked before the final bond sale, but this is kind of where we’re at, um, we have some legal expenses that are going to be added to the project we looked at what the transaction report was and said these are assigned to the assessment district, the other are, you know, Section 32 or or general board costs. 00:33:29,600 Uh, we expect about a $15,000 bond expense sale and cost visiting with bond. Uh, there’s various portions of there that, you know, fees, etc. uh, we put a a ballpark budget of about $5000 for engineering and legal to kind of step through that process. So all said and done, the project total cost and the distribution was about 457. 00:33:54,670 1,25766. You can see the percentages that are assigned to each parcel, that’s the way this was done based on the amount of material that was on each individual parcel that was controlled and documented during construction, um, we had one property to the north it was 20% under. 00:34:13,870 We did a lot less work up there than, uh, originally thought based on, you know, boots on the ground actually starting to do the project. Um, there was no seating in that particular area, so no charges were for that. 00:34:29,470 There was One property it was about 10% over that was kind of a request by the landowner to put in some additional material with a contractor and like we said, it’s a, you know, biparsial scenario. So relatively speaking, all said and done, the total over budget amount based on all costs considered was about 3. 00:34:48,170 7%, which is, you know, pretty nominal in in today’s day and age with some things of how they work, um, the lower portion on there goes to the sovereign lands and the actual structures. And the costs that were broken down for the Department of Water Resources and uh the director had the ability to approve up to $100,000. 00:35:05,130 We had one structure, um, to be honest with you, it was the one that had the tires and stuff in it to where, you know, basically we, we underestimated the amount of material that it was going to take to redo that one that ended up kind of being rather than a flat slope and end up being a vertical slope. The way it was held. So there was a lot of additional material. 00:35:20,070 So the request of the State Water Commission is going to be for about 133,558676, that’s going to be the split fifty-fifty, uh, like Randy said, we’ll have to show them the actual invoices for engineering and the final cost from the contractor. 00:35:40,470 I suspect that being in Saudi overage, the director will have to go back for the commission possibly to get that approved, but again in the next month or so we’ll put those numbers together, uh, so. 00:35:56,930 All in all, I guess one of the um requests that I got to the board, these are the numbers we can submit a direct letter and see how it is, or is there a desire to have kind of a summary memorandum. I go with this is to the little bit of the chronology and the process to, you know, as far as submittal to the DWR. I mean, it’s up to you. It’s just a little bit of extra time and dollars to actually put that together, but. 00:36:15,600 I don’t know I I feel strongly either way. I mean, and I just, I just put that out there because as you have, you know, potential for future projects, you know, we can probably document a few things in here as to what occurred here so that on the future did come up but I don’t think it’s gonna take that long. 00:36:30,200 It’s just a matter of I don’t want to write something without. The board saying, yeah, we should do it, look at it in the future too. Yeah, I’d be OK with that. This is all you can do it again if you have to. Roger good with that? I’m good. OK. All right. 00:36:49,600 Chair, so we’d have to go back to the state water commission board for that, so we’d get a try to get in by August 26th. Is that, is that a thought, um, that would get approval or consideration at the October meeting. That, I mean, is that doable? Yeah, that’s doable. 00:37:06,970 Yeah, yeah, it’s not gonna take me that long, um, I’ll focus on the. year-end reimbursements, and then I’ll follow it up with this one. And then uh the last item from the easement’s perspective, um, we have some information put together from the easements that’s in essence going to be a board cost, um, we will draft the easements. 00:37:27,870 I’ve talked to Dave about language relative to those easements we can get the exhibits we’ve got that pretty much set up already. Um, but we’ll get the language for the easements and understanding there’s a critical decision here. 00:37:46,930 The easements are primarily set up to make the owners aware and to memorialize the fact that the they’re responsible for the operation or the the ONM of their own residential stabilization, um, if in fact there is a pushback from any individual property owner, um, I shouldn’t say it’s it’s not important because I think it is important, but you still have the easement out there. 