We’ll call uh this month’s uh Mandan Park District Board meeting to order. Today is November 10, 2025. at the City Hall here in Mandan, uh, additions or deletions to the agenda. OK, at this time we’ll open up public communication for visitors, seeing nobody in the crowd, We will open and close out portion of the meeting, moving on to approval of the October 13, 2025 regular meeting minutes. Opposed motion carries. All right. In item number 2. Nope, item number one. Consider for approval Man and Baseball Club amendment for construction of Phase 2. Bull. President Meske and Commissioners, as you know, last month we approved uh KLJ and the man in Baseball Club to move forward with the project. This agreement before you, Attorney Ruff, had drafted basically just amends our existing agreement to make sure that diamonds 11 and 12 are in place and that the cost of everything from design to construction are all the responsibility of the man in baseball club. It’ll be ran exactly the heck it has in the past. We pay the bills, get reimbursed back from the baseball club. It worked very seamlessly and both, um, the baseball club has reviewed this. I spoke with Damian specifically. He had no concerns with the agreement. I just wanted to add that one of his comments was how do we protect access to the park, meaning through the gates public coming into it, things of that nature and I kind of explained like it is a public facility and that we do control, lock the doors, lock the gates and things of that nature, but at certain times of day, it’s OK, I think, for the youth fields to have the general public to come in there and utilize it and whether it’s play with mom and dad or other siblings or pickup. So it’s one of those conversations I said we can continue to have, but I don’t know if there’s a real solution in trying to a public facility not access to the public. I get that there are events and activities such as maybe teams from outside of the Mandan area that come over and utilize our diamonds for practices or camps or something, we can address those one on one, but they have overall public that’s our goal is to make sure those are open. We do control Memorial Ballpark though. Paul, what is the reason why they’re worried about that. They’re just trying to make sure that their investment speaker system here is a little loud, but I think their investment that they’re putting into it’s over $7 million and just trying to make sure that it’s being protected, but they need to understand that we are a public entity and that the opportunities that we provide are all ages and abilities and we want to make sure that the public has access to them as needed and if it becomes an issue with, you know, whether there’s vandalism or damages of other sorts, we definitely can lock the gates and we do that in the offseasons I think you’re right, Cole, as far as being a public facility and I mean we have other public facilities where there is an open access either. I think one of the main times might be in the spring of the year. One of the reasons that there’s turf down there, so our teams can get on there sooner. And I would, I would assume that we have policy that says our programs and and uh clubs that we work with do have priority over that, so I, that should cover that, I would think too, so. OK. Motion carries on to item number 2, Education on upcoming April 2027 deadline for 8DA upgrades to our district website. Hi, Kelly. Hi, good evening, President Meske and Commissioners. I’m here today to give you an update, um, like you said on our ADA compliance with our goal to to get our website ADA compliant by April of 2027. Um, as I’m sure you’re aware, um, that is a government mandate to have that done for special districts by April of 2027. Um so far what we’ve done, we’ve worked with Mint Brand Marketing to complete a full website audit for 3 of our 4 sites. So the three sites are Man and Park Districts, Staran Sports Complex, and Re Rivers Water Park. So we went through each page and did small changes, which include changes to font, color, sizing, scaling, um, some of the smaller items for what they look at for to become ADA compliant for our website. Um, you can see on the screen here, we did input a wave tracker on these 3 sites, um, so you can see that this page specifically is 77% passed, um, you can see that there’s some errors, um, 21 warnings. Um, they give you this information per page. So we have about 100 pages between those three sites. Um, so right now this Wave checker helps me see that we’re not 100% compliant, but we’re working towards that. Um, there’s still a lot of information that we don’t know that we’re working to learn or to become more knowledgeable in. I did mention, um, the three sites. We do have 4 sites, so our golf mandan.com website is operated by TSnap, our point of sale system. Um, so I’ve also been in contact with them. Um, with them, we’re just basically waiting to hear back on what their vendor says for control. So they are telling us they’re going to walk us through the process to become ADA compliant on our golf Mandan site. Um, so there are three other sites, like I said, are operated by Mint Brand Marketing. Um, another thing that we’ve done was we put alt text on all the images so that you’ll see on websites when you hovering over an image, you know, if it’s a kids playing, it’ll say, kids playing in the ball diamonds. You know, something along those lines. So we are taking the necessary steps, and we’re just learning along the way of what we can do, um, more of the simple fixes that I can do now, um, to become ADA compliant before that April of 2027 deadline. Um, so I mentioned the four sights and then we also have a different point of sale