00:38:07,970 The issue is in some cases the easement goes through the residents, which isn’t, you know, it’s a clouded title question. So we’re assisting the residents in clearing that up, but if for some reason somebody said, hey, I’m not signing this goes to the other easements we try to obtain, you still have the easement out there and can continue to do what you’re obligated to do under your agreement with the 00:38:23,730 State Water Commission, so OK. But we’ll pursue those it’s not a. High-end thing it would again be probably towards the end of the year we’ll get it cleaned up and and out there, so. 00:38:43,030 And we did FYI once the project was completed, um, had a couple of requests and we got one landowner out there who’s selling their property. They’re going to move to another house, so we gave them what the potential assessment was going to be, um, I will get back to them and update them based on this number, um, and then we had a couple of requests to just say, hey, you know, what’s my assessment? Um, but, uh, 00:38:56,400 like I said, this is now public information. I will share this with the email group which we have everybody in that case. So if you’re OK with that. 00:39:14,330 And ask when was the last time we actually contacted the right after construction was completed and we let them know that things were done and all cost some updated numbers we’re moving forward with We need the action on this at this point, Michael, or are we still kind of waiting to? No, no formal action at this point. It’s just things are online and on track to move forward, close it out. All right, thanks, Michael. OK. Anything else, Randy? All right. 00:39:33,630 OK, here you know we’ll move out over to other old business this morning, um, page 15 of your packet. Is the uh the FEMA CRS assistance. essay that Houston has put together for us here for their. 00:39:58,200 They’re involved in the kind of help and review and and put some of those documents together for us I don’t know, Michael, if you’ve got an update there looks like what 20,000 yeah, generally speaking pursuant to your authorization last month we put SA 29 together for the $20,000 cost with the county. The only thing I didn’t do here unfortunately is I left out page 3, which is a signature page. 00:40:17,570 So at that point I’ll send that to you, James, and we can if the board approves we execute that and uh insert signatures, so, OK. But yeah, we’re looking at the schedule, ready to start that uh middle of July and, and step through the process with the submittal sometime in early 2025. 00:40:37,130 OK, and work with Mitch and crew and, and everybody to put the documentation together. Any questions from Michael on that item? Mr. Chair. Bord Michael, I at the budget hearing that I actually ran into Mary Singer and she asked me about this and, and one of the comments she made was, um, I think it’s coming out of her budget and 00:40:55,330 she wants to have, she would like to have it completed by the end of the calendar year just for budgetary purposes because they don’t have it in the next year’s budget, and, and, and to that point, that’s kind of why we said the, the. 00:41:11,430 The application would be submitted in 25, but the costs would be done, you know, by the end of the year. OK, I just don’t see it, you know. Being done in submitting in November. So we’re probably going to have everything done in December with the application right after the first of the year. 00:41:26,200 So I understand where Murray’s coming from and the budget will seek that, and so and I think just allowing for process we we’ll get the invoice, we’ll pay them, but we’ll have to forward on a request to that agency for reimbursement from them as a way way you have it written up, which makes sense. 00:41:45,470 OK, I will, I will check with Mary on the timeline for submittal because obviously if you Got your last invoice, say the December meeting and then is that enough time for her to process by your end, right? And and I don’t know how critical that comment or request was, but it was, it was a common, OK, fully understand. OK OK. 00:42:06,870 OK, uh, I guess we’ll probably need a motion just to I’ll move to approve the motion my manager Reap seconded by manager Jones to approve the SA uh for Houston on the CRS application assistance. When you take a roll call vote, please. Any questions on that first we’re OK, thanks Wendy. Andrew Smith. Yes Yes. Yes. vinegar, Chair Leberger. Yes, motion passes. 00:42:37,270 So Michael, you’ll you’ll get that page over to Wendy. OK, thank you. Uh, we have here, the Crystal Lake stink Lake Outlet study. Yeah, um, giving you an update on that one, there’s been a lot of conversation that came up at the James River Basin meeting, um, there was a meeting at the Missouri River Basin meaning 00:42:58,900 lower Missouri because it is in the Missouri Basin. It’s not in the James River Basin. Um, so that project is ongoing, uh, Stutzman County Water Resource District and the county Comm. 00:43:15,730 are looking at, you know, where that goes and what it might entail, um, based on the discussion with the commissioners, they wanted me to inform you again that it’s still out there and it’s still on. Going and to provide you, you know, updates as. As they proceed with that process, so. 00:43:34,600 But that would take water from the Crystal Springs area and uh bring it west and discharge it into Long Lake, which ultimately would come all the way through into Burleigh County, so, um. Apple Creek eventually gets into Apple Creek. OK, so All right, thanks, Michael. Any questions for Michael on that one? OK, uh, moving on to item C. I’m not sure there’s any updates regarding ONM agreements. Have a department at this point I’m sure there’ll be some assessments done this maybe this later this summer. 00:44:01,300 I know that Travis and Katey were working on a few of those earlier this year, but we’ll, we’ll work something out to do something before putting on the inspections, yeah, OK. Roger, any updates on the Missouri River Joint board this morning. 