system, as you know, Vermont systems, which control all of our recreation programs and our facility rentals and memberships. Um, so I’ve also been in contact with them and they gave this similar response as G golf Man Dan that they’re going to be working with the vendor. Um, we also have our app with them. So just again taking those necessary steps that we’re learning. Um, another thing is I’ve been talking to the North Dakota professional, um, groups with had that have similar positions to me, um, throughout the Park District. So we basically have a hub for all information, so any news source or any updates that one learns, we all have an uploading place through Clearwater communication. So that’s a good hub for resources and just kind of a gathering knowledge. Um, what we’ve done recently, Cole and I have been meeting with, um, different vendors and things to see how they can help us if it’s a widget we can put on our website to help, um, kind of that AI tool to show us what we need to do to change, to become more ADA compliant. Um, we’ve also met with a company, um, that basically ensures your website, um, for the ADA compliance and gets you to that compliance level, but doesn’t maintain your website when you update standing schedules, etc. so there’s a lot of research done, there’s a lot more that needs to be done. Um, we’re just taking the steps to try to become compliant by that April of 2027 date. Any questions for me? Kelly, and I know we’ve talked about a few of this stuff, um, is there I know we’ve talked about websites and all this stuff, um, if we don’t get done by April 27th, is it OK? I mean, can we go on from there? Yeah, I mean, of course, it’s our goal to become ADA compliant by April of 2027. I am documenting everything I’m doing, who I’m talking to, um, so if there was a complaint that I’d have the proof to say, hey, this is what I’ve done, this is what I know to my knowledge. Um, I’m watching webinars just trying to stay updated. Um, I know Comm Mudder and I talked a little bit about it today that there’s probably always going to be changes and always going to be updates to become ADA compliant, so I don’t see this as like a once all fix all. I feel like I’ll have to continue to learn and continue to update the site. Um, and you know, I did mention that we’ve been meeting with different vendors and I can show you. what an ADA website looks like, um if you look at the screen here, um, one of the vendors we’ve worked with, you can just see that the, the colors contrast, the font stands out. It doesn’t look too different than what our site looks like now. Um, so that’s a good sign. Um, the videos are allowed. The thing that will be, uh, probably the biggest change is just kind of updating our template with PDFs since we use them a lot through standings and schedules and so it’s just a process and just learning as I go. Thank you, Kelly Moving on to item number 3, update on, uh, lower heart water, uh, district, uh, impact tomunni Golf Course Timeline. Well, says the golf courses are closed now for the season and we’ve been attending the monthly meetings. Um, I thought it’d be good to give an update where we’re at. Um I know there was concerns about potentially shutting down a hole number 4, at municipal this year, possibly and even right away in the spring, but the way it’s been playing out in the discussions that we’ve been having realistically, we probably won’t see any impact to the golf course till late fall of 26. Um, they have to get, as you saw the notes and the meeting minutes from the last um October board meeting. Obviously they got to get the permit submitted. They got to get some approvals, they have to do some bidding. There are a lot of spokes to the wheel. so to speak, for this lower Hart water resource district in the municipal component is just one spoke, so there are other areas that have a higher priority list than that one. So if it doesn’t get done in the fall of 26, more than likely it may get pushed till the spring of 27. We do not know at this time Um, Ho as we continue to go to the monthly meetings, we’re gonna learn more, but we were kind of concerned that 26 was going to be the day the year it was going to happen. It, it would be a very high chance, I think, for it to happen in 206, a very low chance, excuse me, I don’t see it happen in the fall based on what I’ve been hearing, what I’ve been seeing. Now, with the government shutdown happened for last month, now, I don’t know how that’s impacted all of the permitting through the corres of Engineers. So again, just some delays on that they can’t control. but a couple of things just to, as you guys are aware, we did, uh, construct that new green, that dollar amount was right around 3800 to $39,000 that we submitted for reimbursement that has been submitted. We will get that reimbursement back, and then any other expenses as we progress, we will continue to submit those as we go, but we don’t foresee anything at this point. The other component that we’re looking at, there may be some mitigation efforts, um not necessarily atmanning Municipal but entire cord or the lower heart we have shared some information that we did with Mitzel Builder when they put that development in. There was some mitigation for every acre you disturb. There’s an acre and a half of replacement. We shared some areas between Prairie West and Manna Municipal as opportunities that if there’s mitigation needed by a lower heart that they could make these improvements and also enhance a facility at the same time to address our drainage or holding ponds or other means of efforts um to go through there. There’s been no direct ion I just shared the information from the last meeting that we were at and so hopefully from there we’ll be able to kind of determine what those next steps are, but. I don’t see anything really happening. If, if it were to happen in 206, all of the deadlines, debt timelines, bidding, financing, warding contracts, all’s got to line up over the winter months and I just think they’re not quite that level yet. So should be minimal impact to municipal golf course in 26. OK. Questions for Cole Does FEMA have a deadline on this project or and I hate to even say that, but I’m going to ask it anyway. I’m not aware of a deadline other than that, you know, we’ve been having these discussions for over 10 years on the lower heart. So I think the extensions and extensions have been there and I think it’s gotten to a point, but there’s once you start seeing the financing getting employed placed, you’re going to see that thing start moving a lot quicker. So some quick updates on the ADA at Star in Sports Complex, the Buick Rink, which was the one we had to retrofit and we um partnered 50/50 with a man in a hockey club with that project. That should be wrapped up by the end of the week. There are a few pieces that we wanted to add for safety. So along the rails so that kids couldn’t step through or fall and garbage could go between there, so we added some additional pieces there that have to get ordered. Hopefully we’ll get in by the end of the month, but that project should be done by the end of the week. We were just there this morning and they’re, they’re about 90% done. So the new ramp on the north side in, the cutouts that were required for uh companion seating have been put in. Everything at Dakota Star Gymnastics is completed, as you know, the Cadillac rink was done this summer. The East Bleachers at the stadium, um, were removed two weeks ago, um, the week of 17th, so next Monday they’re supposed to get delivered if the weather looks, you know, positive for us right now. They will do the installation hopefully have all that wrapped up, um, by the end of the month if weather continues to hold out for us. And then once that’s done, we’ve met all of the standards and the expectations for that ADA assessment there, um, we’ve contacted, um, DOJ out in Fargo and mentioned that this is where we’re at. Do we need to schedule this appointment? And they said, call us once the project is complete. So once those bleachers get in, we will start that process and send that information off. Uh, the boat ramp, we took a picture today with Shields, who donated the ADA lift. um, that lift is here, which is kind of nice. We thought I’d get here a few weeks earlier. so maybe we could be install it, that ADA lifted the boat ramp won’t go in till spring. Um, we’re waiting on a few extra parts that come out of Canada and the tariffs and the shipping is kind of impacted that so that ADA bolt ramp will, um, lift, excuse me, will take place. And then just as a reminder staff are off tomorrow for Veteran’s Day. Yeah Kelly All I have is that region Rover’s Black Friday sale, um, starts on November 24th and is $85 and it’s that sale for one week. OK, good advertising. Um, do you want to talk, I know it’s in our packet at the foundation board, what they’re, what, what we decided that last meeting. I think that’s important for our public to know. Yeah, definitely. So our foundation has a scholarship waiver that anyone can apply for in the Mandan area. Um, we do have some qualifications, um, with anyone in a youth recreation program, you would have to qualify for free and reduced lunch, um, but we did add the exception or the addition to add Schoolyear Mac and Summer Mac, um, as a qualified program. So with this, we will do it on an application basis. So we’ll have that during program registration, we’ll have a two-week period where patrons can, um, turn in their form and if they need a form, they can reach out to me at the Park District, um, or see her at the Park District. So this is a great opportunity. Um, we’re able to do this through the funds through the scholarship, um, the scramble for scholarship golf tournament, um, and then just local businesses that help out too. So it’s a, it’s a great benefit, um, for those that need it. Yeah, so the dollar amount, so we’re able to, uh, fund 100% to 50%, um, is what we’re working with right now. Um, so again, if you apply, it kind of depends on how many applications we get and basically how much money we have, um, so again, we, we’d apply through that two-week period and then I would reach out to them to let them know and we go through kind of an application process so we’re all, we’re all really excited about it. Thanks for sharing. I know that the golf tournament that the foundation’s put on uh continues to raise money for that and we have a lot of donors and people to help with that. So thanks for sharing Attorney Ruff, um, concerning the ADA issues that Cole was discussing up with the sports complex. Um, I’ve been in touch with attorney Corey Laird. He’s out of Missoula, Montana, I believe. He’s the attorney for JLG. I sent him a list of mediators, the agreement that we have with them requires mediation before litigation is commenced. Um, I received an email from him today that any of the mediators are acceptable to him. and he just asked for available dates. when we can, uh, get together, I need to contact now the mediators, see which, if any of them would be interested in handling the mediation and get dates from them, and then we’ll try to get this set up. and Thank you Comm Mutter, I don’t have a lot to say because Kelly’s here and she did everything, so I don’t have a lot to say, but I want to thank, since Thanksgiving’s here, let’s, I want to make sure we thank our staff for all they’ve done this year too, so thanks, Steph.