00:44:22,070 Oh, we’re going to have an advisory meeting to discuss the agenda for the summer meeting, advisory meetings coming up. I think it’s on the 23rd of July and then the. Missouri River Joint Board summer meeting is going to be August 20. Is that going to be here in town in Mandan at the what do they call that building? It’s where Wade is housed. Um, yeah. 00:44:45,470 I get lost going there every time, OK. OK. Thanks, writer. Uh, no updates I imagine on the policy manual this morning. So then we can move on to item 11, new business starting with Summit Point. Mr. Chair, I’ll step through that one. Casey’s been involved with this one as well. 00:45:11,600 Uh, we did get an updated we met with a consultant who was here at your last meeting relative to the deficiencies, we stepped through the majority of those. And I believe we have, you know, those resolved. 00:45:31,170 We just recently got a copy of the revised stormwater management plan, um, Nick went through it last night and had just a few more questions that he was going to ask Dave about and then uh I would. Say probably within the next week or so it should be resolved in The Chair can be authorized to sign the received document. So it’s taken a while, but uh it’s been proceeding well and there’s been good cooperation to move that forward. Good, appreciate that. 00:45:48,970 Any questions for Michael on that? OK, sounds good. We’ll look for that uh here soon. OK, moving on, uh, any updates, Michael, on the Ice jam No, it’s just kind of ongoing. It’s kind of been set in the background because of some of the other things we’ve had on our plate, so, OK. 00:46:10,800 And we already talked about the state water commission planning forum that was submitted. We had the lower Missouri River basin meeting that we attended last month. Gave updates on. That as well as uh Sibley and Hogue Island. So and then also McDonald Dam, so. 00:46:29,770 Um, I think everybody there really appreciate that, you know, us being there and giving our updates and answering questions, so it’s good. Um, I didn’t. Either under new business in your packet there is a. There’s a meeting. Coming up here for the MPO. July 15th, July 15th, man man. I don’t know if we in the past, I don’t know if we’ve ever really attended in the past. 00:46:54,200 I think it’s kind of more informational I guess, Andy, if you think it is on one of your. Packets, but yeah. Uh, if there’s a need, I can be there. Have, have you received the agenda yet? Just this letter is the only thing I’ve seen. I’d ask for the agenda, Randy. I used to when I was on that board. 00:47:15,430 As for the agenda because most of it tends to be. City issues. Is there, um, Michael, do you plan to attend? No, we typically do not. Every once in a while, the van goes to uh. Comm. 00:47:34,470 Jones point, you look at the agenda and you kind of take a look at it, is there a project of interest to the board. Or or us or whoever at that point. Some of them are background stuff they’ve been the same, I shouldn’t say this, but a lot of them have been on there for a while, and they’re kind of ongoing efforts, some are implementation, so great agenda. I’ll give this Stefan Larson a call. 00:47:52,970 And ask for that agenda, yeah, go from there, OK. Sounds good. if there’s a if there’s, if I feel there’s a need, then I’ll t.y. Yeah Good with that. OK, uh, additional information you kind in the packet there, there is the. temporary permit for Knife Forever, it was a pretty standard and then. That there is a subdivision. 00:48:20,000 You remember that one’s going at, Michael, the Aberly. 6 subdivision not familiar with that one. I don’t think it’s a large one. It’s just a. Probably a several lot. 00:48:41,870 Averly A release I was, you know, I don’t we it’s property Alas up by Big Dall Dam, so I was just curious with that connection or not, this one’s out by 158th um. West over there, it’s a 11 house development, so it’s a one house on how many acres they’re cut out a 5 acre piece, but it’s 1020 acres that the whole surrounding area is about 240 acres, so there there’s a total of 3 houses pretty minimal impact they submitted to stormwater management plan 00:49:09,600 waiver and size the color for the approach. All right, thanks, Casey. OK, uh, any questions on that? If not, we can move on to approval of this month’s bills. board members, page 18, um, as your summary of your bills and all the details follow, um. 00:49:34,900 The numbers do add up, and so with that I would. Move for approval of paying the bills in the amount of $134,301.57 just a large items there are Sly Island Engineering and design and management of that assessment district, and then uh McDel Dam are the large items there. 00:50:00,100 So moved He got a motion by Man Reap and a second by manager Jones to approve this month’s bills. Any questions, discussion? If not, when you take roll call vote, please. Andrew Smith. Yes, managers. And your vinegar car. Yes. Motion passes, bills are approved. As Ma Reid mentioned the rest of the packet is kind of more information and detailed uh the, the bills for this month. 00:50:31,670 Unless there’s any other items, we will now look to close our monthly board meeting to guarantee a motion to hold an executive session pursuant to North Dakota Century Code 44-04-19.2 to discuss Negotiation strategies with our attorney related to easement acquisition for the McDowell Dam and Cybee Island. Oh no, just at this point, just be McDonald Dan project, so. 00:50:54,930 So moved OK, we got a motion by Manager Jones. 2nd by a manager. Vinegar to move into executive session. All those in favor say aye. Propose Motion passes. We will now move into executive
